    Confiscate property of Agrani Homes' directors: Bihar RERA

    The two were hearing a bunch of complaints filed by the aggrieved real estate buyers, who have made payments to Agrani Homes but have not got possession of the property.

    PATNA: The Real Estate Regulatory Authority (RERA), Bihar has ordered confiscation of all movable and immovable property of the present and previous directors of Agrani Homes Private Limited and freezing of their bank accounts.

    The order was passed by the bench of RERA, Bihar chairman Afzal Amanullah and member R B Sinha on February 10. The two were hearing a bunch of complaints filed by the aggrieved real estate buyers, who have made payments to Agrani Homes but have not got possession of the property.

    The RERA has also ordered that utilisation of a building constructed on a residential plot in Patliputra area by Ruben Hospital (Ruben Patliputra Hospital Pvt Ltd) be stopped until further orders or an approval from Patna Municipal Corporation (PMC) for utilisation of the residential property as a hospital, whichever is earlier. Ruben Hospital has been asked to explain why they were using the building for medical purposes without proper deed as well as authorisation from PMC.

    Incidentally, the plot was sold by Agrani Homes to Ruben Hospital using the proceeds of few real estate projects of the company. Agrani was required to use the proceeds from the sale of Patliputra property to reimburse its aggrieved customers. However, out of Rs 4.05 crore received from Ruben, Agrani deposited only Rs 2 crore with RERA. Now, Agrani has been directed to deposit another Rs 2.05 crore in the form of demand draft with RERA immediately.

    The RERA bench has observed that a part of the money paid by Ruben Hospital for buying the land at Patliputra was used by Agrai Homes for closure of a loan account of Indus Ventures, a firm run by Vijaya Raj Laxmi, wife of Alok Kumar, managing director of Agrani Homes.

    The RERA has stated in its order that all moveable and immoveable property of Alok, his wife Vijaya and their son should be brought under the lien of RERA with immediate effect. Similarly, all moveable, immovable properties and bank accounts of all its present and previous directors, their spouses, dependent children and all their power of attorney holders have been frozen.

      Over 18 lakh beneficiaries got aid under PMAY-Gramin: Bihar rural minister

      He said from 2012-13 to 2015-16, the construction of 19.03 lakh houses were approved, and 18.03 lakh beneficiaries have got the first instalment. He said 13.67 lakh units are complete.
      PATNA: State rural development minister Shravan Kumar told the legislative council on Monday that the Pradhan Mantri Awas Yojana scheme is being implemented properly in the state, and its progress monitored. The minister said staffers have been roped in on a contract basis to encourage beneficiaries to avail of the facility, and panchayats observe Awas Diwas every Wednesday.

      He was replying to a starred question raised by MLCs Radha Charan Sah and Ram Chandra Purbey on the issue of incomplete houses under Indira Awas Yojana and their report not available on the portal.

      Shravan told the Upper House that the Indira Awas Yojana was renamed Pradhan Mantri Awas Yojana Gramin in 2016-17. He said from 2012-13 to 2015-16, the construction of 19.03 lakh houses were approved, and 18.03 lakh beneficiaries have got the first instalment. He said 13.67 lakh units are complete.

      He further said as per a letter from the Union ministry dated November 2017, there's a ban on giving the first instalment to new beneficiaries under the Indira Awas Yojana and only those houses which have received the first instalment will be completed. This means 4.35 lakh beneficiaries will not get money.

      Minister further said beneficiaries have to construct their houses themselves and they get the second or other instalments only after completing a certain determined level.

      Acting chairperson Awadhesh Narain Singh told the Upper House that the video clippings of the proceedings will be made available to them the same day, which they could use on their social media. BJP MLC Rajneesh Kumar thanked the acting chairperson on behalf of all members.

        PATNA: The Real Estate Regulatory Authority (RERA) has put a stay on registration of any property in Residency-City Centre project at Lodipur here till the time a final order does not come from Patna high court on pending cases related to the land and its ownership.

        A complaint case was filed in 2019 by the Baptist Union Church, Bakerganj, against the developer, M/s Utkarsh Sfatik Ltd, claiming that the firm was not the lawful owner of the 7.52acres of land of the project titled ‘The Residency-City Centre". The complainant Rev Moses V Thomas, pastor-cum-priest-in charge at the Baptist Union Church claimed that the land was acquired through wrongful means.

