Default Architect Mis-calculation Problem

Hi,

I had recently booked a flat in Pune in Feb 2011, and have payed around seven lakhs for 3 slabs. The registration for the flat is not done due to some dispute of the builder( he says he needs approval for further 3 floors in addition to the existing 18 floors and that my apartment on the second floor is approved).

But my main problem is last week( jan 2012) the builder suddenly says that there was an error in the calculation by the architect and my area measures 50 sq feet more. He claims I need to pay for those extra square feet as well, this is adding to my burden. I wanted to get this clarified, do I need to pay?? Isn't it their mistake??? Please help, its urgent.....Thanks

Hi,

As far as I understood with your post, I am also having the same problem. And I think we are on the same boat Aragog. I am hoping if someone replies us in this matter. Even I came to know that builder was not having approvals till Dec 2011 and they were selling/allotting flats on hyped prices without having even CC and necessary approvals. Plan is still need to be approved by few of the banks. Possession has been delayed one year in current conversation against what we had got promised.

If such kind of things are happening, i have serious question on credibility of Builder?
I have one more question about the agreement of the flat. As per the builder, In agreement he will metion only carpet area and will not including balcony area under agreement. Is it correct as far as agreement is concerned? (I know salable area does not come into picture anyways in agreement).
