    NGT disposes plea against Goa Velha building complex

    ​While the activists had alleged that the report of the expert committee formed based on NGT orders were faulty and malafide, the tribunal refused to accept this submission.

    PANAJI: The National Green Tribunal (NGT) has disposed of an appeal filed by two activists alleging that construction of an apartment complex in Goa Velha has been carried out in no development zone of CRZ.

    While the activists had alleged that the report of the expert committee formed based on NGT orders were faulty and malafide, the tribunal refused to accept this submission.

    The Tribunal said that expert committee findings have to be put on a ‘higher pedestal and appreciated as documentary evidence’.

    “It is a well settled position of law, a report/opinion of the expert committee is put on higher pedestal and of course it needs to be appreciated like any other documentary evidence,” the Tribunal said.

    The appeal was filed stating that the construction at Goa Velha was carried out by damaging salt pans and mangroves. The activists asked for the construction to be demolished and the land to be restored to its original state.

    The activists said that while an inquiry committee, set up on orders of the Tribunal in 2014, stated that three of the constructions were in violation of laws, the same inquiry committee submitted a second report later the same year where they contradicted their original findings.

    But the Tribunal found that the inquiry committee found in its second report that the GCZMA had granted permission for the construction by considering the width of the nearby river as the CRZ line. The committee raised the issue as to which is to be considered as the CRZ line, the Tribunal noted.

    The inquiry committee found that site plans had a different CRZ line and the permission granted by GCZMA for construction had considered a different CRZ line.

    The committee noted that the CRZ line was drawn in 2005 by the GCZMA when granting the permission and the construction was carried out based on this permission. Therefore, the construction cannot be said to be in the no development zone of CRZ.

    The panel said that only a cemented platform and jetty existing in the no development zone of CRZ should be removed, which was eventually demolished.

    The Tribunal noted that its subsequent committees also did not find any violations. The 2017 committee also found that there was no disturbance to mangroves at the site.

      Govt orders building on Saligao comunidade land to be demolished

      PANAJI: The directorate of panchayats has ordered the demolition of a ground plus two-storey building on comunidade land in Saligao. The matter came to light after a villager Eleuterio Fernandes raised the matter against the sarpanch and the comunidade of Saligao and won the case against them.

      The judgement states that “the construction has been erected without any valid lawful permissions” and that “the construction does not possess the necessary legal permissions.” The judgement further read that the construction is a “pucca construction” since materials used are sand, cement, steel, laterite stones, RCC etc.

      “An illegal construction of a huge ground plus two floors structure which has been constructed illegally by the comunidade in an agricultural tenanted property without the necessary developmental permissions and approvals from the town and country planning department and without obtaining the necessary construction license,” the judgment reads.

      It states that this is in “blatant violation of all building laws, rules and regulations, including the Town and Country Planning Act and Rules, as this illegal construction does not have an approved plan or a no objection certificate (NOC),” from the Town and Country Planning department (TCP).

      Deputy director of panchayats Fiona Cardozo has granted a period of three months for the demolition. “The village panchayat secretary of the sarpanch shall proceed to demolish the construction as specified in the BDO report with the help of a demolition squad within a period of three months and all the expenses incurred shall be recoverable from the comunidade,” the order reads.
