Default Land acquisition procedures simplified

Here is a good news for industrialists and real estate developers. They will not have to knock at the doors of district collectors any more for getting 11 different no-objection certificates (NOCs) to obtain the non-agricultural (NA) permission, which is necessary to purchase land for non-farming purposes.

The district collectors will soon confine their activity to see if the title of the land is clear after scrutinising land records. The collector will ensure that the land is not under any litigation or belongs to the new tenure, under which landless and marginal farmers were given land during the land reforms days.

While a decision to this effect was taken at a high-level meeting in Gandhinagar, a government resolution making the new procedure effective will be out very soon, a senior official said. As for 11 other NOCs, including the ones required from the Gujarat Urja Vikas Nigam Ltd, Gujarat Pollution Control Board, roads and buildings department, Indian Railways, Airport Authority of India and the Oil and Natural Gas Commission, the state revenue department will facilitate the process.

The collector’s job will be to grant land title clearance in the stipulated 90 days. The need to simplify the procedure arose because the collectors would often reject the application for getting an NA if he is unable to get the required NOCs within the stipulated 90 days.

A large number of investors, who had signed MoUs during the Vibrant Gujarat investors’ summits, withdrew their decision to invest in Gujarat because of the inability to get NA. Both the governments were allowed to go ahead simultaneously.
