    These people see that there is project launched in the broad daylight in fron of authority's own eyes and land which is there for everyone to see, so it must be correct. The only situation which these buyers prepare for is that there may be a delay in the construction and sooner or later we will get the flat and they get satisfied once the bank provides the loan. That's the best they can do. Atleast that's what I did(In Noida sectors).

    Now if you say that these common working class should go about on verifying all documents on how the land was purchased for farmers, you must be kidding yourself, that does not happen. Mind you this scenario is new for end users, they don't go about fighting property disputes in their daily lives. And therefore I would not squarly blame them for the legal mess. For me they are largely innocent home aspirants.
    However with the proceedings people will become more careful now and may go to larger extents to verify their purchase.


    Agree with EMI babu, here GNIDA is the one who is to be blamed who has been practicing a fraudulent policy of land acquisition. How can an end user be expected to uncover the fraud of GNIDA. If a government authority is committing fraud then there not much which can be done about it.
    There shall be hardly any user who would have known about section 17A of land acquisition before this agitation. Nobody in his wildest dream would have thought about this scenario. After all this even sarkari plots will also not be considered safe by investors, kya pata kaun sa section laga ke acquire kiya hai...

    All this is turn of events be it for CR or NE investors and they cannot do much about it.

    अब बिसरख की जमीन अधिग्रहण पर भी कोर्ट का स्टे

    नोएडा एक्सटेंशन में हाई कोर्ट का हथौड़ा दूसरे दिन भी चला। मंगलवार को हाई कोर्ट ने बिसरख गांव की करीब 30 हेक्टेयर जमीन के अधिग्रहण पर स्टे लगा दिया। अधिग्रहण की कार्रवाई के विरोध में बिसरख गांव के 22 किसान हाई कोर्ट चले गए थे। कोर्ट ने अर्जेंसी और लैंड यूज के आधार पर मामले में स्टे लगाया है। इससे नोएडा एक्सटेंशन एरिया के बिल्डरों व ग्रेटर नोएडा अथॉरिटी के अफसरों में हडकंप मचा है।

    किसानों के वकील एडवोकेट प्रमेंद भाटी ने बताया कि इस जमीन के अधिग्रहण के लिए शासन ने मार्च 2008 में धारा-4 की कार्रवाई की थी। उसके बाद किसानों को नहीं सुना गया। किसानों को सुनने वाली धारा-5 के बजाय सीधे धारा-17 कर दी गई। अर्जेंसी में जमीन अधिग्रहण करने के लिए धारा-17 का यूज किया जाता है। किसानों का कहना है कि जमीन अधिग्रहण के लिए हुए नोटिफिकेशन में जमीन का यूज सुनियोजित औद्योगिक विकास के लिए बताया गया था। बाद में इसे अधिग्रहण कर बिल्डरों को दे दिया गया। इसी को आधार पर बना कर अधिग्रहण के खिलाफ बिसरख गांव के जीता सिंह, जयभगवान, ऐडवोकेट राजेश भाटी, ऐडवोकेट राजीव भाटी, प्रधान गजेंद्र, संतू यादव आदि 22 किसानों ने 26 फरवरी 2009 को हाई कोर्ट में रिट डाल दी।

    इस मामले में मंगलवार को इलाहाबाद हाई कोर्ट में सुनवाई हुई। हाई कोर्ट ने अधिग्रहण प्रक्रिया पर सवाल उठाते हुए अधिग्रहण पर स्टे लगा दिया है। स्टे से प्रभावित करीब 30 हेक्टेयर जमीन है। कोर्ट के आदेश से प्रभावित एरिया में सभी निर्माण कार्य बंद कर दिए जाएंगे। वहां न तो निर्माण हो सकेगा और न ही तोड़ा जा सकेगा।

    बिसरख के मामले में हाई कोर्ट के आदेश की जद में आधा दर्जन से अधिक बिल्डरों के प्रॉजेक्ट आ रहे हैं। इससे बिल्डरों व ग्रेटर नोएडा अथॉरिटी के अफसरों में हडकंप मच गया है। वहीं किसानों में जश्न का माहौल है। बिसरख गांव के किसानों ने कहा है कि यह उनकी जीत है। उनकी जमीन को जबरन अधिग्रहण किया गया था। अब ऐसा नहीं होगा। अन्य गांवों के किसान भी हाई कोर्ट जा रहे हैं। इससे पहले सोमवार को पतवाड़ी और गुलिस्तानपुर गांव की जमीन पर कोर्ट ने अधिग्रहण पर स्टे और रद्द करने के आदेश दिए थे।

    its only 30 Acres..so agar 3-4 project bhi hue to thoda thoda land jayega sabka......these villagers were tha people who hadn't accepted the compensation at that time and file a case in HC....all these are of 2008-09 cases......i guess most of the villagers has accepted the compensation and they do not right to file any case .......its only few person's in some villages......because sector 1 is quite big and complete land is not impacted means only handful of villagers had filled the case as a result of which the 30 Acres has been given back to villegers.....let's see who will gain n who will loose.....dono taraf aam aadmi hai ek taraf kisan dusuri taraf middle class common men.:o
