Default huda rohtak sector 6 scheme

Huda closed its sector 6 rohtak in january 2011. About 2-3 months back i read in some newspaper that supreme court has put a stay on the scheme. Is it true? If it is so what will be the fate of applicants of the scheme

SC orders stay on HUDA scheme
R Sedhuraman
Legal Correspondent

New Delhi, March 21
The Supreme Court has stayed HUDA’s scheme for freehold residential plots in Sector 6, Rohtak. The booking for the scheme had opened on November 4, 2010 and closed on January 4, 2011.
A Bench comprising Justices GS Singhvi and AK Ganguly issued notices to HUDA and the Deputy Commissioner and tehsildar of Rohtak on a contempt petition filed by Haryana Roadways Cooperative House Building Society Limited, Rohtak, through its counsel Rishi Malhotra.
The society contended that HUDA had advertised the scheme in newspapers in utter disregard of the status quo order passed by the Supreme Court on May 24, 2010.
According to the society, HUDA had in April 1998 purchased land measuring 16 kanals in Pada village in Rohtak district and used it for allotting plots to its 168 members. The mutation was done on June 5, 1999.
However, the Rohtak administration acquired this land on December 30, 2002 for developing a commercial area in Sector 6, ignoring the objections filed by the society and its members. Subsequently, the state administration returned 600 of the 800 acres of the acquired land belonging to influential persons, but rejected the pleas of the society and its members.
In its May 24, 2010 order passed on an earlier petition filed by the society, the SC had directed status quo, clarifying that “this would necessarily mean that the petitioners and the respondents shall not alienate the land/property to any other person.”
HUDA contended that the scheme did not cover the land acquired by the society. Nevertheless, the society maintained that the status quo order was meant for the entire chunk of land acquired by HUDA in Rohtak. The society stated in the contempt petition that HUDA had “deliberately and with mala fide intent misconstrued and misinterpreted the orders” of the apex court to “over-reach the categorical directions of status quo.”
