My brother was in talks with these folks before Gudi Padwa and had negotiated to about 2750 psf for Sai Laurel (project by the same builders making 10 Elite); 2 days after the festival my brother was told that price now is 3300 psf and will not reduce even 1 rupee. Needless to say, we dropped the idea.

Stopping a cheque payment illegal: High Court Mumbai: Asking your bank to stop payment on a cheque could cost you dearly. The Bombay High Court last week ruled that this could attract criminal action under the stringent provisions of the Negotiable Instruments Act (NIA), which are otherwise invoked mostly in instances where a cheque bounces due to insufficiency of funds. Citing several Supreme Court orders, Justice SA Bobde said if stop payment orders on cheques were kept out of the purview of criminal law, it would “shake the confidence that a cheque is otherwise intended to inspire regarding payment being available on due date”. He also observed that if one was not allowed to take action against people who first issue a cheque and then give a stop payment order to the bank, it would “provide a handle” to those trying to avoid paying up. http://www.swamilawyer.com/2009/09/s...t-illegal.html |

please correct me if I am wrong...
I am payble to X person by all means & I am issuing a cheque to this X person & stopping it.. then It may be illegal.....as I have to pay him at any cost. Here the scenario is different, I wish to purchase something & I dont like it so I have all the rights to say NO until I purchase. So I guess stopping a cheque is not a problem as such.. please correct, me. |

At least send register notice to builder about cancellation of house and of stop payment so that you can be on safer side. |

I have stop payment on cheque twice so far, no problem.
Wonder is this is illegal(seems its a new law as per the post #34) then, this facility of stop payment should be withdrawn by bank itself. why bank facilitate it first and then law call it illegal later? I see no problem in stop payment on check, when you don't have obligation to pay, like canceling the booking with intimation to the builder about the same. |
