Farmers move court against UP govt

Greater Noida : Encouraged by the Allahabad High Court's intervention
related to forceful acquisition of agricultural lands, hundreds of
farmers from Patwadi, Bisrakh, Khairpur villages comprising the so
called 'Noida Extension' area and neighbouring ones such as Milak
Lacchi, Jalalpur, Vaidpura and Sadullapur have approached the court to
seek reversal of acquisitions in their areas.

The lands of Patwadi, Bisrakh and Khairpur villages were reportedly
acquired by the Mayawati government in 2009 after revoking Section 5A
of the Land Acquisition Act 1894. Local farmers' leader and lawyer on
land issues, Satya Pal Chaudhary on whose PIL, the HC had passed the
Sahberi order, said, "Apart from the farmers who are approaching the
HC now, the writs of many farmers are in the final stages of disposal
and orders are likely to come within 2- 3 days." The farmers committee
also said it would file an application in the Noida court under
Section 156( 3) of CrPC seeking directions to lodge a criminal case of
murder, attempt to murder, loot, kidnapping, rioting and assaulting
women against the officials responsible for the Bhatta-Parsol
bloodshed.

The SC order had stated that a builder could not pre-launch its
property unless it has paid the complete amount of the land to the
government or is in possession of the registry. In the case of Noida
Extension, the Greater Noida authority has given the land to private
builders in easy installments of 10 years and had sold off the land at
nearly 10 times the cost paid to the farmers, they said.

Farmers are also likely to seek relief from the HC on the basis of a
Supreme Court order passed on March 7 that cancelled the acquisition
of their agricultural lands on emergency pretexts for construction of
a district jail in Shahjahanpur district in UP. HC lawyer and legal
activist Amit Khemka said, "By applying emergency clauses, these
authorities are misusing the provisions of ther act and are making a
mockery of the law.This act is anti-farmer, anti-people and anti-human
rights. The government, instead of providing welfare, has become a
land-holder and property dealer. Public interest has taken a back

  • Yes high level meeting going on with BMW and they will announce new compensation deal next week. Govt need to sort out this if they want to avoid any further damage. Hope for the best.Already BMW removed Noida ADG & transfered ACP.

  • if BMW resolves all the issues with farmers...n doesn't let other issues to emerge...things may get smoother...but extinguishing fire doesn't completely make the smoke to vanish completely.

  • This may not impact RPS/BHS scheme.

    Farmers demand was more “Money” . Authority has taken land 850/sqm and sold to builder 10K/sqm… Before this land acquired process, authority had marked all area (sector 1,4) for industrial purpose but after taking possession from farmers.. authority has changed master plan and sold to builders.

    Sector 2/3 are already shown as residential purpose in G.Noida master plan 2011, 2021 and 2031.. so no impact to sector 2/3 schemes… also.. Authority has given 17.5% + farmers quota in these plots… so farmers will not create any fuss.

    Somehow.. this situation of (Noida ext & Yamuna expressway) would generate more investors for Raj Nager ext/crossing republic/Noida sectors…. Investor are now afraid of putting money in Noida ext/yamuna expressway plots due to current situation… We all are know that “OVERSUPPLY” word is used for Noida/G.noida but “oversupply” was because of 80% projects were started in these two locations…. Now due to current panic situation… investor would only buy GOVT plot/flat/buildup house in Noida ext .

    So BHS/RPS premium may be high due to safe investment.

    I hope you mean sector 16-B and not sector 168 (one sixty eight)?
    I have a booking in zing i.e. Sector 168 this is why getting little extra cautious.

  • Advan city IT SEZ is in trouble then. It is suppose to be in Tech Zone - IV, but company claims to have got the land back in 2005, which I think is not possible.

  • Sector 1 is also shown as residential zone in G.Noida master plan 2011-21 in 2009 and 2010 on G.Noida authoritie's website.
    In 2010, G.Noida authority made changes in the purpose of land use in other sector near Sahberi village. Images of master plan 2011-21 is attached.
