Land row: Mayawati announces new land acquisition policy

Uttar Pradesh Chief Minister Mayawati has finally met farmers protesting for greater compensation for land and announced a new land acquisition policy which will come into effect from today.

She though clarified that the new policy will not affect land acquisition in Bhatta-Parsaul.

The chief minister said the private players will have to directly acquire the land and the government will only act as a facilitator.

She further added that farmers will be given 16 per cent of developed land.

Last month, farmers' agitation at Bhatta Parsaul in Greater Noida had turned ugly with four persons, including two farmers and as many cops losing their lives.

Earlier, BSP supremo charged Congress party over fuelling the agitation in Uttar Pradesh when she said, "The Congress was only responsible for the demonstrations by the peasantry."

"We will raise the issue in Parliament for bringing uniform land acquisition policy," Mayawati added while stating her strategy to resolve the land acquisition spat.

The Allahabad High Court on May 30 cancelled the 170 hectare land acquisition in Gulistanpur in Greater Noida. Earlier 100 farmers approached the court seeking justice as the government "forcefully" grabbed the farm lands.

The Mayawati government reportedly acquired the land for private real estate developers. The High Court also asked the state government to pay for any monetary loss to any farmer.

However, the Supreme Court on the same day refused to entertain a petition seeking a CBI enquiry into the alleged excesses and violence unleashed by the Uttar Pradesh government on farmers protesting against "forcible" acquisition of land at Bhatta Parsaul.

Assembly elections are due in Uttar Pradesh in 2012.

  • New Land Acquisition Policy Will Make Homes Dearer In State

    Uttar Pradesh's new land acquisition policy will make homes dearer as this will push up the land acquisition costs for real estate developers. Besides the cost of land, farmers will get 16 per cent of the total land acquired after development.

    ``The cost of this will get loaded on the remaining area the developer sells,'' said R K Arora, CMD, Supertech Ltd, a Noida-based developer. If a developer buys 500 acres, he has to leave 50 per cent of the land for roads, sewerage and greens, while seven per cent is for resettlement and rehabilitation cost, and then return 16 per cent of the developed land.
    Developers feel the cost of all this will get loaded on the remaining saleable area, which will increase prices of finished homes. Arora is also worried that if developers buy land directly, infrastructure development could suffer like it did in Gurgaon.
    ``How will infrastructure development happen? If the developer buys 1,000 acres directly from farmers, there's no focus on infrastructure development like in Gurgaon. Who will develop the roads, the sewerage, and provide power,'' Arora wondered. A bigger challenge will be to get consent of 70 per cent farmers for land acquisition, says Getamber Anand, CMD, ATS Greens, a Noida-based developer. ``Getting 70 per cent consent will be a big challenge as few farmers can hold you to ransom,'' he said.
    Anand feels it will be better if an industrial authority or a government agency acquires land as per a master plan, and then auction the same to developers at market prices.

    Developers are still waiting for the fine print to understand the implications, but they feel that industrial authorities in Noida and Greater Noida will continue to acquire land and developers will not need to acquire land directly from farmers in these areas.
    UP's new land acquisition policy could also be the basis for settlement with farmers in several villages of Noida Extension, where the Allahabad High Court had cancelled land acquisitions. After a settlement with farmers, the Greater Noida Authority is likely to file a special leave petition in the Supreme Court to stay the HC judgement. Shakti Nath, chairman of Logix Group, welcomed the new land acquisition policy as it would facilitate land acquisition and address issues of delays associated with it.

    This is how I look into this issue.

    Is there any problem in NE? ..... absolutely, no doubt about that.

    How big is the problem? .... no one knows, atleast no experts here

    Is my project safe? ..... NO, wait until you get delivery of your project. Any area, any project can be included in litigation, just keep your finger crossed.

    How long will it take to resolve? ... no one knows but most likely will be dragged until the election and probably after the election too if there is no clear mandate.

    Will there be a solution? .... Oh YES, all the issues originated due to MONEY... and a HUGE MONEY at stake. No big shot is going to loose money in their business.

    Then why there are so many panic news in this forum?

    There are three types of people creating this unnecessary panics

    a. The JOKER type, who want to just have FUN
    b. The FRUSTRATED type, who failed to buy earlier
    c. The Cleaver INVESTOR type, who want to make a killing in distress

  • noida extension shant ho jaye bahut log maze le rahe hai. bhai har koi big shot nahi hota 20-25 lakh arrange karne me halat kharab ho jati hai phir agar koi home sweet home ka sapna dekh kar paisa dalta hai to uska paisa nahi phase. god bless all.:)

