What To Do To Get Fair Compensation From Unitech For Delaying Possession of Unitech Escape, Gurgaon?
By Iamdkjain, Section Ask Questions Posted on Mon Feb 07, 2011 at 07:27:13 PM EST Hi, I booked one 3 BHK apartment at Escape Unitech in Tower No 6,super Area 2050 sq.ft. The possession has been delayed by more than a year by Unitech, and there is still no concrete date for them to complete and handover. The payment terms were Time-linked irrespective of progress on site. I am very much aggrieved as I am suffering on account of loss of interest on deposits I have made and the builder is going to compensate me by rental value of only Rs 5 per sq ft per month which is grossly unjustified. The national consumer forum in many other cases has held that in case of such delays, the builders should compensate the buyer by way of interest.We have a strong case and in case some of you also feels cheated the same way, please contact me and we can jointly seek redressal to the issue with the builder or court. Delay in handing over of Unitech Arcadia Project (none / 0) (#10)

The builder has collected 98% Payment two years back and have taken the poor investors to a ride. The office block is not yet handed over. It is surprising that now they have launched Arcadia II project in the same premises. I fail to understand that the builder like UNITECH has no moral responsibility / commitment to hand over the property on time. It's a clear case of cheating the investors. Through this message I want to cautious the investors not to put their harden money in to their projects. In Unitech commercial Project the carpet area is 50% of super area. This is again a fraud done by the Company. |

The clubhouse was finally developed more than 4 years after the promised date. However, contrary to all promises Unitech refuses to allow the residents any say in the management of the club. Unitech has turned the society's clubhouse into an open club which it uses to makes money by renting the club premises to outsiders for private parties. Despite many representations from the Nirvana Country Residents Wellfare Association, Unitech refuses to change its stand. The fees of the clubhouse has been arbitrarily doubled by Unitech and the tenants have also been denied the access to the club despite they being provided NOC by the respective Nirvana Country house owners. Nirvana Country Resident's Wellfare Association is now contemplating legal action against Unitech for this breach of trust. In the meanwhile, everyone involved has been greatly inconvenienced by this unethical behavior of Unitech. |

Residents of Nirvana Country, a high-end township, in Gurgaon, have started a campaign against their developer, Unitech Limited. Even after complaints being filed by the Residents Welfare Association (RWA) against the developer for the past six months, the developer is allegedly insensitive towards providing basic amenities like proper water supply in the township.
A Unitech official, however, claimed that the residents raised several issues, after a circular regarding revised maintenance rates, was sent to them. The rates have been increased to R2.5 from R1 per sq yard. Nirvana Country residents have alleged that there is inadequate water supply in overhead tanks. "The HUDA water supply line has touched Nirvana gates, but the developers' connecting line is four and a half feet above the line," Sanu Kapila, secretary general, Nirvana RWA, said. Sewage connectivity to the main sewer line is non-existent.The sewage is pumped out of the township and dumped on the road. "The township does not have a complete boundary wall, which is posing threat to security as many thefts have already taken place," Varun Ahuja, president, Nirvana RWA, said. Besides, the residents have been allegedly forced by the developer to pay R75,000 extra for club membership. Other issues include lack of a community centre, generator, guards and incomplete bus shelters. A Unitech official said, "As far as water supply is concerned, we have recently obtained the connection from HUDA and the line is very deep, which if released could mix with sewage water. The work is in progress. We'll have a meeting with HUDA to sort out this issue in the next 2-3 days. " Source: Hindustan Times |

