Default Court Orders FIR Against Parsvnath Builders

In an order passed on Tuesday, the additional chief judicial magistrate (ACJM) directed the police to file an FIR against Parsvnath Developers.
ACJM AB Singh passed the order because of an application filed by a man named Manish Mittal who said the flat that the builders gave him possession of was not like the sample shown.

However, till Wednesday evening, the police had not lodged the first information report. "We have not received the court order yet," said Subhash Chand Tyagi, the in-charge at Noida Phase 2 police station.

According to Mittal, his flat in the builder's Sector 93A was was not like the sample flat.

When he filed an RTI application for information, the chief architect planner (CAP) refused to provide it. The court also made the CAP an accused

This should happen for all builders.And did anyone file a case against the builders in Noida whose building plan has been not approved and builder has not returned money to the buyers??

Sir,

My Mother have purchased 1 unit in Parsvnath Exotica..They promised us to deliever our unit by mid of 2009 or last by the end of same year.We went there in January, 2009 to see the status & was shocked to see there was no construction going .We were informed construction will be started by end of January...but when I went to see in April, 2009 there was no improvement.This time they informed me they will handover our unit only by the end of 2010.

We have already gave them 95% of the total payment I cannot understand if there is slowdown in the economy why should we bear.They confirms that they will give 10/sqf if any delay now they says this we will discuss at the time of possession only.

i was submitted a complain before 6 months but they are not given any attention towards my application. sir i have a vedio recording for their behaviour with clear voice of them.

sir i want ur help for this metter
every day 4,5 peoples are coming in my home.
and give dhamkies to my mom and my sis. becouse no gents present in home in day i m a engineer in a reputed company . thats why i was not present in home in day.
police mans not given any attention towards our report. thats i want ur help sir pl.
i m sufering every day .
in police station we r ecord their voice and pic. also if u see that u beilieve.

Parsvnath not Paying Salary to thier employees from last 5 months
Dear Sir/Madam,

We are employees of Parsvnath Developers Ltd. This is to bring to your notice that Parsvnath has not paid the salary to their employees from last five months. Since Nov, 08 we have not recieved our salary nor we we are getting our conveyance. Several employees have already been sacked and others are being sacked day by day.

This is our sincere request to please bring this case to the notice of the government.

Looking for your co-operation at this difficult junction of life.

Ref: Unit No. T9 – 301, Parsvnath Preston- Sonepat.
I want to attract your kind attention about the unfair dealing of M/S Parsvnath for the booking of above said flat.
The said unit was booked by me on 02.06.2008. At the time of booking I was told by the booking agents that the construction of the said tower will be started in the month of July’08. I visited the site in the last week of July’08 but I found that no work has been started at site. After that I went to site each month and finally in the end of January’2009, I visited the site and found that even after 8 months of booking nothing has been done at site. Even the construction has not been started till date. The company is saying that the construction could not be started due to world wide slow down. I am not responisble for the slow down and this is the responsiblity of the company to arange funds for complition of their projects.
In this connection I want to bring to your kind notice that I booked the unit for my residential purpose, not for investment purpose because I have no spare money for such type of investments. Even for payment of the unit, I had to arrange loans from bank. But after watching the attitude of the company about so much delay in starting the project, I did not deposit more money in the company and also I thank my God that I did not make hurry for loans disbursement by bank. Otherwise I will have been in grave trouble due to the attitude of the company.
All these kinds of promise are only cheating with the customers who are really needed a home (not for the investors) and despite apologizing for the delay by the company, they are threatening me for forfeiting my initial deposit.
I requested the company many times to refund my initial deposit i.e. Rs.1, 68, 918/- with 24% interest because the company is using my money since more than 1year without giving me anything except the pictures of the flat booked by me and I really mean it that I needed a flat not pictures nor promises.
Also I want to bring to your kind notice that non refund of money can cause me bring under depression and also any casuality to me because I am not a rich man and this money was arranged by taking loans from some of my friends and relatives, hoping to own a home for my children. But now the company is neither giving me home nor my money. So, you are requested to look in the matter for refund of my money at the earliest otherwise M/S Parsvnath will be responsible for anything which may happen to me due to this huge loss without any fault on my part and only due to the cheating of M/S Parsvnath.
Parsvnath builder should be banned from India at the earliest. This builder is nothing but a group of irresponsible thugs. The same thing (increased area) have been done in their all project in Noida and Gr. Noida. So it is there common practice to get money out of people. Mr. Jain does not believe in goodwill etc. I have stopped almost 20 new customer from being getting trapped with this thug builder. Also as God see everyone, this builder has got so much financial crunch that 90% of its projects are on hold and construction is stopped. One more interesting this about this builder is ‘The Maintenance of the Complex’ – This builder has got some maternal family members who are given the authority to manage the apartments complex the co. name is Basundhra, these guys just take money from you (monthly maintenance ) and do the work only for 10% of that money. In most of the parsvnath projects the residents are being harassed by this agency for the money which residents are not supposed to pay. like (electricity charges during construction). So Don’t think this builder will be here in the news for long.
I am on same page, I paid full amount to Parsvnath for plot in Dera bassi in early 2007. Project is not even cleared by state goverment. They sent me letter to take refund of money.
I spoke to many officials in last 1 yeas but of no use.
They bluntly refuse to refund any money & offered me to put my money in some other projects.
Still figuring out what would be next course of action..
Any ideas/thoughts, please share.

