Default Court dismisses Emaar's petition

HYDERABAD: A Division Bench of the AP High Court comprising Justice V. Eshwariah and Justice V. Suri Appa Rao on Wednesday, dismissed the application filed by Emaar to review the order passed regarding maintainability of a writ petition which was based upon a letter written by Handlooms Minister P. Shankar Rao.

Dr. Rao, in his letter addressed to the Chief Justice, sought inquiry into the dealings between Emaar and the AP Industrial Infrastructure Corporation (APIIC) alleging that huge public money was snatched away. The Bench issued notices and the various departments including the Vigilance filed counter affidavits and reports.

Emaar raised the issue of maintainability and the Bench declared that the writ petition based on the letter written by Dr. Rao was maintainable as the issue involved public property. The company filed the present review petition contending that the petitioner did not have bonafides and he was acting on instructions of his political masters.

Speaking through Justice Eswariah, the Bench said that the scope of review was limited.

It said, “We do not see any error apparent on the face of the record and no new facts have brought on record that was existing as on the date of filing of the letter or disposing of the said review petition.”

The Bench said that filing of review after finalisation of the Supreme Court order was an abuse of process of law.

Good news. Emaar should know this is India and they are not in Dbai.