        The respondent, Utkarsh Sfatik Ltd through its managing director, Saday Krishna Kanoria, later stated that frivolous allegations have been levelled having no basis and complaint does not come under the purview of related clauses of RERA Act, 2016. It was further stated that the dispute on land ownership and pendency of cases is in the Patna high court.

        In the light of few petitions and counter-petitions filed at Patna high court and one at Delhi high court, the full bench of RERA, Bihar, consisting of chairman Afzal Amanullah and its member R B Sinha recently ordered that “no registration shall be done of any properties, constructed or situated on the said 7.52 acres of land till such time as the issues of the title and legitimacy of sale are finally decided by the honourable courts where these matters are pending.”

        The RERA, however, permitted the registration granted to the developer by the Authority under RERA Act to remain in force till its due date.

          Provide pucca houses to all eligible beneficiaries: Bihar CM

          The CM further said that the RDD officials must ensure that all eligible beneficiaries get a pucca house either under the PMAY-G or the MMAY-G.
          PATNA: Chief minister Nitish Kumar on Friday asked rural development department (RDD) officials to speed up the ongoing construction of houses under the Pradhan Mantri Awas Yojana-Grameen (PMAY-G) and the Mukhya Mantri Awas Yojana-Grameen (MMAY-G) to provide pucca houses to all eligible beneficiaries at the earliest.

          While chairing a high-level meeting to review the progress of the PMAY-G and the MMAY-G in the state, he further asked the officials to immediately release all due amounts to the beneficiaries so that people in rural areas can get more opportunity of employment besides completing the construction work of houses. “Release of funds under the two housing schemes would also benefit the rural economy,” Nitish said.

          The CM further said that the RDD officials must ensure that all eligible beneficiaries get a pucca house either under the PMAY-G or the MMAY-G. “If an eligible person could not get a pucca house under the PMAY-G for any reason(s), he/ she must be allotted similar house under the MMAY-G. Ensure that no one is left,” he added.

          “Families who have been rendered homeless because of the anti-encroachment drive on public land like Aahar, pynes and ponds under the ‘Jal-Jivan-Haryali Abhiyan’, should be provided benefits of either of the two housing schemes or the Mukhya Mantri Vaas-sthal Kray Sahayata Yojana (Chief Minister Homestead Land Purchase Assistance Scheme.),” the CM told the officials at the meeting.

          State government provides assistance of Rs 60,000 per family to buy land for building homes to BPL families who do not have land.

          Similarly, the PMAY-G, a central government scheme, was launched to address the housing gaps existing in rural areas and provide pucca houses with basic facilities and a clean kitchen for those living in ‘kuchcha’ houses. The houses built under the PMAY-G scheme are low-cost and disaster-resilient. The central and state governments share the cost of assistance at a ratio of 90:10 in the hilly areas and 60:40 in the plain areas, and it stands at ₹ 1.2lakh and ₹ 1.3 lakh in the plain and hilly areas, respectively.

          The MMAY-G was launched by the state government a few years back. Under the MMAY-G, all those eligible families are provided pucca houses, who could not be covered under the PMAY-G for any reason. All costs under the MMAY-G are met by the state government.

          While reviewing the progress under the continuous livelihood programme, Nitish asked the officials to provide necessary assistance to those poorest families who have been rendered jobless after ban on sale of liquor and toddy in the state.

          Earlier, RDD principal secretary Arvind Kumar Choudhary made a detailed presentation before the CM on progress made under the PMAY-G, the MMAY-G and some other schemes of his department.

            Bihar CM asks officials to speed up installing smart meters in every house

            PATNA: Reiterating his demand for ‘one nation, one electricity rate’ in the country, CM Nitish Kumar asked the energy department to accelerate the installation of prepaid smart meters in each household of Bihar on Saturday.

            While chairing a high-level meeting to review the performance of the energy department through video conferencing, the CM assured the officials that there would be no dearth of funds for the ongoing work of installation of prepaid smart meters. “You all should work to speed up the installation of smart meters,” he said.

            Nitish said the prepaid smart meter scheme was first launched in Bihar. Later, the Centre adopted it for implementation in other states. “The installation of prepaid smart meters in all households will not only provide convenience to the consumers but also stop the misuse of electricity in the state,” he said.

