    Many of us are holding unapproved/Panchayat approved plots. They have become dead investment as we cannot sell the same unless DTCP or CMDA approves the same. A very difficult road ahead.

    TN GOVT to going to challenge in the court and will try to modify certain clauses as they are also loosing a lot

      The judgement is very good to check the conversion of the agricultural land into plots. But also it is too late but a required judgement for proper development of a residential colony.The gullible promoter to make quick money, developed such mindless plots which cause lot of problem for the residents. People will say that they need more money to buy a plot if it is approved by CMDA or DTCP. But why should we always think of a ground (2400 Sqft)for our house.

      Even we can build our house in a smaller area like 1200sq ft in a well planned colony. This mindless Panchayat approval totally spoiled a well planned housing development and many forums and media cautioned the public about so called Panchayat approval which is not at all a proper approval. But many Govt bodies including Banks accepted the approved for loan and they made the approval as a good as other legal approval. At least now there is some wisdom comes out through court. But still I am doubtful, this order can be implemented in full spirit because it will create a chain reaction and need some remedy for the innocent buyers.

      Lets wait and see how the government is going to take step to protect the innocent plot buyers(Old) and a well planned housing.development of Tamil Nadu.

        It should not be done retrospectively. There people who are holding on to unapproved plots from 60s and 70s.

          People holding unapproved plot (60s or 70s or any year) cannot sell now as the transaction will not be registered. They are trying a loophole to sell the plot as agricultural plot, court is blocking that also by imposing minimum size on agricultural plot that can be sold to third party.

            If a farmer wants to sell his small agri land which he has got as his share, I don't think court can stop the selling.

            Govt is going to suggest that only " Nansey" lands can not be sold as plots.

              As per CMDA, the unapproved plots formed before 5.8.1975 can be considered as approved and also considered under CMDA Green Channel for Planning Permission Approval. Not sure whether the registration department will accept the GO copy as the proof for the approval.

                Whether it is approved/not approved layout/plot if we have building plan approval for the particular plot.then it may consider as approval plot?

                  Soon high court will issue stay on its own verdict.

                  A simple question as a law abiding citizen, if the village presidents were practicing to approve such unapproved plots in the guise of "panchayat approved layouts" by taking suitcase full of money from amateur / overnight promoters, even though they don't have power to approve any such layouts, are they not punishable, since these officials have misused their power in a fraudent manner?

                  It is big scam then. Why this scam is not coming in picture during the court verdict.

                  "Ramana" needs to be back.

                  Moreover the money eaters are the registrars. So literally the registrar office was accompanying this fraudent. Are they not liable for refunding the money tax collected?

                  Let us assume the capital money thrown by the investors be lost in these fraud layouts, as per the high Court order. But, will the investors get the refund of the registration amount and the tax paid during the registration, if the government now agrees that these layouts are not valid all of a sudden, after being advice by the "CLEVER" high court. Till last month since 1997 the legal department was sleeping it seems.

                  Very funny country we are living in.

                  But , in overall, I am also one of them who welcome this court order. But, not so late, after many people already lost their hard earned money by investing in such layouts during last 10 years especially. Will government buy these layouts back from people to nurture it back as agricultural fertile lands? :what:

                  Anyway, I Feel pity for the innocent buyers, especially who entered as investors expecting better returns than bank interest, but finally now ended at zero returns and loosing the capital investment itself.


                  But don't worry . As we all know, this is also one of the funny dramatic order by high court similar to "Helmet and traffic regularisation" orders twice in a year.

                    You are right. Govt was party to this action in every possible way which makes the ruling difficult to sustain. However, my only hope is that this puts a check and end to anymore promotions of 'Panchayat Approved' plots. This ruling, if persists for some more time, and the ensuing panic will spread the message that the 'Panchayat Approval' is a scam and reduce the audience for it. We need such 'awakening' call for ECR side soon as the rampant 'red light' speeding has legitimized it and made it a norm. Following rules and asking questions related to land/building approval in ECR area is akin to a dressed up man in a nudist camp.
