We have bought a two bedroom flat in Alwal area in secunderabad in the year 2004.The quality of construction is very poor and this has resulted in :

1. Our main gate- Iron one has fallen from the hinge within 1.5 year and till date this has not been repaired

2.Our Flats leaks in every rainy season

3. Doors , nuts and bolts used were of very inferior quality and this has broken in many places

4. Cracks in the wall has appeared within 6 months

5. Every rainy season we have the water flowing from terrace down the staircase and potential threat of anyone falling down

6. Water connection was not given at the time of occupation

7. Many taps have been replaced due to poor quality

8. Privacy on the iron gates has not been provided

9. Terrace rain shelter was broken to pieces during the rainy season because of poor quality sheet and work done.

10. Driveway slope is too steep and 2 wheelers skidding is high

There are many other points , now anyone in Hyderabad can provide me with details to fight this case in the consumer forum.All residents have formed a resident welfare association and it has been regd. We`are looking for step by step methods to claim compensation and book the builder severely for the hardships which we have faced.

    Hello !!!

    It is really sad that you are facing such grave issues at your place of residence.

    Since it is a flat, your neighbours must be facing similar problems...

    In your case, its the sheer deficiency of service from builder's part and he is certainly held accountable for that.

    You simply need to visit the consumer court of your city and get the complaint form that is given free of cost or not more than Rs 20.

    Once you fill up the form describing the nature of the complaint, you have to enclose sufficient evidences in support of your case. So you must get photographs of the affected parts of your flat and enclose them with a copy of the registry.

    If you have any brochures or hard copy of any documents from the builder's end stating the features and facilities of the flat, it will work for you.

    Most of the builders today specify which quality of flooring, tiles, fittings etc they will install in the properties and the same is distributed to the prospects quite in general. So, try securing such proofs.

    Further, if you feel that you can express your case before the judges, there is no need to hire any lawyer. On the other side, you can take services of an experienced advocate.

  • Sorry for your situation. But you know how our system works. All depends on who the developer is. Also check the agreement papers that were provided to you during the Apt purchase, and go through the terms clearly, and see if there is scope to go back to developer and demand the action/money.

    If the developer was just one-time-wonder in the market, then it is be hard to trace him or he woulnt care to give an ear to this issue. But if the developer is continuing in the market, there is some probability that he may help to keep the name in the market. Please research your options and proceed. First step would be to approach the developer and talk to him without any fight. Going to court should be the last step.
