Cancellation of allotment of Apartment at “Vatika India Next”

Subject : With Reference to thier Letter Dated 10th June 2010 regarding Cancellation of allotment of Apartment at “Vatika India Next” for our priority No. 1BR/086 in Lifestyle Homes
We as a young couple dreamt of living in above mentioned 1BHK unit in your esteemed project, as we are working executives in Gurgaon. But on receiving the cancellation letter our dreams got shattered and a feeling of shock and disbelief entered in our minds that how such a reputed company like yours has befooled us by showing Exit doors/Red cards . Your company has been using our money since last 18 long months.
One of our query is that why the company accepted new bookings on revised rates w.e.f. 8/3/2010 by leaving the initial customers of Ist phase in lurch. Do old customers who have been waiting for last 18 months in the hope of getting allotment with their booking amounts blocked with the company are at any fault.?????
We are hereby not ready to accept your offer of cancellation and neither the offer to accept 3BHK unit option as this is beyond our Budget. We request you to kindly allot in 1BHK unit (irrespective of size) in lieu of Cancellation only. An early action to my communication will be highly appreciated, otherwise we will have to take the legal course of action against the company.

I am shocked to see how developer like Vatika works in a totally unprofessional way.
I paid second installment of 10% in Feb 2010 and accordingly I was allotted plot no 2 on street 2 in 82 F.
My last e-mail was exchanged with Vatika was on 29th March 2010 in which it was mentioned that " This is to inform you that there is no amount due till date for your booking. The next installment shall be demanded with the start of earthwork."
Because many months are gone and there is no demand from Vatika side so I decided to visit the site to see the progress and to know the details of schedule from Vatika. To my surprise new story started from Vatika side which was in a totally unprofessional way. Vatika staff don't know how to deal with a customer because for them is more important than a customer (who was there from abroad), because after every 2 to 3 minutes he was leaving the office to attend his call. I requested to meet with Senior Management ( Mr. Kapil or Mr. Bhalla) but my request was just ignored.
I wasted my 3-4 hours in Vatika office and result is zero because new numbers which are shown to me is not fulfilling my requirements so I need a solution from Vatika side because this blunder of allocating of one plot to two customers is from Vatika side which I am not trusting because in master list there is only one entry which is my hand written entry.
Now it's the responsibility of Vatika to resolve this issue.

Thanks alot Manoj ji for such important info .
I have also booked one floor in Vatika India Next in Nov 2009 phase2 .
But still they have not alloted me the floor .
Guys please suggest what can be done to deal with these types of issues .
I am shocked to see such posts by the people which are cheated by Vatika .

There r many more complaints against this Group, search the web for them .
Best way, would be to form of a group of people who have suffered & take on collectively, against the might of the builder . Doing it, individually, can put a lot of financial burden, besides a whole lot of other issues .

Vatika Group – Delay in possession of plot and change of project plan
Sir, In 2006, I have booked a plot in Vatika Infotech City Jaipur and till last year made a 75% payment for a 360 square yard plot. I made a payment of Rs.18,50,000 till date. Now Vatika group has changed the plan and offered a different plot, which they have said, will be delivered to me in 2011. I refused to take the new plot and asked for refund of my paid amount along with interest. They have refused this and asked me to accept the new plot which they are offering. I have contacted their executive Mr.Kush and Sumit Arora in the CRM team.But, I am not getting solution regarding refund. I have few questions: 1. How could they sell a plot when they knew that it is not approved 2. They took Rs.18.5 Lacs from me till 2009.Why did they not inform that project has been scrapped. Sir,please help me in getting my refund or delivery of the plot at the earliest. I know they are several such customers who have been fooled by Vatika Group. My plot no is: IP/NAV/8th street/25 in Vatika Infotech City Jaipur.
Vatika is Cheat
Vatika is famous for changing plans and structure of the buildings. They even changed location of certain projects in India Next Project.As per Vatika all sectors in a City are equal and they can give you apartment in any location of that city.Do no book any apartments from Vatika, because you will regret your decision. They do not answer your emails/ calls.

