    Lucknow: Uttar Pradesh Chief Minister Mayawati has finally met farmers protesting for greater compensation for land and announced a new land acquisition policy which will come into effect from today.

    She though clarified that the new policy will not affect land acquisition in Bhatta-Parsaul.

    The chief minister said the private players will have to directly acquire the land and the government will only act as a facilitator.

    She further added that farmers will be given 16 per cent of developed land.

    Last month, farmers' agitation at Bhatta Parsaul in Greater Noida had turned ugly with four persons, including two farmers and as many cops losing their lives.

    Earlier, BSP supremo charged Congress party over fuelling the agitation in Uttar Pradesh when she said, "The Congress was only responsible for the demonstrations by the peasantry."

    "We will raise the issue in Parliament for bringing uniform land acquisition policy," Mayawati added while stating her strategy to resolve the land acquisition spat.

    The Allahabad High Court on May 30 cancelled the 170 hectare land acquisition in Gulistanpur in Greater Noida. Earlier 100 farmers approached the court seeking justice as the government "forcefully" grabbed the farm lands.

    The Mayawati government reportedly acquired the land for private real estate developers. The High Court also asked the state government to pay for any monetary loss to any farmer.

    However, the Supreme Court on the same day refused to entertain a petition seeking a CBI enquiry into the alleged excesses and violence unleashed by the Uttar Pradesh government on farmers protesting against "forcible" acquisition of land at Bhatta Parsaul.

    Assembly elections are due in Uttar Pradesh in 2012.

  • BMW is only talking about builders. What about industrialist who want to set up industry in UP. Will they also be required to part with the 16 percent of the industry/power plant they built to farmers. Or it is presumed that land is required only for builders.

    करीब तीन साल पहले जेल बनाने के लिए भूमि अधिग्रहण की सरकारी अधिसूचना निकलती है और उत्तर प्रदेश के शाहजहांपुर में देवशरण जैसे कई किसानों को भूमिहीन बना देती है। उसी साल ग्रेटर नोएडा में औद्योगिक विकास के लिए दनकौर तहसील के मकौड़ा गांव में भूमि अधिग्रहण की दूसरी अधिसूचना राधेश्याम का तीस साल पुराना मकान लील लेती है। कोई अपील-दलील नहीं, क्योंकि अधिग्रहण जनहित के लिए था और सरकार ने भूमि अधिग्रहण कानून केआपात अधिकार का इस्तेमाल किया था। ये मामले सुप्रीम कोर्ट पहुंचे। सबसे बड़ी अदालत ने अधिग्रहण निरस्त कर दिए और आपात उपबंध के संदर्भ में सरकार की मंशा पर सवाल उठाते हुए कहा कि संपत्ति के अधिकार को इस तरह नहीं छीना जा सकता। भूमि अधिग्रहण के कई मामले जनहित बनाम संपत्ति के निजी अधिकार की बहस में उलझे हैं। नया अधिग्रहण कानून बनाने में जुटी सरकार के लिए अदालतों का बदलता नजरिया खासा अहम है। शाहजहांपुर में जेल के लिए जमीन अधिग्रहण को रद करते हुए अदालत ने अधिग्रहण के 117 साल पुराने कानून पर भी टिप्पणियां कीं। अदालत ने कहा कि ब्रिटिश काल का यह कानून, संविधान लागू होने से पहले का है। इसमें राज्य सरकार को मिली शक्तियों से आम लोगों के संपत्ति अधिकार प्रभावित होते हैं। हालांकि संपत्ति का अधिकार अब मौलिक अधिकार नहीं है और यह राज्य की कृपा से ही मिलता है, लेकिन यह मानना पड़ेगा कि संपत्ति पर कुछ अधिकार दिए बगैर बाकी के अधिकार बेमानी (छलावा) हो जाते हैं। संविधान के अनुच्छेद 13 के मुताबिक, इसके लागू होने के पहले का कोई भी कानून मौलिक अधिकार के खिलाफ नहीं हो सकता। अदालत का यह फैसला इसी साल मार्च का है। यह अधिग्रहण को लेकर सरकार के आपात अधिकार पर कानूनी नजरिया बदलने का पुख्ता प्रमाण है। इसी वजह से सरकारें अधिग्रहण के बाद अदालतों में मुकदमे हार रही हैं। कुछ ताजा फैसलों का निष्कर्ष है कि अदालत आपात स्थिति में लोगों की आपत्तियां सुने बगैर अधिग्रहण के सरकार के अधिकार को तो मानती है, लेकिन यह कहती है कि आपात स्थिति जमीनी तौर पर दिखनी चाहिए। खासतौर पर औद्योगिक विकास के लिए आपात उपबंध के तहत जमीन अधिग्रहण पर अदालत काफी सख्त दिखी है। मकौड़ा गांव की जमीन सरकार ने इसी मकसद से अधिग्रहीत की थी, लेकिन कोर्ट ने कहा, यह अधिग्रहण वास्तव में निजी हितों के लिए है। अधिग्रहीत भूमि पर सरकार या उसकी कोई एजेंसी उद्योग नहीं लगाना चाहती, बल्कि निजी निवेश और क्षेत्र के लोगों के लिए रोजगार के अवसर बढ़ाना चाहती हैं। सुप्रीम कोर्ट ने अदालतों को निर्देश दिया है कि जनहित के नाम पर अधिग्रहण की बारीकी से जांच हो और अदालतें सामाजिक और आर्थिक न्याय के सिद्धांत का ध्यान रखें।

  • I am not an expert but here could be a possible scenario moving forward.

    1. Builders might cancel the affected towers citing high court orders and offer refunds.
    2. With revised policy; the psqft rates will increase across NE.
    3. Builders will relaunch the same projects towers at higher rates with same/new branding and maybe better fit and finish. Maybe they will sell these towers as ready to move.

  • Guys(users/investors) dont worry and panic as some vested interests are doing their level best to push their own interest.

    The situation is not as bad as it is being positioned. things will be worked out between govt-authority-builder-farmer.........enduser/investor needs to wait and watch and stay put.

    You could be right - however no one can ignore the present situation.

    The affected projects of Noida xxx will remain affected and more or less it has hurt the sentiment badly.

    I don't want to compare however if the situation pans out like the stock market crash of 2008 then many will never see their present price / project at the level they thought of.

    I seriously want this fiasco get settled and builders come out with more sensible pricing and projects.

    Till things are not delivered on the ground now I fear most of the endusers would like to stay out of that region because of their entire life's savings being at stake.

    simultaneously u never forget to shower praise n nehapur/gr faridabad at every opportunity

    we all know u are well experienced, kindly show restraint. Those who hv put their money in Noida etc are also people like u/me. Has anybody told u to remove your money from neharpur and put in noida or gzb or wherever because it is a sick place?

    Pl take this as an inoffensive post as usually tempers are high due to financial and biz pressures in life.:)