i have booked commercial shops at kukat pally hyderabad in there malls and paid rupees fifteen lakhs towards intial advance on november 2008 they told work will start in the month december 2008, i waited till febuary 2009 i asked them to refund the amount at there local regional office they taken letter from me of cancellation if you want money within fifteen days you wright cancel on personal reason i given letter but till know 31/10/2009 i couldnot recieved my money. 8days back i have given legal notice know they are telling my file is cleared for payment i will get amount earliest. i dono what is there time limit of earliest. iam proceding to court and i want also expose them in media. one year passed till know i the work has not started and sanction of mall experied they applied for extension i got all sorts of proof. i have lost one year interest plus if i would purchase thier share at the time the rate was 30/= and know it gone above 100/= plus.
Still figuring out what would be next course of action..Any ideas/thoughts, please share.

I have paid 85% payment for Parsvnath city kundli sonepat plot its been 4 years and there is no sign of posession happening …. would invite B block plot owners to form a association and file a formal case

1. I applied for a pre launch registration on 25 May 2004 in Sonipat and against priority 773, I was allotted a plot No 3095 measuring 355 yds in B Block on 30 Jul 2010.
As per advance registration terms and conditions signed on 25 May 04, It was agreed that -

“ In the event your intimation about availability of Plot is made to me after 6 months a interest 10% p.a. shall be paid to me for the period beyond 6 months on the amount paid by me up to the date the said offer of allotment is made in the confirmed project.”

4. Keeping the above-mentioned criteria in mind, the interest on following amount stand to be paid by you and need to be corrected in the letter of statement of account. As per para (c) of advance registration, you are required to provide me interest amounting to Rs 3,28,000/-
Now my question is as per your builder – buyer agreement the project is planned to be completed within 1 yr ie “3 months after last payment” which is 14 Aug 11. But I have checked up with PIO of Director Town Planning, HUDA Complex, sector 15, Sonipat and PIO of DTCP, sector 18, Chandigarh through RTI and they have confirmed that :-

(a) Firstly, your layout plan of sector B has not been approved by them till date and secondly the EDC/IDC pertaining to plot B-3095 amounting to Rs 8,25,375 /- paid to you has not been onward paid to Director Town Planning Sonipat / Chandigarh.

(b) Land which is sub divided into plots and sold without permission from competent authority is considered illegal and unapproved layout. No facilities such as roads, drainage, water, street lighting are provided by the govt to such colonies. Since DTCP have not approved the layout, there is no question of asking for EDC/IDC by them.
On account of your aforesaid dereliction of duty and failure and neglect to rectify the same I have suffered loss. Parsvnath may be called upon to refund the interest of the sum of Rs 3,28,000/- 10% per annum