            “Union Finance minister Nirmala Sitharaman, while presenting the country’s Budget for FY 2021-22 in the Parliament in February this year, proposed to introduce the Bihar government’s prepaid smart meter scheme throughout the country. Then, Bihar CM had welcomed the Centre’s decision,” an energy department official told TOI on Saturday.

            A few months ago, the government-owned Energy Efficiency Services Ltd (EESL) entered into agreements with two power distribution companies of Bihar for the installation of 23.4 lakh prepaid smart meters in the state.

            Speaking at the review meeting, Nitish said his government completed the task of providing electricity connection to every household across the state in October 2018. People are getting an uninterrupted supply of power. “All people are requested to use the electricity for good purposes and don’t misuse it. The proper use of electricity is also in the interest of the environment,” Nitish said.

            He further asked the energy officials to work on a priority basis for providing electricity connection to farmers to supply water for irrigation to each farmland.

            The CM further asked the officials of the renewable energy agency to expedite the installation of the proposed two solar power plants at Kajra in Lakhisarai district and Pirpainti in Bhagalpur district. “With the beginning of generation from the two plants, there will be a sharp increase in the production of solar power in the state, which will be in the interest of the environment,” Nitish said.

            While reviewing the status of hydel power, Nitish said, “The multi-purpose Dagmara hydropower project was in its advanced stage, and the state would be benefited after the completion of this project.”

            Earlier, the state’s energy secretary Sanjeev Hans made a detailed presentation before the CM on the current status of different schemes of the department.

              Illegal occupants vacate government flats in Chhapra town

              BSHB’s executive engineer (Muzaffarpur section), Sujit Kumar, told this newspaper that nearly 75% of the illegal occupants had willingly vacated the flats.
              CHHAPRA: A large number of residential flats, which had been constructed by the Bihar State Housing Board (BSHB) at Prabhunath Nagar in Chhapra, were vacated on Tuesday. Of the 164 flats built in 1980, only two were “properly allotted” while the remaining were encroached upon.

              BSHB’s executive engineer (Muzaffarpur section), Sujit Kumar, told this newspaper that nearly 75% of the illegal occupants had willingly vacated the flats.

              “The ones, which were not vacated, have been sealed by the administration in the presence of police. Now, the people, who try to break the seals, will be booked and fined,” Sujit said, adding that the poorly-maintained flats were in a dilapidated state and not suitable for anyone to live in.

              Earlier, Saran district magistrate Nilesh Ramchandra Deore had visited the locality and directed the illegal occupants to vacate the flats.

                ED arrests Patliputra Builders' MD in Patna in money laundering case

                ​​Anil Kumar Singh, MD of Patliputra Builders Limited, was taken into custody on September 7 and a special Prevention of Money Laundering Act (PMLA) court sent him to five-day ED custody on Tuesday.
                NEW DELHI: The Enforcement Directorate (ED) has arrested a managing director of a Patna-based real estate company in a money laundering case linked to alleged misappropriation of public funds in allotment of flats, the agency said on Wednesday.

                Anil Kumar Singh, MD of Patliputra Builders Limited, was taken into custody on September 7 and a special Prevention of Money Laundering Act (PMLA) court sent him to five-day ED custody on Tuesday.

                The ED filed a criminal case under the anti-money laundering law after studying a Patna Police FIR and charge sheet against Singh where he has been accused of "defalcation of public money and non-allotment of flats to the buyers even after receiving money for allotment of flats."

                The agency alleged that Singh, all through the investigation, has "resorted to non-cooperation with the investigation and has not divulged any truth or information."

                About Rs six crore funds have been identified in this case as the proceeds of crime under the PMLA, it said.

                  Patna high court to NHAI: Remove religious structures hindering NH work

                  PATNA: The Patna high court on Tuesday directed the National Highways Authority of India (NHAI) and state government to ensure removal of five religious structures from the Koilwar-Buxar NH project by February 28 in accordance with the Supreme Court directive issued in the Union of India vs state of Gujarat & others case.

                  One of the guidelines stipulates that in case of unauthorized constructions of religious structures for worships on public places, roads and parks, all the states and union territories have to formulate comprehensive policy regarding removal or relocation or regularization of the unauthorized construction.

