Icon26 Ground Rent for Mhada Flats???!!

Hello, I own a flat in Mhada, Oshiwara and have been informed that there is some ground rent payable to Mhada. Now the interesting part is that I was never told about this ever, it is not mentioned in any property documentation, and neither has any notification ever been sent to my apartment for payment. Also I have a document titled Mhada Cerificate which states that (besides other points):

"The land underneath and appurtenant to the building will be leased to the Society to be formed by the allottees of the buildings, for a period of 99 years on payment of lease rent at the rate of 2-1/2% per annum of the premium of land which is included in the sale price of the tenement".

Now if one reads the above, all that can be ascertained is that the rent has already been paid as part of the sale price. Hence why is this rent payable, which is around 10K for 13 yrs + interest for non-payment to the tune of around 11K....around 21K in all (rent + interest) for 13 yrs? Please let me know of your views. Also will Mhada not provide an NOC to sell the flat unless this payment is cleared?

I don’t know if you got that Flat directly from MHADA or you bought resale. When Mhada transferred the flat on your name then you got a letter written in Marathi and English that mention paying Lease Rent of Rupees 75 or 95 each month. MHADA has office near Shree Ji resturent and Punjab and Maharashtra Bank in Oshiwara on First floor and one can pay the Lease rent in that small office. You can ask any Broker the office of Mhada in Oshiwara.
One of My friends bought the Resale flat on Oshiwara Link Road 4-5 years back. My friend asked owner of the flat for “no Due Certificate from Housing Society" and MHADA Lease Rent paid Receipt and" No objection Letter" from Society. Flat Owner was not aware about MHADA Lease Rent and had not paid it for 10-12 years and then he paid it with Penalty and got the receipt. One needs that Receipt to be attached with Registration documents if you are buying or selling. First one goes for Registration of the Flat in Sub Registrar office and later with Flat registration documents one applies to MHADA for Transfer the flat on your Name and you pay official fees about 30 or 35 Thousand to MHADA through DD and if you want transfer letter in 30-40 days then you have to give bribe of 15 to 20 thausend to MHADA official through Transfer Agents/ Transfer Brokers. All the Brokers in Oshiwara know this. Most of the Flat owners of MHADA Flats who baught the flats in resale dont have MHADA Transfer done and are not aware about the Lease Rent.
You can pay the Lease RENT to MHADA with penalty. Please note that MHADA receipt has Correct FLAT number and Code number according to Registration or Mhada letter. If you want to sell the Flat you do not need NOC from MHADA. You will need NOC from Housing Society. if you need any info let me know.

Yes I am selling the flat, and somehow I don't have the letter which mentions the lease rent, in spite of us being the first owners of the flat (outright purchase from Mhada). We checked with another family from the building who are also first owners and members of the society and somehow they also mentioned they are not aware about this. Hence I was a bit skeptical. Anyways since this is required and we are being pursued by the purchaser of the flat for this rent-paid receipt, I shall go and pay this lease rent.

1 If Your flat is outright purchage from Mhada then check the allotment letter if anything is mentioned on allotment letter regarding Lease rent. I think Mhada sold flats for 25 Lakh and then these flats of Mhada had no buyers and then Mhada reduced the price to 22 Lakhs and few baught for 22 lakh and those who baught for 25 had filed a case in High Court against Mhada and later that case was setlled.
2. You checked with other family(who are first owners) in same building regarding Lease rent and they dont have any info. I have knowedge and I have seen the papers for Lease rent to be paid when somebody baught the Mhada Flat and it was Transfred by Mhada and this letter came when Mhada sent Transfer Letter. First owner also had paid the Lease Rent when he sold the Flat.
3 Now it is the buyer who is asking the Lease rent paid reciept because he needs it to be cleared from your side.
4 You are selling the flat and you may be having your broker and broker should know about this.
5 There are 3-4 good Brokers who deal in Mhada Flats on Link Road Oshiwara . when the Mhada Flats were not selling( 1998-1999) these Brokers were paid by Mhada and they helped Mhada and got Brokerage from Mhada.
one of them is Mr Waguley 982-104-3505 (Ashirwad properties) in building 15. one is Master Zhendey his office is opposite to Bank of Punjab and Maharashtra in building 43 or 44 (he deals directly with Mhada and Mhada official are known to him) other person is Mr Brijesh Tiwari982-005-8691,982-003-6999 (Earth Properties) in building 41 on Link road. If still Confused or need latest update they can let you know about the Mhada Lease rent update. I am out of India and dont have latest update.
6 How much Sq feet is your flat? most of 2BHK on Link road are 835, 925,935?
7 How much are you getting? If not possible to post please PM me or send me your Email.It is just for information about the going rate as I am out of India and I am also thinking about seliing the flat but at this time confused to sell or not to sell.

Hello, I checked the allotment and also the possession letter cum receipt however there is no mention of the lease rent anywhere. We had bought this flat for 25L in 2001 from Mhada. We are not dealing with a broker, but directly with the purchaser and he seems to have some good connections at Mhada, hence he is able to get all the information required to complete the purchase process. I shall PM you to let you know of the sq ft area and agreed price.

I had another couple of questions:

a. For the lease rent payment, can any other family member go and pay the amount of my behalf? I hope the actual owner is not required to be compulsorily present during the payment of the outstanding rent + penalty. Is any authority letter or something required in such case?

b. What modes of payment are accepted by Mhada for the lease rent payment? Would a cheque do or whether they insist of any other FOP like DD?

I believe the office mentioned by you (above Shreejee) is open only on Tues and Wed every week for a certain time for payments.

after having your aforementioned post, you could request the purchaser itself to pay on your behalf whatever the amount is.

He will do it as per his satisfaction and you will save hassle

-----Anybody can pay the lease rent. I paid by Cash in year 2009 it was only for 2 years and in 2010 I went to pay the lease rent and the person asked for a check. Better to pay by Check. send the person with Copy of Allotment letter so that they write the correct name on reciept, correct Flat number, correct Code on reciept and in the register they maintain in the office. Name,flat number, code number, building number on the payment reciept and allotment letter should be same. Ask the MHADA Person Why you are charging Lease Rent when it is not mentioned on Allotment letter?

I hope the actual owner is not required to be compulsorily present during the payment of the outstanding rent + penalty.

----No, last time I sent my servent to pay and i sent the copy of Last payment reciept so that they dont charge for the years i have paid.

-------They asked Check or they can also take DD and i have also paid Cash but DD or check is better as you will have record and keep the Copy of check or DD. Just go to that Mhada person and he will give you info.It is very small office with 2 persons only.
I believe the office mentioned by you (above Shreejee) is open only on Tues and Wed every week for a certain time for payments.
-----That is correct, for two or three days in a week.
