if the builder has not started the construction yet, means he doesnt have the GDA approval for the same. as simple as that. try to squeeze the info out of the builder. u cud consider getting the money back from them as well n put into the under construction project .it might turn out to be expensive deal but u'd have atleast peace of mind.

Yes i have the agreement. I am plannig to go to there office in JULY as i stay in bangalore.During my visit to there office i will check all the neccessary documents.In the agreement they have given the possession time of 30 months. i had agreement in JULY 2012. so still there is time and i also spoke them regarding the change of flat in underconstruction building(tower 1) they are selling for 3100 per/sqt which will be very expensive for me and also i was wondering if the two tower in the society is not approved then how come society will have value with only one tower.So i was planning to take back my money and invest some where in reliable place.

PS:If any one else is planning to visit there cop. office, guys please let me know even i will join you guys.

Hi All,

Please enlighten me about the legal way to take money from the builder.

Also, is it okay if builder deducts 10% while returning the money back. After all, it is not our fault that he doesn't have the approval. We have trusted them with hard earned money.

Complete money should be refunded.

I am talking about Krishna Garden for which nothing is in media or on papers/advertisements.

Please guide.

Hi all,
Any one planning to go to there corp office this week.If yes, please let me know. I am planning to go and ask the status of my flat in 2nd tower in aparmeya residency for which construction has not started. So i was planning to go to there office and ask complete detail of the permissions they are waiting for approval.Lets meet together and go to there office.I am in delhi till 13th later i will be travelling back to bangalore. let me know please if any one intereted to visit

Agenda for the visit :
1)Permissions waiting for approval.
2)If it gona delay then transfer of flat registration in current on going project.
3)If not then we can ask for refund amount.

Write a registered post to builder for BBA signed as you have made payment to them. Without approval they can't issue BBA and If builder fails BBA then you can put pressure them for refund even consumer court will help you in this regard.

Default Regarding the discussion Had in builders corp office

Hi All,
I have been to there corporate office on 12th July. Didint meet the builder but the corporate office head sushil mishra, Asked him about the status of Aparmeya residency remaining two towers.He showed me the approved permissions,i read and it was lil satisfying but then i asked y the work is not yet started for other two towers if you have all the permissions, he started saying that Zone plan is not apporoved by the UP govt. and they are expecting to get approved by this nov. I dont know how far this is true.Please let me know if this is only the issue. I have less information about the permisssions builder should have but what all he showed i can brief you guys to help u understand the situation in better way :
1)He had permission from IIT roorkee for height i guess.
2)He had some pernission for 41 or 14 form not sure about (the form )it.
3)Water permission he showed.
some more he showed i dont remember.
But at the end he said that zone permission is awaited from UP govt.So please let me know if this is only issue. If this is not the issue then i will pressurise him to give my money back.

I think , you have to ask for money refund from builder , as alredy 3.5 years has been passed . please take help of any advocate & file the case on the basis of builder / buyer agreement.

Please share the phone nos of all corporates guys . ( like sushil mishra)

Default Bad news.!!

Hi Real Guru,
To my Knowledge i got to know this recently that there was no BBA done between me and builder as my uncle went to book the flat,we just have details in the letter head of Krishna builders and developers regarding the allotment of the flat and other payment plan details.Also we have the cash reciept of the payment.i assumed that he is having BBA when he said he has the papers.Is there any possible way to get money back. Please i need your help.

ps:Sushil mishra is site officer of APARMEYA RESIDENCY