Tired of the colonizers lack of action, the RWA of South City II has moved a petition in the Gurgaon Lok Adalat demanding the installation of the sewerage treatment plants (STPs) in the colony.
The Lok Adalat hears all the cases relating to public utility services in the city. Much like other courts, the Lok Adalat is empowered to hear cases and issue orders to settle dispute brought to its notice. RWA president SC Sharma, said: The court has issued notice to all respondents like the HUDA and the colonizer to respond to the issues of STPs in the colony. The colony has over 2,500 houses which include both plots and flats. The absence of STPs has turned the area in to a total mess with sewerage strewn all around and foul smell emanating from the stagnant sewerage water. In their petition, the residents said that the sewerage pipes of the colony must be linked to HUDAs main sewerage pipe and that STPs should be installed in the colony on a priority basis. At present, the sewerage is collected by the builder through tankers, but that itself has become a major cause of headache for the residents. The entire process of sewerage collection takes place during the night and the stench makes it impossible for residents to sleep, said Sharma. The RWA is now gathering all documents pertaining to previous communication with the civic authorities and the colonizer for submitting them in the Lok Adalat. 'Buniyadi Suvidhavon Ko Taras Rahi Hai Nirvana Country'....
गुड़गांव-सोहना रोड (सेक्टर 50) पर स्थित है नरवाना कंट्री। नाम और देखने में यह जगह किसी पॉश एरिया से कम नहीं। राजीव चौक से लगभग 5 किलोमीटर की दूरी पर बसी इस कॉलोनी में विला, प्लॉट और ग्रुप हाउसिंग सोसायटी बनी हैं, यहां तकरीबन 1 हजार से अधिक परिवार रहते हैं। लेकिन अगर यहां बुनियादी सेवाओं की बात करें तो नहीं के बराबर हैं। मेसर्स यूनिटेक लिमिटेड ने नरवाना कंट्री 6 साल पहले बसाई थी। लगभग 290 एकड़ में बसी इस कॉलोनी में 800 विला हैं। 250 से अधिक प्लॉट और ग्रुप हाउसिंग सोसायटियां भी हैं। आज यह कॉलोनी सीवरेज ओवरफ्लो, पीने का पानी, पार्किंग, खस्ताहाल सड़कें, चौपट सफाई व्यवस्था, खस्ताहाल पार्क आदि समस्याओं से जूझ रही है। सिक्युरिटी भी नहीं के बराबर है। कॉलोनी निवासी इन सुविधाओं को मुहैया कराने का आग्रह कई बार कॉलोनाइजर से कर चुके हैं, लेकिन उनकी तरफ ध्यान नहीं दिया गया है। स्थानीय रेजिडेंट वेलफेयर असोसिएशन के पदाधिकारियों का कहना है कि उनकी कॉलोनी को हरियाणा अर्बन डिवेलपमेंट अथॉरिटी (हूडा) की वॉटर सप्लाई की लाइन से तो 8 माह पहले ही जोड़ दिया गया है, लेकिन कॉलोनी में बिछी वॉटर सप्लाई की पाइपलाइन बहुत बड़ी है, इसके चलते पर्याप्त मात्रा में पानी नहीं पहुंच पा रहा है। सड़कों की तरफ ध्यान नहीं कॉलोनी को डिवेलप हुए 5 साल से अधिक समय बीत गया है। डिवेलप होते समय सड़कों का निर्माण किया गया था। इसके बाद कॉलोनाइजर ने सड़कों की तरफ ध्यान नहीं दिया। आज कॉलोनी की सड़कें बद से बदतर हालत में पहुंच चुकी है। कई बार असोसिएशन के माध्यम से कॉलोनाइजर से सड़कों की मेंटिनेंस करने का आग्रह किया गया है, लेकिन समस्या जस की तस है। - अभिमन्यु भास्कर, रेजिडेंट पीने का पानी भी मुहैया नहीं गर्मियों में कॉलोनी में पीने के पानी का संकट गहरा जाता है। कॉलोनी में ट्यूबवेल के माध्यम से पीने के पानी की सप्लाई की जाती है। गर्मियांे के मौसम में पर्याप्त मात्रा में पानी की सप्लाई नहीं की जाती है , जिससे उन्हें प्राइवेट टैंकरांे पर निर्भर रहना पड़ता है। हालांकि हूडा की वॉटर सप्लाई की लाइन से कॉलोनी को जोड़ दिया गया है , लेकिन पानी नहीं पहुंच सका है। - बी . पी . पाराशर , रेजिडेंट सीवर ओवरफ्लो करता है कॉलोनी में सीवरेज ओवरफ्लो की समस्या अक्सर रहती है। सड़कांे पर सीवर का पानी फैला रहता है , जिसमें मच्छर मक्खियां पनपते हैं। वहीं वातावरण भी प्रदूषित होता है। कॉलोनी में सीवरेज ट्रीटमेंट प्लांट का निर्माण कॉलोनाइजर की ओर से नहीं किया गया है। उन्होंने कहा कि पार्कों की हालत भी खस्ता है। प्लांट से सीवरेज पानी को फिल्टर कर हरियाली में प्रयोग लाया जा सकता है। - एच . के . गांधी , रेजिडेंट शादी - पार्टी के लिए नहीं जगह कॉलोनी में कम्यूनिटी सेंटर न होने के कारण छोटे समारोह के लिए भी क्लब को बुक करना पड़ता है। इसकी एवज में कॉलोनाइजर की तरफ से भारी चार्ज वसूला जाता है। कॉलोनाइजर ने क्लब का निर्माण स्थानीय निवासियों के लिए किया है , लेकिन इसमें बाहरी लोगों को मेंबरशिप दी हुई है। बाहरी लोग इसे पार्टियों के लिए बुक भी करते हैं। - कुलदीप सिंह , रेजिडेंट साफ - सफाई और सुरक्षा कुछ नहीं कॉलोनी में साफ - सफाई व्यवस्था भी चौपट है। सिक्युरिटी गार्ड न के बराबर हैं। असोसिएशन के माध्यम से इन सुविधाओं को मुहैया कराने का आग्रह कॉलोनाइजर से किया गया है , लेकिन सुनवाई नहीं हो रही है। कॉलोनाइजर इन सुविधाओं को देने की एवज में मेंटिनेंस चार्ज वसूल रहा है , लेकिन सुविधाएं नहीं दी जा रही हैं। - ननीता सिंह , रेजिडेंट धूप में करते हैं बसों का इंतजार कॉलोनी में बस शेल्टर नहीं बनाए गए हैं। स्कूल बस के इंतजार में बच्चों को बरसात , सर्दियों और गर्मियों में खुले में ही खड़ा रहना पड़ता है। बस शेल्टर का निर्माण अतिशीघ्र करवाया जाना चाहिए , इसके बिना सभी को काफी परेशानी हो रही है। - संदीप , रेजिडेंट नहीं हैं वॉटर ड्रेनेज सिस्टम कॉलोनी में स्ट्रॉर्म वॉटर ड्रेनेज सिस्टम नहीं है। बरसात के दिनों में भारी परेशानियों का सामना करना पड़ता है। कॉलोनाइजर को यह सुविधा कॉलोनी डिवेलप करने के दौरान ही दी जानी चाहिए थी , लेकिन नहीं दी गई है। रेजिडेंट वेलफेयर असोसिएशन का कोई कार्यालय नहीं है , जिसकी वजह से शिकायत करने में भी दिक्कतों का सामना करना पड़ता है। - शिल्पा , रेजिडेट Source: Navbharat Times |

