2. The company subsequently invited all members, who have booked unit in the said housing project, to submit their selection for allotment of unit through a ‘selection process’. They have prepared a priority list as per the priority assigned at the time of receiving the booking application. I was given a Priority No. 109 among 293 members and was called on 2nd July 2012 to submit my choice for the unit. The selection process started on 30th June 2012 and finished on 5th July 2012. 3. Though it was quite a transparent process for allotment of unit, I have not received any communication about the section process. I only came to know about this process, when it was already finished. I checked from the company, they informed me that they have sent an invitation letter (24th June 2012) through ‘speed post’ at my residential address which was returned to them ‘unclaimed’. They also showed me an incorrect email id where they have sent a copy of invitation letter. When I asked them why I have not been informed over the registered no., the company executive showed inability to answer. 4. I have asked them some specific question :- (a)As to why the speed post was sent so late when there were only 6 working days left for the selection process ? (b)When the speed post was returned unclaimed to the company, why the company have not sent any reminder keeping in view the complexity of such an important process ? (c)The invitation letter sent at the incorrect email should have bounced back, why the email id was not crosschecked with me over my phone ? (d)Last and the important one, why I was not informed about the process over my registered phone, which is considered to be the fastest mode of communication ? 4.Not only this, the company is now offering me 19th floor (top floor) though my Priority No. is 109 and could have got below 5th floor unit in case the company would have communicated appropriately. 5.Now, when I am asking for refund of my booking amount of Rs. 10,87,191/-, the company answered quite ‘surprisingly’. Instead of returning the booking amount with bank interest rate, the company is claiming to deduct 15% from the booking amount, which is a clear case of cheating on the part of the company. 6.Senior member please help me as to what is should do in this scenario to get my hard-earned money from this fraud company. Is there any government authority/ agency who can help me in this case? |

take the allotment and put it on sale in the market , you might get 100 , 200 Rs premium....
And then Dont invest with this builder again..... Secondly , Did u book thru a broker ?? If yes , then Did u check with him on a monthly basis about the allotment dates...??? I understand that the company is at fault here but , this could have been avoided if you has been a little proactive on your part....Since it has been close to an year from Pre launch , You should have been activly seeking updates directly from the company regarding the dates of allotment . Did u write the correct Email Id on form ?? If yes then Company is at fault here as well , otherwise if the Id is written incorrect by you , then it will be wrong to blame the company for that... In the end , all said and done , I would suggest you to take the allotment , sell ur unit and move out of the investment with positive cashflow hope this Helps |

and BPTP is nthing different from Dlf, emaar, unitechs of the world.. In this industry, people now have such low expectations, even if a company just do the basics right, people will be willing to reward it with huge premiums. The case in point is Chintels, Ireo and the three corporate (Tata, Godrej and Mahindra) |

Amit Ji, one can only hope in the case of Chintel that it is able to execute properly. There is a difference in being a Land banker and being able to deliver a group housing. Ireo will most probably be able to deliver a class product.

sureman, I would also like you to check ur application form. These days builders are putting a clause saying that they can't be held responsible if communications go the buyers address are not delivered in time and they are also nt responsible for sending any reminders.
also I would second amit bhalla. |
