Can first appeal is considered valid via email ?

My RTI is not being answered even it's more than a 50 days including sat sun n holidays...do they count only working days ??

Another way of calculating Revised EDC as per latest Rate by HUDA (though a bit crude but removes the problem of disclosures by builders
= EDC psf charged by your builder say, Rs 330psf X New Rate Charged per Acre as per Revised HUDA memo/Old Rate Per Acre by HUDA as per earlier Memo.


Eg:
The old rate of EDC (as per Huda memo HUDA-CCF-ACCTT-I-2010/26813, dated 02.07.2010) was Rs 249.899 Lacs Per Acre (cross check through RTI w.r.t. year of license)
The new rate of EDC (as per Huda Memo HUDA.CCF.ACCTT-I-2010/44973, dated 23.11.2010) is Rs 176.28 Lacs per Acre (attached public Notice may be referred)


Therefore, the revised EDC + IDC should be = 330 X 176.28/249.899 = Rs 232.78 psf
(Assumptions
1] Edc+IDC Rs 330psf being demanded is calculated correctly and ethically and may depend on the year of license.
2] IDC being included is calculated correctly and ethically and remains constant and therefore does not impact the calculations..
3] Since Like figures are included, compounding of delayed payment interest and incremental annual increase in EDC, does not impact the calculation

Therefore, I can say with 99% confidence level that actual edc is about Rs 97 psf lower than what is being demanded, on the basis of above example and assumptions.

Thus, for a 1900 sq ft flat, this translates into Rs 1.84 Lacs per Unit being charged in excess in the name of government levies and taxes and needs to be re-invoiced or compensated for as advance payment with interest (if already paid by buyer).

Let the highly paid and faithful employees of builders keep tanting what they want. Immediately ask reply about EDC demanded and rates for your builder through RTI and file a complaint with DTP Enforcement Gurgaon, DGTCP Chandigarh through registered post for immediate intervention on receipt of figures..

If no response is received, it clearly is a case of cheating above 2 Crs collectively and admittable as culpable offence of cheating, with the EOW Gurgaon/Delhi.

NO NEED TO PAY EDC/IDC AND BUILDERS CANT ASK FOR THE SAME DUE TO HIGH COURT STAY
BELOW IS THE ORDER COPY NOW FROM DTCP TOO

ORDER
The Hon’ble High Court in CWP No. 5835 of 2013 (Balwan Singh Vs. State of Haryana) has stayed operation of HUDA memo No. HUDA-CCF-Acctt-I-2011/24224 dated 14.07.2011. In view of the above orders dated 19.03.2013 on Hon’ble High Court, the Department is not insisting for payment of enhanced EDC from the licencees for the time being. All licencees are hereby directed to take note of above orders and ensure that no violation of the same takes place. In case of any violation of the said orders the entire onus of the same shall lie on such coloniser. However the licencee shall remain bound to deposit any amount collected against enhanced EDC either directly or indirectly from its allottees and deposit the same with the Department without any delay.

What is you advise not to pay them.

High court order is applicable for Faridabad as TCP increased EDC . It is not applicable to Gurgaon as EDC was actually reduced.

Issue in court is Enhanced EDC & Not reduction in EDC .

Hi BlessU,

Need a small guidance, I have a unit in era sector 86 and he is cherging EDC/IDC very high amount. I am trying to file an RTI online the very first time and to my surprise there is nothing like town county planning ministry or department.
Could you please guide me here, whether its not possible to do it online or is there any way.

Senior members - I have paid the enhanced EDC/IDC charges raised by Bestech for their Dharuhera City project. Please suggest whether i should seek refund (if possible) if they have not deposited the same to Govt till this issue is resolved?
