Just saw the confirmed news on Zee TV that the Allahabad HC has STAYED ON CONSTRUCTION in Sector 1, Greater Noida (This is the Noida Extension Area). Many builders projects, including Supertech Eco Village 1 are under construction here. Thousands of buyers will be effected.

This has given way to a new dimension to the fight for land. I would rather say it is virtuyally a Doomsday for the NOIDA investors.
It is just a beginning, and many fresh Stay Orders will start pouring in. Investors should just keep away from Noida. NO NOIDA SECTORS (NEW, including 7.x and 100.x, gnida and YEA) ARE IMMUNE NOW! JUST KEEP AWAY FROM THEM.

IT IS MY ESTIMATE THAT IT WILL BE YEARS BEFORE THE SITUATION CAN BE RESOLVED. IT MAY TAKE EASILY 10-15 YEARS FOR THE LEGAL BATTLES TO END AND CONSTRUCTION COST WILL GO MANYFOLDS BY THEN - AND BUILDERS MAY NOT SUSTAIN THE PROJECTS FOR THAT LONG AT ANY COST.

For those people who have taken loan (for officially announced litigated properties UNDER STAY), the best will be to talk and start NEGOTIATING with the banks. For others, try to hold the further payments to the builder whose properties are in litigation and awaiting "DATES OF HEARING" (All dates of hearings are important now, because there are now much greater chances that with the hearing dates, HC will put stay order on construction on these properties).

    ठ्ठजागरण संवाददाता, ग्रेटर नोएडा नोएडा व ग्रेटर नोएडा में जमीन की दर एक बार फिर बढ़ने जा रही है। प्राधिकरण के बाद जिला प्रशासन सर्किल रेट बढ़ाने जा रहा है। नए सर्किल रेट 1 जुलाई से लागू होंगे। अधिकारिक सूत्रों के अनुसार 15 से 20 प्रतिशत तक दर बढ़ाई जा सकती है। इससे जमीन की रजिस्ट्री करना महंगा हो जाएगा। ग्रेटर नोएडा के सर्किल रेट 14 हजार से 17 हजार रुपए प्रति वर्ग मीटर तक और यमुना प्राधिकरण क्षेत्र का सर्किल रेट 55 सौ रुपये है। गांवों का सर्किल रेट अलग-अलग है। गत माह नोएडा, ग्रेटर नोएडा व यमुना एक्सप्रेस वे प्राधिकरण ने अपनी सभी तरह की संपत्तियों की दरों में 12.5 फीसदी की वृद्धि की थी। प्राधिकरण ने बढ़ी दरों को 1 अप्रैल से लागू किया था। अब प्रशासन सर्किल रेट (बाजार भाव) बढ़ाने पर गंभीरता से विचार कर रहा है। दरों पर चर्चा के लिए शनिवार को एडीएम वित्त एवं राजस्व शिवकांत द्विवेदी ने तीनों तहसीलों के एसडीएम, सब रजिस्ट्रार व एआइजी स्टांप के साथ बैठक की। इसमें सहमति बनी कि 1 जुलाई से दर बढ़ा दी जाए। इससे पहले प्रशासन गत वर्ष की दर व जिले के प्रत्येक गांव व सेक्टरों की बाजार दरों की समीक्षा करेगा। सब रजिस्ट्रारों को 15 जून तक इस पर रिपोर्ट देने के निर्देश दिए गए हैं। एडीएम ने बताया कि गत वर्ष कुछ ही स्थानों पर सर्किल रेट बढ़ाए गए थे। इस बार सभी जगह दरें बढ़ेंगी। प्राधिकरण ने अपनी संपत्तियों में साढ़े बारह प्रतिशत की बढ़ोतरी की है। प्रशासन दरों में इससे अधिक इजाफा करेगा। जिन सेक्टरों व गांवों में खरीद-फरोख्त अधिक हो रही है, वहां दरों में ज्यादा इजाफा करने पर विचार किया जा रहा है। किसानों को अर्जित भूमि की एवज में मिलने वाले सात प्रतिशत भूखंडों का सर्किल रेट ग्रेटर नोएडा में 9 हजार रुपये प्रति वर्ग मीटर है। आवंटन के छह माह के अंदर किसान भूखंड की रजिस्ट्री करा लेते हैं तो उन्हें आवंटन दर पर स्टांप शुल्क देना पड़ता है। इसके बाद बाजार दर (9 हजार) पर पांच प्रतिशत स्टांप शुल्क का प्रावधान है। 1 जुलाई से यह दर 11 हजार रुपये प्रति वर्ग मीटर हो सकती है।

  • Hi group, RTI has been filled by one of IREF member about 7x and 1xx sectors... hopefully we'll soon receive the details.. .as of now... i don't think so we need to worry.. as these land procurments been done long back i.e. much before NE... even no. of projects are very high... infact there are projects which are about to complete... and been supported by govt nationlized banks..

    Also request the fellow members not to spread information which is quite sensitive and without proper document proof.

    It may come too late or even too little. Government officials are masters in hiding critical things.

    Instead of venting our frustrations here, why not all of us write mails to CEO/ Chairman NA/GNA and demand details?

    The quashing of the “forced acquisition” of 156 hectares of land in Shahberi village has jeopardised 6,500 houses being built by key real estate players. Now, hundreds of farmers in the neighbouring village of Bisrakh, where more than a dozen builders have planned or launched their projects, have moved court, seeking quashing of land acquisition.

