गाजियाबाद। डूंडाहेड़ा में प्रस्तावित डंपिंग ग्राउंड मामले में सुप्रीम कोर्ट ने नगर निगम, जीडीए और प्रदेश शासन के मुख्य सचिव से जवाबतलब किया है। अंसल एक्वापोलिस और क्रासिंग इंफ्रा लिमिटेड की ओर से दायर याचिका पर सुनवाई करते हुए सुप्रीम कोर्ट ने याचिकाकर्ताओं को भी हाईकोर्ट द्वारा निर्धारित जुर्माना राशि भरने के आदेश दिए। कोर्ट ने जुर्माना राशि भरने के बाद ही मामले की अगली सुनवाई करने की बात कही। कोर्ट ने याचिकाकर्ता को चार सप्ताह का समय दिया है।

क्रासिंग इंफा के वकील केविन गुलाटी ने बताया कि हाईकोर्ट द्वारा डंपिंग ग्राउंड निर्माण में देरी के लिए बिल्डर्स को एक-एक करोड़ रुपये भरने का आदेश दिया था। इसके खिलाफ अंसल और क्रासिंग ने सुप्रीम कोर्ट में याचिका दायर की थी। याचिकाकर्ताओं ने दलील दी कि डंपिंग ग्राउंड निर्माण के लिए जरूरी 45 एकड़ जमीन ही नहीं थी, तो इसका निर्माण कैसे होता। मामले की सुनवाई करते हुए जस्टिस बीएस चौहान और टीएस ठाकुर की पीठ ने याचिकाकर्ताओं की दलील से सहमति जताई। पीठ ने उपलब्ध 14 एकड़ जमीन को डंपिंग ग्राउंड निर्माण के लिए नाकाफी माना। पीठ ने कहा कि पर्याप्त जमीन की व्यवस्था के बिना नगर निगम डंपिंग ग्राउंड बनाने की प्रक्रिया नहीं शुरू कर सकता। इसके अलावा कोर्ट ने यह भी कहा कि एक बार जब जीडीए ने आवासीय कालोनी विकसित करने का लाइसेंस बिल्डरों को दे दिया तो सरकार के भू-उपयोग परिवर्तन के फैसले को हाईकोर्ट रद्द नहीं करता सकता। पीठ ने जीडीए, नगर निगम और मुख्य सचिव को नोटिस करते हुए याचिकाकर्ताओं को चार सप्ताह में जुर्माना राशि भरने के बाद कोर्ट आने के निर्देश दिए। क्रासिंग इंफ्रा ने अपनी धनराशि पहले ही जमा कर दी है। अंसल द्वारा निर्धारित एक करोड़ रुपये की राशि को जमा करने के बाद मामले की आगे सुनवाई होगी।

The Supreme Court has issued notices to the Ghaziabad Development Authority and the Ghaziabad Nagar Nigam on Ansal's petition on the dump yard in Dundahera."Issuing a notice is as good as a stay order. The Ghaziabad Nagar Nigam cannot go further for the proposed dumping ground on that 14-acre land," said Akhil P. Chhabra, president, Crossings Republik Flats Owners Association.
"This is not the end. As residents, we have to wait till the final order passed by the Supreme Court on this dumping monster. Another round of litigation has begun. It may take a few months or years to get finality by the Supreme Court. But till then, the Ghaziabad Nagar Nigam cannot proceed on the dumping ground project," said Chhabra.
"We have other options open to file a petition in the National Green Tribunal. We are discussing with seniors lawyers and environment specialists to file an intervening application in the Supreme Court on behalf of residents," he said.
After the High Court dismissed the petitions against the dumping ground last year, the authorities recently started the construction of the solid waste management plant opposite Exotica apartments on the 14-acre land at Dundahera in Ghaziabad which is on the border of Gautam Buddh Nagar. "The land in question (for dumping ground) was depicted for residential land use in the GDA Masterplan-2021. The Ghaziabad Development Authority changed the land use from residential to that of dumping ground," Chhabra added.
