    ‘Comunidade land to be saved by amendment’

    Porvorim: Acknowledging that comunidade lands in the state were mired in controversy and illegal plot allocation, revenue minister Rohan Khaunte on Monday said the government is working on an amendment to strengthen the code of comunidade to ensure that this land is not fraudulently sold or squandered.

    “I think the code of comunidade itself has some shortcomings and the comunidade commission, which we had appointed, has recommended some changes,” Khaunte said. “We are trying to bring an amendment and if for some reason we cannot manage it this time, then we shall bring out an ordinance.”

    Even as the minister stated that the government was serious about protecting comunidade land in the state, he said the management bodies for the comunidades also had a responsibility, which they were not performing. “We must look at this seriously. Just 165 comunidades are functional,” Khaunte said.

    Earlier, speaking during the discussion on the demand for grants, Aldona BJP MLA Glen Ticlo said, “Comunidade managing committees are not appointed and that is why comunidade land is being misused.” The government should take some measures to safeguard comunidades , Ticlo said.

    Khaunte said that each comunidade managing committee was answerable through the code of comunidade. “Under Article 34J, they have to take the approval of the government before doing anything, otherwise it is illegal.”

    He urged the opposition to support the Bill to amend the code of comunidade when it is brought before the House.

    Khaunte also informed legislators that, since 2012, the Serula comunidade cannot allocate plots as per the high court directive. He also said that the government had enforced compliance of norms by the administrator of comunidades. “We will act, whether it was Shirvoi, Colvale, Peddem, Harvalem, Tivim, we have acted with a firm hand,” he said.

      MLAs want strict action against land violators

      Porvorim: Legislators, cutting across party lines, on Monday urged the government to take strong steps to crack down on illegal land transactions in communidade land. MLAs also expressed concern that several comunidade bodies were defunct.

      During the discussion on demand for grants, MLAs argued that the apathy shown towards the comunidade system was undermining the age-old land ownership system.

      “Is it that the government is conniving with officials so that they can take over comunidade lands? It should not be the case with such age-old institutions,” Congress MLA Aleixo Reginald Lourenco said. In the recent past, comunidade land at Pedemol, Colvale, and Serula has been illegally sold by representatives of the comunidade.

      BJP Calangute MLA Michael Lobo raised concerns about comunidade land being usurped. Congress MLA Francis Silveira said that in his constituency, construction companies were dumping debris and clay on communidade property despite the local panchayat intervening and filing a police complaint. “I demand that the government file a complaint against those who filling mud on communidade land, in this case Gera developers. If a sub-contractor is involved, a complaint should be filed against the sub-contractor also,” Silveira said.

        Activists: Draft CRZ will forever displace local occupants

        Calangute: Goans Against CRZ — a federation comprising unions, political parties and activists — organised a meeting at Calangute beach on Monday to create awareness about the implications of the draft 2018 Coastal Regulation Zone (CRZ) notification which has proposed to reduce ‘no-development zones’ from the existing 200m to 50m.

        Kennedy Afonso, convenor of the federation, said the 2011 CRZ notification, regularising structures built by traditional occupants in no-development zones, should have been implemented by now. However, seven years later, nothing has been done to implement the 2011 notification that would have benefited traditional occupants. “Now they have come up with the 2018 draft notification to reduce the no-development zone to 50m. This is being done only to facilitate construction of hotels by outsiders who have bought huge areas of land in the no-development zones,” he said.

        Former Calangute sarpanch Joseph Sequeira, who also spoke at the meeting, said if the draft 2018 notification is implemented, it would forever displace local traditional occupants

        Former Calangute MLA Agnelo Fernandes said the most affected would be beach shack owners.

        “Most of the beachside plots have been bought by outsiders who are waiting to build hotels. Once hotels are built, no beach shacks would be permitted in front of the hotels. The shack owners will be finished,” he said.

        However, response to the meeting was unimpressive.

          New Goa Board building gets government approvals

          PANAJI: The new building project for Goa Board of Secondary and Higher Secondary Education has already received all the necessary clearances for construction from various government departments. It now only waiting for approval for finance for the project, members were told at a Goa Board meeting held recently.

