    jia: what is your situation ? have you signed the registration or planning to do that & later fight against them ?

    sunny: I agree, we can fight legally with a lawyer leading the fight for the excess amount charged, also want phase 1 to be completed by Dec 2012 or Mar 2013.

      I haven't signed the agreement nor did the registration yet.... hoping that someone will come up with a master plan to nail IB and their unfair ways... I would support any action against them...

        As a first principle, anyone who wants to differ with IB should not sign agreement or get it registered. One signed it is acceptance of all changes and excess charges. Second, there is a clear case of violation of sale terms as announced by IB in 2009-10 and at present. Hence, our case will stand in the court of law. Those overseas may like to give PoA to their relatives while those in India shud get together immediately by agreeing on a meeting place and discussing the matter face-to-face. IB is a business house which would like to maximise gains any which way, hence we need to take concerted action.

          THe only option is to go through the consumer court, Have got an contract through which we can nail them however there doesnt seem enough support in for the same.

            This all efforts shall go waste as we all have signed the registration form where the have kept all conditions in their favour which includes flat area calculation, layouts , etc etc..

            One can fight but it could turn out waste of time as the have upper hand

              My point is very basic:
              If someone cheats you, do you sit and watch or do you complain.
              In all cases you should go to consumer court.
              As regards, you would win or lose, lets not jump to conclusions.
              The court has a human judge (no robot).
              Worst case, atleast you can expect the court to ask for a technical justification of the loading (50%) in their project and I am sure Indiabulls cannot provide it.
              So be convinced that the tide is in your favor.
              Baner2010 is right that signing will help Indiabull's case but even those who have signed, do not lose hope, as if you are cheated, the law should still help you.
              Hence, whether of not you have signed, group together through the email and plan the next course of action.

                HI ,this things are going to happen since there is no market regulator.the carpet area for 1246sft -2bhk house is only 737sft which is astonishingly more than 65%. about 140sft extra they are promising in flower bed areas ,which i think will not be usable.no one knows how they have calculated the super builtup areas.

                all the builders in mumbai work with more than 100%profit. last 2/3 years the construction cost has almost doubled. labour is not easily available in mumbai .land cost has gone up. this money they are definetely going to recover from us.

                if they start charging rs 8000/- for panvel ,no one is going to buy from them .so better increase the super built up areas, charge exhorbitantly for car park, clubhouse,plc etc etc.

                r.c.c slabs takes approximately the same time as it takes to do finishing item such as plumbing, tiling ,electrical etc. by the time they complete the r.c.c works say about 9months to a year ,they would have taken 90%payment from us and then they would earn interest on the said money for the balance period of 2 years till the time they loose interest in the project and move somewhere else.

                soln -wait for price to go up, cut your profits and sell

                  This is not the comparative loading. Most builders have 33% to 37% loading.
                  The way this 33-37 is calculated is (super built up - carpet)/(super built up)
                  So in IB case it is 1246-737/1246 = 40.85%.
                  If you include flower bed, etc in carpet area, it becomes 1246-877/1246= 30%

                  Somoene who has time could look into the details and confirm what the actual loading is and compare it to current market trend.

                  For this, one needs to do the following:
                  1. Inquire with other builders about their carpet/super-built up areas for 2BHK
                  2. Ask the builder if balconies, flower beds, etc are included in carpet area. Bhushan was told by IB that walls will have wadrobes and IB had mentioned in our group meeting that walls are thinner (due to NASA technology ), but I donno how much truth is there in these assertions.
                  Builders to consider: 1. Kalpatru, Nexzone, Hirco, etc. One can also include some oberoi/raheja projects in proper mumbai.

                    I believe that the International Airport may complete construction sometime in future. Its a nice place to invest in..check out on internet for some really good opportunities....thanks