High Cost, no construction progress but continuous payment demand
Vatika Group lauched "Vatika India Next project (Gurgaon 21) - sector-82 Gurgaon" in March 2008 with starting BSP of 2470/- per sq ft with additional PLC of 200-250-300 per sq ft (depending upon number of PLCs). In addition to this, car parking charges/IBMS/EDC/club membership are additional to this.
Note that, current BSP from Vatika is 2720/- per sq ft.
SUMMARY OF ISSUES
1. NO CONSTRUCTION WORK PROGRESS AT SITE. NO OFFICIAL COMMUNICATION FROM VATIKA TO MEMBERS REGARDING THE CONSTRUCTION WORK COMMENCEMENT DATE AND COMPLETION DATE
2. DELAY IN PROJECT SINCE BEGINNING
3. ALL APPROVALS NOT IN PLACE DUE TO WHICH NATIONALIZED BANKS LIKE SBI NOT WILLING TO GIVE LOAN
4. NO RESPONSE FROM VATIKA TO E-MAILS INDICATING NO VALUE TO CUSTOMERS
5. NO CLARITY ON MEMBERSHIP CANCELLATION CLAUSE
As on date (22nd Feb 2009) there is no progress in the construction work on the site.
To add to this, in the span of past 10-11 months (i.e. since inception), none of the activities have been performed as per the proposed time-lines (construction linked payment payment) in the application form. In other words there is a delay in project since starting. To prove the point, lets see the proposed timelime and actual time when the action was inititated by Vatika, till date:-
1. Booking Date : March-End / April Starting 2008
2. Next installment due within 30 days of booking i.e. by May '08 but Actual date was Mid May 08
3. Next installment due within 3 months (or at allotment) whichever is later i.e. Around July 08 but Actual date was Mid Oct 08
4. Next installment due within 6 months (or at allotment) whichever is later i.e. Around Oct 08 but Actual date is Feb 09. Demand is currently open.
So, there is already a delay of roughly 4 months. Also, BUYER-SELLER AGREEMENT which must have been signed immediately after Allotment but Vatika dispatched the agreements in Feb'09.
To add to this, there is no clarity as when the construction will be started and when will the project get completed. On checking with Vatika, they verbally conveyed that work is scheduled to start in April 2009 and expected to finish by 2011-end. But, again there is no written commitment/communication in this regard.
Besides above, Vatika-CRM has stopped responding to e-mails which shows the kind of care they exten to the customers.
When checked about membership cancellation, Vatika is not willing to say anything. However, other people (non-Vatika) do say that normally booking amount/earnest amount gets forfeited but as such nothing is mentioned in the application form.
On cost front, DLF Bangalore/Chennai has already reduced the price for existing projects but no such benefit has been provided by Vatika as of know.

For the last 4-5 months, i've tried to reach the senior management to know about the progress of this Project. Their Chiarman Mr. Anill Bhalla & their CRM Head Mr. Anupam Varshney have failed to give any time frame about the construction/handover schedule.
Instead Vatika claims to have the financial tie up with HDFC & LIC Housing. When HDFC is contacted to vouch for Vatika's statement, they say they are waiting for the sanction plans to be submitted - which is getting delayed because of certain regulatory approvals not being submitted by Vatika. When Vatika is asked to share he details of the finance scheme - it just asks for a couple of weeks. And those "couple of weeks" have not come since last 4-5 months.
Vatika is not willing to share the Project progress details - but keep maintiang that it is on time and financing is tied up. If that is the case, why is that their website is silent about the Project progress. Why is that there is no mention about the financing tie up - which otherwise is the sellng point of the builders.
We the unfortunate investors - who have already paid 20% without having any idea of what is going on - need to come together and put pressure on the management to state the factual position.
Otherwise, the money alreday invested should be returned with a 15% compound rate of interest alomn with a a class action filed against Vatika for mis-representing and misleading its investors.

I have booked a 240 sq yds plot in Vatika India Next 6 months back. At the time we we told that they will not raise any demand until they have their propoerty cleared for funding by leading publice and private banks. It has been more than 6 months and the banks loans have not come through. In Dec 2010, they have suddenly raised 3 demands togather for 21 lacs and when I told that I can only pay further through a home loan, they tell me that it is not their problem how we pay the demand money. I have been running from pillar to post in Vatika but no solution. Their CRM team is extremely rude and they are now showing their true colors. At the time of booking they had promised to give in writing that they will not raise further demand until home loans are approved, but they flatly denied giving anything in writing. Now I have to pay 21 lacs and I HAVE NO WAY to arrange for this kind of money in the next fotnight. If we have other people with the same situation please lets get togather and see how we can counter this arrigant and bullying attitude from Vatika. They are truly showing their true colors now.

I bought a 2bhk flat in gurgaon 21 in 2008.1st of all people at Vatika group don't bother to respond to their customers query.Highly unprofessional and pathetic.2ndly i got to know that with re-allotment vatika is charging PLC on every flat.Let me tell this to Mr,Anupam Varshney(who never picks up the ) and Mr.Anil Bhalla that you cannot do anything and everything that you wish.Earlier i got to know that the flat no.alloted to me is not there and there are changing project map.And with this they also change the area.This is so horrifiying.It seems there is nobody to stop them from doing such heineous act.If that is case i would request Mr.Anupam Varshney and Mr.Anil Bhalla to return my hard earned money alongwith interest, because i cannot pay PLC charges.

lets be together to defeat this moster by the name of VATIKA to do what ever they want. We all previlage memners of Vatika group be unite to solve our common problem. Singe person cant fight with big business tycoons but we all small inmvestors can be one.

I had booked an Apartment in Gurgaon 21 project around 10 months back however I am still waiting to see any Progress.... They have misled the Investors by showing then dreams about world class township whereas the reality seems to be totally different. recently they have sent the agreement again to trap the innocent customers.... As per agreement Layout plan, Building Plan is yet not approved but still they want the Customers to sign the agreement so that they can later manipulate as per their wish. They have also introduced a clause of non refundable Earmnest Money (20% money already deposited by the customer) so that no one raises any objection later.. Why should we sign the agreement even when the Plans are not approved and nothing is mentioned about the facilities that are going to be provided in this so called 'Global Society'... I wonder how can they demand 60 lacs for an Apartment (3 BHK) without any prior Approvals... I would sincerely advise all the Allottees of Gurgaon 21 not to sign the agreement until Plans are approved and all facilites are clearly mentioned in the agreement whcih justify such a high cost of the unit in current economic situation...

Can you pls. pm me the details of the above complainant, so that we could approach the issue together with Vatika on a 1+1=11 basis. Calling all other such complainants for Jaipur Infotech to get together to give a common notice to Vatika.
