License was obtained by landmark around 1.5 years back for full 10.15 acres of land after giving advance to landowners. After that dispute started between landmark and the 17 landowners. In December last year the dispute was settled with 11 landowners who gave possession of 8.58 acres of land to landmark. Dispute for the remaining part is still not settled. Landmark is constructing on the basis of old license. Till dispute is not settled for the remaining 1.57 acres this construction will be deemed to be illegal.

1.Landmark is not able to get the project approved for home loan because the title is still not clear.

2. Builder Buyer agreement is also not possible because of this.

3. Landmark can't advertise this project in the newspaper till the case is in the court.

4. Landmark has already drawn about 180 crores from this project (sold 1 million sq. ft. area @average price of Rs. 4000/= and demanded 45% payment). While it has spent only about 30 crores on this project (27 crores paid to 11 landowners).

Landmark is a very unprofessional company. 1.57 acres of land may be about 5 to 6 crores only. But due to their ego they wan't the farmer to surrender the land at old rates and are ready to wait another few years. Because of this dispute landmark's reputation is down :-

1. Other projects in the area with inferior location and specifications are selling at much higher prices because of their reputation.

2.Due to the dispute in this project landmark's other projects are taking a hit. Landmark has failed to sell sector 81 project even below market rates even with offering 12% brokerage to dealers. Dealers are not willing to book because they don't wan't to spoil their own reputation. They have already burn't hands in this project.

IT IS HIGH TIME LANDMARK SHOULD WAKE UP AND TAKE APPROPRIATE STEPS.

STRENGTH IS IN NUMBERS

150 Crores in pocket of Landmark !!! without required approvals ..very strange

Combined efforts are needed by buyers only .......Somewhere in IREF I read a lot of compliant about Landmark's Dharuhera Project ( Golden Height & Villas)

Smile Court tells builder to return money to buyers

Hi All,

This is the similar case of Landmark except that construction in our case has started.

Court tells builder to return money to buyers
Expressing concern over rising cases of developers duping the public, the Delhi High Court has asked a builder to immediately return a total of R3.5 crore, he allegedly received from 50 investors, as principal amount.
An FIR had been lodged against one Rajesh Yadav after investors complained that they had been cheated as the construction for a project in Faridabad had not even commenced even six-and-a-half years after the initial payment.
Justice Kailash Gambhir asked Yadav, a director of Pal Builders and Infrastructure, to refund the principal amount to all the 50 investors by May 21, making it clear that his plea for quashing the FIR would only be considered after that.
Yadav’s lawyer Sudhir Nandrajog told the court that the matter has been settled with one complainant and his client is prepared to settle the dispute with the remaining 49 investors also “to their fullest satisfaction”.Public prosecutor Navin Sharma opposed the quashing of FIR till all the complainants got back their money and said “It would send wrong signals at a time when the menace of builders duping the public who are losing their hard-earned money has reached alarming proportions”.
“This clearly amounts to contempt of court. On April 10, the judge had given a month’s time to the builder to pay up. Till now we have not got back a penny. Forget the interest we are even ready to accept the principal amount we had paid,” says MD Aggarwal, an investor who lost money.
The court had asked the investigating officer of the case to ensure the settlement of the dispute within a month by calling five investors at a time and to make sure they got the amount back. Aggarwal said 40 of those who were duped have formed an association to present their case in a better way. During the last date of hearing on May 14, the court agreed to the plea of builders for one more week’s time to pay up

In most of the cases the investors don't agree for refund as they can't buy any other apartment at the same prices. If the investors insist the court always gives relief to them by ordering the builder not to make further demands of installments till the anomalies of the project are cleared. This puts builder under pressure.

Lalit ji,

It is about 25 days since the letter was sent to Landmark.Landmark has not shown any interest till date. Now what is the next step?

Dear Kehsav,

Officially communication is going on, with landmark guys as well as other channels.

You would recieve an update as soon as association have reached to some decision or fruitful happening in the whole course.

Few members still want to have dialogue with landmark . They are not able to judge the cunningness of Chillar party. 15-20 members went to landmark office on saturday. Devender pandey once again committed to sign the BBA within a months time and assured the member that he will communicate this on the Association Email by Monday i.e. 27/05/2013 But once again he has backtracked from his words and has not replied on the mail so far. Without court pressure these fraud builder will not listen to any one. after all he is befooling us from last 2.5 years by cooking different stories.

The only way members can get relief from the miseries caused to them by this cheat builder is through the court of law

Fight with unity against the Injustice of this builder

Good news , After the sincere efforts of the Association finally Devender Pandey has sent a confirmatory mail today in reply to the Association mail confirming that they are starting doing BBA on or before 25th June 2013. Now we are writing him to sent a draft of the agreement so that we can show it to our legal experts . The agreement should be equally biased containing conditions in favour of both the parties.