    ठ्ठ जागरण संवाददाता, ग्रेटर नोएडा मुख्यमंत्री मायावती द्वारा गुरुवार को घोषित नई भूमि अधिग्रहण नीति उन सात औद्योगिक विकास प्राधिकरण में लागू नहीं होगी, जहां शहर विकसित करने का मास्टर प्लान तैयार कर लिया गया है। इससे साफ है कि नोएडा, ग्रेटर नोएडा व यमुना औद्योगिक विकास प्राधिकरण में यह नीति लागू नहीं होगी। हालांकि इसके तहत आपसी सहमति के आधार पर बिल्डर अब सीधे किसानों से 70 फीसदी जमीन खरीद सकेंगे। नई नीति के अनुसार, मास्टर प्लान की सीमा के अंदर प्राधिकरण ही किसानों की जमीन का अधिग्रहण करेगा। हालांकि किसानों को सीधे जमीन बेचने को छोड़कर अन्य सभी लाभ मिलेंगे। पूरे प्रदेश में ऐसे 7 प्राधिकरण हैं, जहां पर बिल्डर सीधे किसानों से जमीन नहीं खरीद सकेंगे। नोएडा, ग्रेटर नोएडा व यमुना एक्सप्रेस-वे औद्योगिक विकास प्राधिकरण ने पहले ही जमीन अधिग्रहण की अधिसूचना जारी कर शहर के विकास का मास्टर प्लान तैयार कर लिया है इसलिए यहां पर निजी कंपनियां बिल्डरों से सीधे जमीन नहीं खरीद सकेंगी। प्राधिकरण ही जमीन अधिग्रहण के बाद कंपनियों को आवंटित करेगा। नोएडा, ग्रेटर नोएडा व यमुना औद्योगिक विकास प्राधिकरण समेत सात प्राधिकरण इस श्रेणी में आ रहे हैं। नई जमीन अधिग्रहण की अन्य नीतियां इन सातों प्राधिकरण क्षेत्र में लागू होंगी। नई नीति के तहत जमीन अधिग्रहण का 16 फीसदी हिस्सा प्राधिकरण विकसित कर किसानों को वापस करेगा। इस नियम का लाभ गैरपुश्तैनी किसानों को भी मिलेगा। इसके तहत यदि कोई बाहरी व्यक्ति नोएडा, ग्रेटर नोएडा व यमुना एक्सप्रेस-वे प्राधिकरण की सीमा में जमीन खरीदता है, बाद में उसकी जमीन को प्राधिकरण अधिग्रहीत कर लेता है तो उसे भी विकसित भूमि में 16 फीसदी भूखंड मिलेगा।

    I have invested my hard earned money in Noida Ex and going through this site for very long to know the updates on this hot issue.

    Surprisingly i have not seen anyone asking / discussing for probe against main architect of this issue. Not even any media person or any public society/forum who has raised this question that why mango men suffer all this due to cheating of handful persons who have got power.

    We all are discussing that farmers are wrong, investor should have been extra cautious but not discussing that why this all happened.

    Ideally media persons who are running behind hot news (rubbish) must have nabbed this nexus, we all writing so much on this forum should have taken a drive to submit quote against this. Some one may say that writing or raising voice will hardly make any difference but to all respected readers of this would like to say that we should at least raise our voice. We should not become immune so much that powerful persons can do any thing and we become puppets of them.
    I am a small investor could not get any place so cheap where i could ever think to own a shelter (home). (Some one may say that it was my greed to invest for such cheap property than would like to say that yes i am greedy but does it mean that government bodies will take advantage of this.)

    दनकौर, संस : प्रदेश सरकार द्वारा घोषित की गई जमीन अधिग्रहण की नई नीति पर किसानों ने मिलीजुली प्रतिक्रिया व्यक्त की है। अधिकांश किसान नई नीति से खुश नजर नहीं आ रहे है। किसानों का कहना है कि नई नीति का लाभ उन गांवों को मिलेगा, जिनकी जमीन भविष्य में अधिगृहीत होनी है। भट्टा पारसौल गांव के किसानों की जमीन गत वर्ष अधिगृहीत हुई थी, इसलिए योजना का लाभ यहां गांव के किसानों को नहीं मिलेगा।
    बुंदू खां का कहना है कि घर के चार सदस्य जेल में हैं। परिवार के अधिकतर सदस्य मजदूरी करते हैं। हमें नई नीति नहीं, बल्कि दर्ज मुकदमे वापस होने चाहिए। कृष्ण कुमार का कहना है कि गांव की पंचायत में निर्णय लेकर यहां से पलायन करेंगे। मुकदमे वापस नहीं हुए तो वार्ता का कोई लाभ नहीं। कृष्णा का कहना है कि घटना वाले दिन उनके घर से नकदी लूट ली गई थी। जिंदा रहने के लिए यहां से भागना पड़ेगा। नरेंद्र का कहना है कि उसका बेटा जेल में हैं। जेल से रिहा नहीं हुए तो परिवार के सदस्य गांव से पलायन व अनशन करेंगे। अनिल का कहना है कि सरकार की घोषणा से भरोसा उठ रहा है। आज तक मुकदमे वापस नहीं हुए। निर्दोष ग्रामीणों को क्यों फंसाया गया। ओमप्रकाश शर्मा का कहना है कि शासन व प्रशासन से कोई मदद नहीं मिली। संग्राम सिंह, मांगेराम, रोशन खां, मनवीर, ब्रजपाल सिंह, वीरपाल सिंह का कहना है कि प्रदेश सरकार की नई नीति से गांव को किसी प्रकार का लाभ नहीं हुआ। पहले किसानों से मुकदमे वापस लिए जाएं।