          The current building of the Goa Board, having been opened for use in 1993, is less than 30 years old, but is rid with structural defects, due to which the new building project was planned by the state. The issue of the poor condition of the existing building was even raised in the past in the state assembly.

          Deputy manager of Goa State Infrastructure Development Corporation (GSIDC) along with his team and consultants appointed for the Goa Board project Pankaj Joshi and Abhijeet Bhosle attended the board meeting in June this year. They gave the board members a presentation on the proposed new building project.

          During the presentation, 28 Goa Board members, including chairman and secretary, raised various queries on safety measures, dimensions of halls, total cost of the building, library facilities, water storage, rain water harvesting which were answered by Joshi.

          The new building is expected to have rooms to carry out the confidential work of the Class X and Class XII public exams, as well as conference rooms. The cost of project will include furnishing. The building will also be fitted with the latest computers before being handed over to the board.

            To curb property frauds, Goa government to use Aadhaar

            PORVORIM: Resident as well as non-resident Goans will soon be able to keep track of their ancestral property and take steps to prevent fraudulent sale of their land once the state government implements an Aadhaar-based system which will send alerts regarding transactions about the linked properties.


            "Regarding property, we are getting into a service to give Aadhaar-based alerts which is voluntary," revenue minister Rohan Khaunte said on Monday during the discussion on the demand for grants for departments headed by him. "We expect the property owner to give his phone number and email id and if anyone comes forward to perform a transaction with the land, other than the owner, the owner will get an SMS and email."

            Given the controversy about implementation of Aadhaar, Khaunte said the linking of Aadhaar to property to avail the service would be purely voluntary.

            "It is in the interest of Goenkar and those abroad. This will take care of all the frauds," the minister said.

            In December, agriculture minister Vijai Sardesai had said the government was considering introducing a law to check fraudulent sale of ancestral property.

            Goans living outside the state and expatriates have claimed that very often their ancestral land is sold without their knowledge. The government has already made it mandatory for citizens to provide their Aadhaar data while registering any property sale deed.

            The revenue minister said the department had initiated GIS-mapping of all land records in the state which would be completed in a year's time. "Every citizen will have access to the GIS network. Digitisation of maps and land records to create an online digital database of land in Goa," he said.

            Responding to queries regarding the long-pending mutation and partition cases raised by MLAs from the opposition, Khaunte said the department had streamlined the process to obtain partition and mutation by creating an online single window system.

            "Courts have been opened up on Saturdays for speedy disposal of mutation, partition and title cases. We have simplified the procedure and with that corruption has reduced," he said.

            To reduce the work load on the revenue department and to simultaneously provide government services close to citizen's home, Khaunte said that a revenue bhavan would be opened up in Porvorim and one in Morod, Mapusa. A dedicated office for the deputy collector in Sanguem and in Ponda would be created in this financial year for which the office space had been identified.

              Congress had hand in SEZ scam: GFP

              Panaji: Goa Forward Party (GFP) has challenged the Congress to move an adjournment motion for a discussion on the special economic zone (SEZ) issue, alleging that the opposition party has compromised to benefit from the cabinet decision.

              The state government on Friday decided to take back 38.4 lakh sqm of land from the promoters of SEZ for Rs 256.6 crore, including the interest payment of Rs 123.5 crore and decided to withdraw cases against former chief ministers Pratapsingh Rane and Luizinho Faleiro and opposition leader Chandrakant Kavlekar for making the allotments. Faleiro was the industries minister when the allotment was made and Rane was the chief minister, while Kavlekar was chairman of Goa industrial development corporation which had allotted the land to the promoters.

              “Will the Congress now rush to the well of the House protesting this cabinet decision of hushing up this scam?” said chief spokesperson of GFP, TrajanoD’Mello.

              “The Congress president should come out openly and speak against dropping the scam charges against its three MLAs, including two of its ex-chief ministers and present leader of opposition,” D’Mello said.

              He said the three escaped criminal investigation in the land scam that had rocked Goa in 2006-07. On the TCP amendment bill, D’Mello said Congress should have brought an amendment if they really felt that something needed to be corrected in it.