                  Hearing a batch of PILs for speedy execution of NH projects in the state, the division bench of Chief Justice Sanjay Karol and Justice S Kumar directed the district magistrates of Buxar and Bhojpur to get associated with the local populace and lend the requisite sensitivity in the matter. The court also expressed its displeasure over the sluggish progress in this highway construction as 30% of the project work is still incomplete whereas the completion deadline of this project is April 17, 2022.

                  HC summons former Patna SSPs: The Patna high court has directed former Patna SSPs Garima Mallick and Upender Kumar Sharma to remain virtually present before the court (in case the court does not start physical hearing) on February 2 for furnishing their respective explanation as to what efforts they made for arresting an accused, who had fraudulently obtained provisional bail from the HC on the pretext of performing last rites of his father, who was later found to be alive.

                  A single bench of Justice Satyavrat Verma, while hearing the bail petition of the accused Prem Sahani, passed the order on Monday, which was uploaded on Tuesday. The court appreciated “the commendable effort” of present Patna SSP Manavjit Singh Dhillon.

                    “It is our aim that all eligible beneficiaries get a pucca house. The officials should monitor at the ground level on a regular basis to ensure that no eligible person is left out,” Nitish said at the meeting

                    He asked the officials concerned to expedite construction of the approved houses under PMAY-G and MMGAY.

                    “The families which have been rendered homeless because of anti-encroachment drives to revive ahars, pynes and ponds under the Jal Jeevan Hariyali Abhiyan, should also be provided benefits of the either of the two housing schemes or the Mukhya Mantri Vaas Sthal Kray Sahayata Yojana (Chief Minister Homestead Land Purchase Assistance Scheme),” the CM said.

                    The state government provides assistance of Rs 60,000 per family under the Vas-Sthal Kray Yojana to buy land for building homes to those BPL families that do not have their own land.

                    Nitish also said that if a person has been approved funds for constructing a pucca house under the PMAY-G and s/he does not have even a small piece of land to construct the house, such eligible families should be provided an assistance of Rs 60,000 under the Vas-Sthal Kray Yojana.

                    Earlier, principal secretary (RDD) Arvind Kumar Choudhary gave a detailed information to the CM about the number of approved houses, completed houses and pending houses under both the housing schemes.

                    Choudhary said more than 26.94 lakh houses have so far been approved under the PMAY-G in Bihar. Currently, Bihar is at the third position in the country in implementation of PMAY-G. The national average of completing the scheme is around 78%, while has achieved 86% of its traget.

                    “Under the MMGAY, altogether 13,199 houses have so far been approved. Of them, 8,753 have been completed,” Choudhary told the CM.

                    Former chief secretary-cum-principal secretary to the CM Deepak Kumar, development commissioner Atul Prasad and secretary to the CM Anupam Kumar were also present at the review meeting. RDD minister Shravan Kumar and principal secretary (RDD) Arvind Kumar Choudhary joined the meeting through videoconferencing.

                      Bihar government starts environmental audit of sand ghats

                      Officials claimed that there are many environmental rules for sand mining and their compliance is very important. Keeping this in mind, environmental audit of all sand ghats of Bihar has been started. Representative Image PATNA: Bihar State Mining Corporation Limited is conducting environmental audit in accordance with the central government’s Environmental Guide 2020 to prevent illegal mining in the state.

                      Officials claimed that there are many environmental rules for sand mining and their compliance is very important. Keeping this in mind, environmental audit of all sand ghats of Bihar has been started.

                      Contractors have been selected and sand mining has been started in Bihar. As sand mining against prescribed standards is dangerous for nature, river ecosystems and sustainable environmental protection, the mining corporation is conducting environmental audit.

                      Officials said during this audit, the mining plan of sand ghats, their latitude and longitude related details, conditions of consent for operation issued by Bihar State Pollution Control Board, standards related to sand mining, its storage and transportation will also be examined by the audit agency concerned.

                      The corporation has given this task to Ocean Inviro Management, Cognizance Research India, P&M Solutions, Ryan Enviro Pvt Ltd and Asenso Enviro Pvt Ltd, listed by the Union ministry of environment, forest and climate.

                      These agencies will use latest technology and drones to inspect the respective sand ghats. They will be directed to audit the sand ghats on random basis.

                      The officials claimed that in case of any irregularity in the environmental audit report, legal action will be taken against the sand ghat contractors concerned. The objective of this entire initiative is to prevent illegal mining as well as ensure compliance with environmental standards.
