Hi
I had booked a flat with one of the renowned builders in XXXX place in 2008. The UDS was registered. I had taken a loan with one of the very very renowned nationalized bank for the same. So the UDS document(registered) and the flat sale deed/construction agreement(unregistered but submitted in the bank for loan) is with the bank since loan and EMI are in progress. But all of a sudden I see that there is another person claiming the same flat. Teh builder has resold the same flat to another person just like me. The person who claims the flat has got very similar documents to that of mine and the registration of the UDS has been done in January this year. He has also got loan for the same flat from some other bank. In this case, please let me know what is the hold that I have got in this flat given the fact that I am already paying EMI and have got a loan with one of the nationalized banks on this flat? The payment 90% has been done to the builder by both of the owners (me and the other person who now claims to have purchased the same flat from the builder in december 2009) Please reply soon How am I to handle this and I dont want to be stranded in this issue ince i have been very prompt on everyhting! |

Feel very sorry for you.....
Thats why Index-II search before buying is very important. The search is basically getting the whole history of that flat or building from the time development started. This is very important in current scenerio where cheating is wide spread. Your property is registered and hence you've got a proper case to file against the builder. Hire a property expert and go ahead with the legal sue ASAP.... It is better if you also post in "Property Fraud & Disputes" section. |

Have you spoken to other guy and checked his credentials? If not than please go ahead and do the same. If you happen to be in possession of flat, than please keep it with you. If flat is still under construction stage, please file an FIR against both the builder and that fellow.
I have come across cases, where someone claim to be the rightful owner of property having all the necessary legal papers in order but upon legal scrutiny turn out to be pawn of politicians or builder's/ developer's concerned. So please go ahead and first file an FIR against both and than consult an good property/ legal consultants. Hope to hear positively from you. May GOD be with you. |