                Mhadei case: ASG advises CM to file contempt plea

                Panaji: Additional solicitor general of India Atmaram Nadkarni, who appears for the state in the Mhadei water disputes tribunal, has advised chief minister Manohar Parrikar to file a contempt petition against the state of Karnataka for diverting the waters of the river into the Malaprabha basin.

                “As per instructions received from the chief engineer, water resources department, Karnataka has breached the vent, thereby allowing the Mhadei waters to be diverted to the Malaprabha basin, which is contrary to the undertaking given by the state of Karnataka before the Supreme Court of India, and which undertaking was also taken note of by the MWDT,” Nadkarni said.

                Nadkarni said that in such circumstances, in case of any diversion, “the same amounts to obvious contempt of the undertaking given to the Supreme Court”. Thus, he suggested that action for contempt of court be initiated in the matter.

                TOI was first to report that Karnataka had diverted the waters of the Mhadei. Taking suo motu cognisance of the report, two teams of the water resources department (WRD) inspected the site of the diversion at Kalsa.

                Nadkarni, in a letter to Parrikar, said it had reference to the ongoing dispute heard by the MWDT, in which an award of the tribunal is expected on or before August 20 this year.

                The government of Karnataka had filed an affidavit before the Supreme Court swearing it wouldn’t divert the waters of the Mhadei until the necessary clearances were obtained from the MoEFCC as well as those stipulated under the provisions of the Environment Protection Act, 1986. However, Nadkarni said that contrary to this undertaking, Karnataka undertook diversion of the Mhadei, as informed by the WRD’s chief engineer.

                Nadkarni said that before undertaking such huge constructions, Karnataka hadn’t obtained permissions under the Water (Prevention and Control of Pollution) Act 1974, the Environment (Protection) Act 1986, the Wildlife Protection Act 1972, the Biological Diversity Act, 2002, or from the Centre or planning commission.

                  Amendments a bid to loot state: Mickky

                  Margao: Former Nuvem MLA Francisco Xavier Pacheco, popularly known as Mickky, on Tuesday termed the recent amendments to the TCP Act “an attempt to loot the state”. He accused the opposition of conniving with the ruling party in passing the amendments with a view to facilitate the “organised loot”.

                  “With the assembly passing the amendments, it has paved the way to rob the state,” Pacheco told reporters. He also expressed his disapproval over the state’s decision to withdraw corruption cases against three Congress MLAs in the alleged SEZ scam.

                    ‘Bill exposes govt’s hidden agenda’

                    Panaji: Opposing the Goa Town and Country Planning (Amendment) Bill 2018, activist group Goenkars Against PDA, alleged that the bill exposed the government’s hidden agenda to expose the state’s land resources to land sharks and deny future generations of their right to enjoy the resource.

                    Arturo D’Souza, a member of the group, said if the government really wanted to repose faith in its citizens of having a vision for their land in terms of its development, it could have included the 73rd and 74th constitutional amendments. “The government finds no obligation towards this cause of giving rights to its citizens and seems to be in a hurry to satisfy the builders’ lobby,” he said.

                    Section 16B of the bill, which deals with reintroducing change of land use throughout the year, would make the Regional Plan useless, D’Souza said.

                    The transferable development rights (TDR) policy was also a direct attack on the pro-people law enacted by the Parliament to award fair compensation to displaced owners following land acquisition, D’Souza said, even as he alleged that the state government was trying to sabotage this cause.

                    “It seems the state is fully aware it has completely messed up the whole exercise of RP 2021 because of two reasons: It has no ground reports to back its planning ideas and there has been no consultations with villagers to sustain this planning,” D’Souza said.

                      Will continue to oppose TCP bill: Cong

                      Panaji: Having failed to stall the passage of the controversial amendment bill to the Goa Town and Country Planning Act, Congress state unit president Girish Chodankar on Tuesday said that the party is exploring all options to continue its battle against the bill.

                      In a statement issued, Chodankar said that options will be explored. “We will never allow such destruction of Goa,” he said, adding that the government’s intentions will be known soon. Congress could muster the support of only 15 members against the bill. Its own member, Taleigao MLA Jennifer Monserrate was absent when opposition leader Chandrakant Kavlekar moved a motion to refer the bill to the select committee.
