Hi,
I am planning to buy a property in India - Andhra Pradesh. As I cannot be present at the time of registration, I would like to do the following: Sign as a buyer, do a left thumb finger print and attach my photograph in Section 32-A form of registration act - 1908 and send one of my relatives as a representative. Form is available for download in http://www.satyasriinfra.com/common/...rPrintForm.pdf My question is: What powers does this representative get in future? Can he sell this property in future in my absence because he is my representative when buying this property? I mean can he misuse this form to sell my property in future because he is my representative while buying this property? Will this representative have any rights on this property in future to transfer, sell or mortgage it? I do not want my representative to have any rights on my property. Thanks, Lakshman. |

In my view the representative cannot sell using this for this is only for that it is meant for i.e."If the Buyer (s) is/are not present before the Sub Registrar" you are authorizing the representative to buy only because you are the buyer there and not the seller