Unitech is taking its customers for a toss. 1. Delay in giving possession of apartments by more than 1 year from the original promised date. Even after paying 95% of the cost of apartment, owners are at the mercy of Unitech. 2. Possession letter comes with a shock of enormous increase in super area to already distressed customers. All of the sudden without any prior intimation Unitech has increased super area by as high as 68 sq. ft. at the time of possession. Not even a single sq. ft. of the increased area encompasses carpet area. 3. Time given for the possession is decreased from 30 days (as per contract) to 21 days. I believe in such a time of crisis glooming all over world, Unitech is in a desperate need of money. 4. Exorbitant increase in the maintenance charges from Rs. 1.25/= per sq. ft. to Rs. 2.50/= per sq. ft. Basic amenities for which the maintenance charges are given are not yet ready. 5. Unitech is seeking advance maintenance charges for a period of two years, even though the contract says for 1 year. 6. Society is in inhabitable state as no electricity is available from NPCL. Using power backup will cost as high as 200% to 300% of NPCL rates. 7. No Service Level Agreement is provided for maintenance of the society. I have to shell out more for 48-68 sqaure feets even though actual carpet area remain the same. 2. Reasons given to us that cost of labour and diesel has increased and projected maintenance cost is no more feasible but could this warrants to 100% increase. The residents of posh township are up in arms against their developer, for showing lack of interest in repair of basic amenities, such as roads and sewer lines. The residents of South City 1 will stage a demonstration on April 30 against their developer Unitech. South City 1 is lacking in its basics
. “The sewer line overflows invariably, which is then boosted into the main sewer line by the workers. It is a big nuisance as every second day the sewer overflows onto the road,” Rakesh Sharma, secretary EWS Association, South City 1 said. The EWS association is supporting the South City 1 Residents Welfare Association in its fight for their rights on April 30. The residents have been travelling on non-motorable roads for the past decade. The roads have not been levelled after the pipeline work was done. The sewage pipeline was laid for which the roads were dug. After the completion of the work the roads were not levelled properly causing difficulty to the commuters. The other major issue for the residents is the increase in maintenance charges from R1 to R 2.50. The residents refuse to pay extra for those amenities which are not provided to them. Dispelling myths of quality and comfort living in a condominium, residents of Heritage City are complaining that they have been deprived of facilities such as swimming pool and gymnasium as promised by developer. More than 3,000 residents in this society, developed by the Unitech, have been living without these facilities for the last 13 years. “The builders sent out advertisements in leading newspapers promising facilities like swimming pool, gymnasium, nursery school shopping centre and even a post office inside the complex,” says Atul Batra, president of the Resident Welfare Association of Heritage City.
These facilities are locked up because of lack of maintenance by the builder. “We have to take permission of the guard to let us get the area cleaned as it is becoming the breeding ground for diseases,” he said.
