    Hello,



    I need some suggestions as I am in the process of selling my current house. My property was purchased by the first buyer in the year 2002. He sold his house to the second buyer in the year 2008. And in the year 2013 I became the third buyer. Now the second buyer had lost the first buyers agreement which came into my attention at very late stage.

    Now I am planning to sell the house but I don't have the original agreement of first buyer, but some how I still managed to get a xerox copy of the lost agreement.

    I read somewhere that to get a duplicate agreement I ll have to file a FIR report and some newspaper ads. But this was lost by the second buyer and he is no more staying in India.



    Now my questions are:

    Will there be any complications on selling my flat without having original first agreement?

    The new tentative buyer is opting for home loan, will bank ask for first original agreement?

    On behalf of second buyer, can I still go ahead and create a FIR report without him getting involved as he has permanently left India?

    Is there any other way of getting my xerox copied version as certified copy?



    Or any other solution?

    You can get a scanned copy from registrar office duly certified

      So can I just walk to the registrar office and get my xerox copy certified? Or there is a separate process to get it certified

    Q.7:What is the fee structure for search?
    Ans:
    1:For search by cts/survey/gat/plot/flat etc. fee is((Count of years)*25, minimum Rs 300/-.).

    2:For search by document number fee is Rs.25.

    3:For download document fee is Rs.100.

    Q.8:How to make payment for search?
    Ans:Please follow the below steps:

    1:After successful login click on make new payment button

    2:Enter the amount. 3:Click on confirm button and then submit button

    4:Government Payment Portal(GRAS) will apear

    5:Select your bank and click on proceed for payment

    6:GRN (Govt. Receipt Number) will be generated then click on ok button

    7: enter your Bank Login ID and Password

    8.After online payment you will be redirected to eSearch login page

    9.After login click on getgrn link to get GRN and bank CIN.

    10: Click on view challan to generate challan(you can only view challan when GRN and bank CIN both are present.

    11: In case bank CIN is not present click on verify transaction and then update CIN even if cin is not present then payment from bank may be under process.

    Note:
    1.Payment will be accepted only if done through eSearch only.

    2.Amount of two challans will not be clubbed together for availing eSearch services

    Did you know: how to obtain a true or certified copy of property title deed

    If you lose the original, lodge a First Information Report (FIR) at your local police station about the missing document

    Aproperty title deed is the legal document that specifies the rights of a person on a particular property. It is an important document for executing the transfer or sale of a property. However, if you lose or misplace the property title deed, or it is damaged, you can obtain a true or certified copy from the registrar. A certified copy can be used in place of the original deed to execute the transfer or sale or for any other purpose. Here is how to get a certified property title.

    File a complaint

    If you lose the original, lodge a First Information Report (FIR) at your local police station about the missing document. Include details such as: document registration number and owner’s details. Collect a copy of the FIR; make sure that the complaint number is properly mentioned, along with signature and stamp of the police department. After investigating the case, if police is unable to trace the missing documents, it will issue a non-traceable certificate.

    Besides filing a police complaint, you also need to place advertisements in two newspapers (one in a local language newspaper and another in an English paper) stating the loss of documents and inviting any claim over the property within a specified time period—usually 30 days. After 30 days, if no claims are received, consult a lawyer and get a letter issued to that effect.

    Once you have all these documents, the next step is to prepare an affidavit. It should state that the documents are lost and that this is a declaration that the contents of the affidavit are true.

    The affidavit should also contain proper details of the property, FIR number and details of the newspaper advertisements. Though you can get the format of the affidavit from the registrar’s website, or somewhere else, it is advisable to take the help of a legal expert or a notary to prepare the affidavit.


    Applying for the certified copy

    Visit the sub-registrar’s office where the property was registered. It also helps to have supporting documents that show ownership, such as utility bills. Apply for a copy and pay the charges, which vary across states. It usually take a few days to process the request. After that you can obtain a certified copy of the document from the registrar’s office.

    It can be used for various purposes as substitute for the original title deed.
