Hi,
I have done the registration of flat in mumbai in the month of Jan 09. However due to certain personal problem I am not able to pay for it. now I want to cancel the registration. I have paid Rs.77000 for stamp duty and registration. please advice me. 1.How to cancel the registration? 2.Will I get the refund of the amount from govt? Reply immediately. Thanks in advance. |

Is it sale-deed or conveyance deed? An registered under-construction flat (which has conveyance-deed) can be cancelled. 1) If the builder is not able to give possession within stipulated time-frame. 2) Both parties agree to cancel the agreement. Normally an agreement can be cancelled within 6 months. For under-construction flat it can be > 6 months. Pls refer the agreement for cancellation related clauses or refer an advocate. In pune 10% of stamp duty is deductible as cancellation charges and remaining is refundable. Remember registration fees are non-refundable. Last edited by hitmady; 08-07-09 at 08:52 AM. |
