Default 'Regularisation' of plot in unapproved layout

Dear friends,
What are the perils/risks of buying a regularised plot in unapproved layout ? My lawyer says it is better to get a building plan approved from the local body (Panchayat !)and also advised to get a NOC from local body !
As posted earlier the layout has been 'regularised' by obtaining regularisation for each plot separately by paying OSR charges and Regularisation charges ! Is there any possibility that shorter road access may be denied later ( the road to present site is meandering and long) as there is no DTCP or CMDA approval for the layout ? Members please enlighten !!

regularised and approved both have the same standing.anyways check out with the local body if the access is a public road

Dear Abk,

As per your above statement if a land is regularised in an unapproved layout and with a 24 feet road then the land is approved?

and is there any timeline or validity for this approval? as one of my relatives is planning to buy a similar piece of land which was regularised in 2003 but the entire layout is unapproved.

Default Insight into building approval falling under panchayat control

If the plot comes under village panchayat control there is no need to get the land approved. You can directly get the building approval from panchayat office and start constructing the house. The Max.. approval limit is 2000 sq.feet above that you have to take DTCP approval by getting NOC from panchayat office

This 2000 sqft limit are you talking about the land or building?

The plot we are looking at is 2050sqft and planning to build G+1 structure greater than 2500 sqft so do we need to approach DTCP only please confirm?

if it is regularised it is as good as approved, so you can get your plan approved by DTCP and start constructing.
where is the plot, if i may ask?

This layout is in Gerugambakkam.

Infact there are 3 or 4 nagars in Gerugambakkam like Lakhshmi Nagar, Chakrapani Nagar and all seems to be unapproved layout with individual regularised plots.

Also for the building plan approval we need to go to Panchayat or DTCP and on what basis?

you have to go to the local planning authority and local panchayat, not to DTCP directly.

Default Panchayat approval limit for building is 2000 sqft

As i said already panchayat has an approval limit of 2000 sq.ft. I mean the building plan approval not about land regularisation. For above 2000 sq.ft you have to approach DTCP in which your area comes under. Before that you need to get a formal letter from panchayat thalaivar.
