Icon25 Power of Attorney Adjudication in Pune

Dear Friends,

Currently i am US and want to buy Flat in Pune.
I have given Power of Attorney to my brother and
have sent a Power Of Attorney (Notarized by the Notary Public in USA)

The Bank has accepted the POA and sanctioned the Home Loan.

However i am curious to know,
  • Does my brother need to adjudicate the POA before the District Registrar?
  • Is there any other legal process my brother has do in Pune before buying a flat on my behalf?
  • What is the process of registering the property/paying stamp duty?

I am confused and need your experts views/experience/suggestion....

Yes your brother needs to get it adjudicated not sure if in front of DR.

But is that ok to go for registration of POA just notarized in USA.

Does anybody has adjudicate the POA in Pune?

Or Bought a Flat using POA?

Please Please share you experience.

I would suggest first finalize the flat and then look for other technical hurdles. There are always solutions to these issues.

For POA, as per my experience , notarized POA works for both registration as well as for Bank. Only thing is both formats and contents of POA is little different. Bank has their own format and they accept POA in their format only. Regarding Adjudication its get it done by Builder for registration and by Bank's agent for home loan. You don't need to worry about.

Between some bank's like SBI needs POA signed by embassy however private bank's like HDFC and Axis just needs POA notarized.

I have notarized the POA sent by LIC Housing and the loan got sanctioned
from LIC.

Can i use the same POA for registration since the POA has clause that
attorney can purchase a flat on my behalf.

That you need to verify from Builder where you have/will buy the flat.
They will guide you. Registration is not just only your pain. So let builder tell you what he needs.

I would suggest to get your paperwork sound by consulting some lawyer as you will be & not the builder be on receiving end in case any error.

Anybody has had an real experience using/giving POA and
bought/in process of buying Flat in Pune using POA???

The personal experience will really help me.
