Default Difficulty in Buying in Resale Flat

Hi ,

I am from Ahmedabad , Mr.X have bought a Flat from bulider and the new flat possesion is in Sept , Mr.X have Made 15% payment to bulider from his pocket and Bank Have done 80% Payment from Mr.X Loan Account and 5% of payment is due at the time of Possesion and ther is a Non Registered agreement to sale ( Notaryised) and Sale Deed is not Done till now , and Mr.X want to Sale this Flat to me , How can it be done ?

You will have to go through a property lawyer to get all the documentation done. Since the property is not registered, you will have to now register it on your name through the builder. There will be a tri-party agreement between the seller, builder and buyer to carry out the transactioon. The lawyer will be able to guide you.

First of all you need to get property in your possession and then only you can sale it. Its better understand the rule from property dealer as well as consult a Property spt lawyer.
