Try threatening the broker with a case in the Consumer Court . He may want to compromise .

If, this doesn't move the Broker, Hire a lawyer & file a case against him in the Consumer Court .

Default Lesson Well Learnt

First thing is that you have got a very good lesson from the entire episode and may be others will also learn from it that you should not run after discount and go for someone who can give u quality service. I have seen people who change brokers even if the next guy offers them Rs. 5000 less.. come on guys, when you are buying a 50 lacs apartment then 5000 is peanuts, instead of running after it, go for quality service

Secondly, this is india, unfortunately, even though he has given you in writing but you may not be able to take any substantial action against him due to the complex legal procedures. The typical questions would be:

1. why not a stamp / letter head of the broker
2. This letter may have been given by some employee and not the broker company.
3. broker is not responsible for changes done by the builder
and the list goes on...

The best you can do is post here and other forums, consumer complaint boards etc. However,if you are able to bring some action against them then please do post the outcome here for the benefit of the others.

I am no saint . Who gave u that idea ? I just like to take a stand, based on certain very simple principle's in life & no amount of any kind of allurements can make me change my stand .

If one Person has a problem with a Broker , Then Ideally he should go to the builder directly and ask them about the issue and get it cleared himself as he is paying for his property and it will be registered in his name not anyone elses

It is very very easy to write on a public forum and crib about it , But if you have to take the corrective action (as it is for his own good) then he has to move his Back side and do some efforts .........

Send a strong legal notice through a good counsel and mention that you are contemplating to initiate criminal proceedings with a civil suit at the cost of the accused.If you still do not get any relief , get the FIR registered under sections 419/420 for criminal breach of trust , cheating and fraud.If police does not register an FIR , then approach Chief Judicial Magistrate under 156(3) to direct police to register an FIR on the basis of supporting documents.

Thanks a lot friends for your advise.
I will be talking to broker one more time before starting legal proceeding.

Also, I will request new buyers to spend time before choosing a broker. I think there is a quite a bit of mud here.

Why dont brokers understand that by fulfilling one's promises they will get lifelong business and references. simple business sense.

Why to kill the Golden Hen.

Quite true . Developing a long term relationship through transparency & honesty should be the norm, instead of what is happening .

These fraudulent Brokers & their likes look to kill the Golden Goose in one shot & want to collect all the eggs in one go .