    Bisrakh has caused worries to the builders and the Greater Noida Authority as about 50,000 houses are planned in the village. In 2008, the Greater Noida Authority had acquired 608 hectares of land in Bisrakh.

    Farmer leader Manveer Bhati said, “In May, 21 farmers moved court. They sought quashing of 30 hectares of land. They have obtained a stay order. Early this month, 110 farmers had moved court, seeking the acquisition of 40 hectares of land. The petition will be heard on July 21. Even on Friday, 250 farmers left for Allahabad to file petitions in the high court.”





    The court is hearing the petitions separately. The petitioners say the land in these cases was acquired using the urgency clause of the Land Acquisition Act — something held illegal by the court and used as a ground to quash the land acquisition in Shahberi.





    The petitions also say the land use was changed to suit private builders. Unlike Shahberi, where 85% farmers had not accepted compensation, half of the 500 affected families had accepted compensation in Bisrakh.
    But they are ready to pay it back for their land. They say they were forced to accept compensation. The outcome of these cases will decide the fate of Noida Extension, where 2,000 acres of land has been acquired from farmers and allotted to builders for the construction of luxury houses.

    220 Petitions Filed By Noida Extn Farmers Slated To Come Up For Hearing This Week

    Noida: With the fate of thousands of dwelling units in the Noida Extension-Greater Noida area remaining uncertain,all parties affected by the dispute homebuyers,farmers,builders will be keenly watching the developments in Allahabad High Court this week,as 220 petitions filed by farmers against land acquisition are slated to come up for hearing.

    First up before the court are 50 petitions filed by groups of farmers from Patwari village that will be heard on Tuesday,July 19.Another group of 50 farmers from Rauja-Yakubpur will be heard on Wednesday.Thursday could be the busiest,with another 120 petitions of farmers from Bisrakh,Haibatpur,Ghanghola,Devla and Iteda villages lined up.

    Encouraged by Supreme Courts July 6 judgment that quashed acquisition in Sahberi village,these villages have moved court for similar relief.Some villages around Noida Extension-Greater Noida,such as Milak Lacchi,Jalalpur,Vaidpura and Sadullapur,have also approached the court to seek reversal of acquisition in their area.The petitions say land in these villages was acquired using the urgency clause of Land Acquisition Act,which was termed illegal by the court and used as a ground to quash land acquisition in Sahberi.The petitions also say the land use was changed from industrial to residential,to suit private builders.
    Farmers lawyer Parmindra Bhati said,About 80% farmers of Bisrakh village have moved court in separate petitions.The court is hearing the matter separately.Farmers in some cases have obtained stay orders from the court. Meanwhile,farmers have begun an awareness drive in Noida Extension before their Maha-panchayat on Sunday to firm up plans to take cases of more villages to court.

    The farmers petitions have rattled the thousands of middle-income buyers in the Noida Extension-Greater Noida area who have so far been untouched by the Supreme Court order on Sahberi.Madhusudan,who has invested almost 40% of the Rs 21 lakh price for his flat in Supertechs Eco Village-II,said he is willing to wait-and-watch as the developer has promised that there will be no problem and the residential project will be completed as per schedule.But he remains uneasy.What will happen if more of the Noida Extension-Greater Noida area gets denotified Where will it leave us he wonders.
    Another buyer,Dileep Kumar,who has bought a flat in Amrapali Golf Homes,said,We dont know what the future holds.We are apprehensive that if the court decides in favour of the villagers,many of us will again be looking at options of relocation,refund and even losing our money.

    Most small time builders will just go bankrupt. It will be interesting to watch how Amrapali and Supertech behave.

    Disgruntled farmers have filed a petition in the Allahabad high court demanding a Central Bureau of Investigation (CBI) inquiry into the allotment of plots in Noida Extension to private builders.
    They alleged that officials took bribe from builders and changed the land use from industrial to residential.
    At a meeting held on Saturday, farmer leader Inder Nagar said, “We have filed a petition in the Allahabad high court seeking a CBI inquiry into the allotment of plots to builders.
    Hearing on the petition is scheduled for Tuesday.“
    “In 2007, the Greater Noida Authority allotted 60% of the acquired land in Noida Extension to private builders though it was acquired for industrial purpose. Officials took huge bribe and converted the land to residential,“ said Nagar.
    The Bharatiya Janata Party has supported farmers' demand of the CBI inquiry. “It is a scam of crore of rupees. If properly investigated, it will expose the nexus between builders and authority,“ said Nawab Singh Nagar, former MLA.
    Authority officials, however, denied the allegations and claimed their motive was solely development of the area and the conversion was done following proper procedure.
    Meanwhile, the Greater Noida police launched a manhunt to arrest the four absconding farmer leaders accused in Bhatta Parsaul clash in which two policemen and two farmers were killed on May 7.
    The main accused Manvir Singh Tevatia was arrested in the Capital recently.
    The court has rejected his bail application few days ago.
    The police is also planning to register a case against those who provided shelter to Tevatia.

    Authority officials in court had claimed that the shifting was done so that industries should not be located near residential localities such as crossing republic. By the same logic FLEX INDUSTRIES which is the biggest industry in Noida/G Noida should not have been located near sector-62/63 which is the most densely populated area in Noida.
