Noida farmers on warpath, 300,000 may lose homes - Hindustan Times

An estimated 300,000 homebuyers and home owners could be affected if farmers in 24 villages along the Noida-Greater Noida Expressway succeed in their agitation for the return of their land taken over by the Noida Authority in 2003. On Friday, 400 farmers held a panchayat at Shahpur

The spokesperson of the Kisan Sansh Samiti, an association of farmers that organised the meeting, Mahesh Asana said: "We will move court against the Noida Authority on Monday. When the Authority acquired our land, it promised that developed plots would be allotted to us as rehabilitation benefits." This has not yet been done.

The farmers will hold another panchayat on Saturday to "fine tune" plans to stall the construction of residential towers - being built by, among others, Japyee Group, Unitech, 3C and Purvanchal Group - along the expressway.

On July 6, the Supreme Court had upheld an Allahabad High Court order that had set aside the acquisition of 156 acres of land in Shahberi village in Noida Extension, a few kilometers away. The result: the authorities have to now recover the land they had allotted to real estate developers, demolish the half-built structure and return the land to the original owners. Many of these farmers now plan to sell their land at market prices, which is several times the compensation they were - or are now being - offered - by the government.

These lands were acquired by invoking the urgency clause of the Land Acquisition Act of 1894, which allows the government to dilute due process in case of an emergency.

But Noida Authority chairman and chief executive officer Balvinder Kumat told HT: "If this clause is challenged, then not a single sector in Noida and Greater Noida would be spared. All the sectors would be under a cloud… all projects threatened."

About 6,000 home buyers, who had already booked flats in projects coming up in Shahberi and now face an uncertain future, find themselves caught in this crossfire between farmers on one side and the builders and the authorities on the order.

This, and a similar order by the Allahabad High Court on July 19 with respect to land acquired from farmers in Patwari village, near Shahberi, has encouraged other farmers in the area to agitate for the return of the land, which, they allege, was taken over in violation of the due process of law.

Earlier on Friday, the samiti had stopped construction work at the Jaypee project site in Noida's Sector 128 (in Sultanpur village) off the expressway, protesting against the delay in allotment of developed land plots. Noida Authority officials said the work was stalled as the builder had allegedly blocked a key access road to Sultanpur.

"A reversal of perceived shortcomings in the acquisition process of the last 20 years is impractical. The entire Noida and Greater Noida Expressway development cannot be undone and land cannot be given back to farmers for cultivation," said Pankaj Bajaj, president of Credai NCR, the apex body of realtors in the capital and MD of Eldeco Infrastructure & Properties, a real estate company that has projects along the expressway.

All this was happening and then Rahul Baba, Prime Minister in waiting after loosing bihar entered UP. Now with Rahul baba prestige at stake, the so called Hon'bles were activated to show some favour. Result is for every one to see. Vote bank of Farmers has been activated in UP, who cares about middle class who aspires to own house?

To show BSP GOV down, Congress started its dirty game. I am saying this becoz, the court judgement has no merits except procedure towards acquistion was not legal. So will then the court term it all illegal. When such lands were acquired, why so called farmers not took stay from court? Why all of a sudden when RAHUL baba PMINWAITING enters UP this all starts?

Court should have asked:
- farmers why were they sleeping all these days?
- Asked GNOIDA authority to refund the money back to builders and compensate all the buyers as they bought from builders who in turm bought it from Gov authority.
- Give back land to farmers, ask them to give the money back less the development cost authority has incurred to develop the area.(Let them plough land which i doubt vd so much of booze and idle A..h on 4w)

No body cared for that backward land few years back, only after the authority walked in, acquired big chunks, laid out foundation for a planned city, the land value went up as the land was backed by assurity of authority that titles are clear.

Now Congress I is hell bent on providing its PM in waiting UP in platter.

NEFBWA has decided to hold a peaceful rally on Saturday, the 23rd July, 2011 starting from Gautam Buddha Statue, Noida Entry Gate. We shall give a memorandum to Chairman, GNIDA at Camp Office Sector 14-A demanding an immediate solution of the Noida Extension issue. The rally will terminate at Sector 18, Noida.

This is an opportunity available to us bring to the notice of the Authority our genuine grievances in the wake of the recent judgements of the Hon'ble Allahabad High Court on the issue of land acquisition in Noida Extension and to press for an early solution of the same. Therefore, all flat buyers are requested to please gather in full strength at Gautam Buddha Statue at 4:00 p.m. sharp on 23rd July, 2011.

Yes the money is indeed hard earned. And the State Governments and Builders and want this hard earned money of ours for themselves!!!

i feel that court order is partisan as it didnot tAKE into account the other stake holders i.e.flat buyers and builders. So it is not only the Authorities but the Court which is responsible for the confusion and turmoil in the real estate market in GN/Noida.

I m not surprise with Allahabad HC judgement. For 3 years, the court did nt gave even stay order (in Bishrakh case). The judges were sleeping or deliberately silent that let the builder start the construction so that HC Judges would inflict maximum losses to flat buyers.
WHY THE COURT WERE SILENT FOR 3 YEARS. ALL Judges in ALLahabad HC are sold for money. Even Supreme court has passed a remark on whole judges of Allahabad HC that they all are suffering from "Bhai-Bhatiawad".
You have money you can influence Judges.
Even a common man say "if some one has sold his property then how can he reclaim his property after 3 years". Max to max 1 years is a more than sufficient to file a cae in court. A Court cant decide whether a law is wrong or right. The court duty is to see whether a work is according to law or not. But the court is making remarks over law (read clause17) which is not in capacity of court. A law can be wrong. But court has no athority to rule over law. This is malafide intention of land seller. But HC Judges dont care about law, they care about their own interest first. Thats why, all useless guy goes for LLB & they become judge.

One of my politician friend once told me, in politics, everything is about TIMINGS.
Before the vote, every party distributes money to voters ... but only the party owns which give money at the right time... and we fool think that I voted so and so and due to that he/she won!!!

Question

No sector that is undergoing development at present can be termed a safe and sureshot future project it seems even in noida right now , leave aside greater noida.
