*नई दिल्ली। *सुप्रीम कोर्ट ने आज नोएडा एक्सटेंशन जमीन अधिग्रहण मामले में कहा
कि नोएडा एक्सटेंशन को दूसरा नंदीग्राम नहीं बनने दिया जाएगा। कोर्ट ने अपनी
टिप्पणी में कहा कि सरकार को जमीन अधिग्रहण को लेकर अपनी मानसिकता बदलनी होगी।

सुप्रीम कोर्ट ने उत्तर प्रदेश सरकार से पूछा कि खेती की जमीन अधिग्रहण करने से
पहले क्या इस बात की कोशिश की गई कि बंजर जमीन का अधिग्रहण पहले किया जाए। इस
दौरान कोर्ट में सरकार और किसानों के तरफ के पक्ष कोर्ट में मौजूद थे। सुप्रीम
कोर्ट ने इस मामले की जल्द सुनवाई करने से इंकार करते हुए कहा कि इसकी सुनवाई 5

  • Where on the earth Supreme Court judges are staying.. don't they see that these things are happening eveywhere in India.. either farmers are selling their lands by their own or either govt is acquiring from them and giving them good compensation....If SC is so concerned then why don't they make a law that farmers will not sell their land ever and will do the farming only... and it will be the govt's responsibility to provide housing to each and every person\professional who is working in cities....guys people
    like us who have left their hometowns and have come to cities to work and generate revenue for govt does not have any right to dream of their home.. if SC is so concerned then why dont' they sack fgive punishment to those govt officers who acquired the land.. they must have made lot of money and will go scot free... there is a very simple solution to all this that govt should pay handsome compensation to farmers and matter is solved.. why they are making it so complicated....

    The only difference why Govt. machinery/political parties etc. are inclined towards Farmers & not towards us because they see them as a collective Unity, a collective vote bank while they see us as a dispersed group of investors who do not represnt any vote Bank. So we as investor are not of any help to the Political Parties while the same is not the case with Farmers. That's why rahul Gandhi is Roaming like mads in G Noida Villages....

    what do you mean by good compensation? if your house has a market value of 1 crore, and govt acquires it paying you 25 lakh, will you call it good compensation? Did govt give the land to the farmers for free? it is THEIR asset. it should be their wish, whether to sell it or not, and at what rate to sell. Isn't that the way a capitalistic economy works?

    how if such law is made for you us also, never sell you flat - use it only for self stay?

    Agree with this. We should never forget that farmers work several times harder than us and we get several times more money than them.

    The situation we currently are in is not the direct consequence of a single person's ill deeds....BUT is rather the effect of many decades of unjust governance....you should understand this .....

    Put yourself in the position of land looser and you will understand the pains of loosing something precious as a land for a kisan.

    Just imagine for a minute that Govt. forcibly takes away our flats, how would we react?

    If buyers feel that they have a strong POV on the subject, let them join and file a writ petition in SC and to impled as a Party to the litigation. I am sure SC will happily allow that...No point in criticising Govt, SC, lawyers, builders and all sitting here...

    In a major blow to the Mayawati government in Uttar Pradesh, the Supreme Court on Tuesday slammed the land acquisition policy and called it "anti-people" and a "sinister campaign" by the state.

    The scathing observations by the apex court come as it heard the UP government's appeal against the Allahabad High Court's order stopping acquisition of agricultural land. The hearing will continue on Wednesday in the SC.

    Calling the Land Acquisition Act "an engine of oppression", the apex court observed that the state was driving out the poor.

    The Greater Noida Industrial Development Authority, UP government and builders Supertech and Amrapali, had challenged a recent Allahabad High Court decision quashing acquisition of agricultural land by the state.

    The SC observed that UP government could have negotiated with people and given enough compensation. If they had done so, people would not have gone to court, the apex court said.

    The SC asked, "What is the option to a common man if his land is acquired? Take the money or come in litigation and that is not an easy option. When people protest against acquisition, men are arrested and women are raped. They lose their livelihood and then have to pay lawyers to fight their cases."

    The SC observed that the state was acquiring land for multiplexes in the name of development, adding, the owners were getting pittance.

    "In the name of development what are you doing? You are acquiring land for multiplexes, malls etc that are beyond the common man. The state should protect common man's right, but it's the other way around. We can understand if the state is building canal, barrage etc, but you are building malls, hotels, commercial townships. You are saying this is residential area. Residential areas for whom? Are those whose land was taken away not needy? You think judges are living in a fool's paradise," the court observed.

    "The state is driving out poor people. This is a sinister campaign by many state governments. It is anti-people," it said, adding, "Land owners are getting pittance of the market value. Development for public purpose must be well defined. This is becoming a land-grabbing state."

    Cong welcomes SC verdict

    Welcoming the verdict, Congress general secretary Digvijay Singh said, "We are grateful to the honorable Supreme Court for making a decision in the Noida Extension land acquisition case."

    The Congress leader's comments came amid party leader Rahul Gandhi's visit to Bhatta Parsaul and adjoining areas in Greater Noida, which was hit by the recent stir over land acquisition early.

    His visit was seen as yet another challenge to Mayawati as the state government had denied the young MP permission for a farmers' maha panchayat in the adjoining Aligarh district, which is also facing similar resentment over forced land acquisition, on July 9.

    This is his second visit to the area since the violent clashes between the farmers and the police in May. During his last visit, Gandhi was even arrested for violating prohibitory orders clamped by the district administration. He had the accused the UP police of carrying out atrocities on the villagers.

    FYI...

    The farmers are not doodh ke dhule...
    if the govt had not taken the land then they would have sold the land to pvt builders...and they wouldn't hve got awesome money for their land...

    if the farmer really loves his land then he should continue farming...y does he wanna sell it...??

    they sell their land to buy SUVs and roam around like gundas...

    this is what a cab driver told me...who actually has a land in NE..."sir hume to bahut paisa already mil chuka hai...humne socha laao behti ganga mein hath dho le...shayad aur rs. mil jaayein"

    Another thing, if SC asks the govt to return the land to the farmers...then they also have to pay the compensation back to the authority...do u think they have the money with them...no..

    SC decision will create more problems for farmers...and some have actually started feeling the heat....

    सुप्रीम कोर्ट ने राज्य सरकार से पूछा है कि आखिर क्यों उसने जमीन अधिग्रहण कानून की उस धारा का इस्तेमाल किया, जिसके तहत बिना कोई कारण बताए वह किसानों से जमीन अधिग्रहीत कर सकती है। इस पर यूपी सरकार ने कहा कि जमीन को कालाबाजारियों के हाथों से बचाने के लिए ऐसा किया गया। लेकिन अदालत इस पर संतुष्ट नहीं दिखी। सुप्रीम कोर्ट ने कड़े लहजे में कहा कि गांव के गांव उजाड़े जा रहे हैं, पुरुषों को गिरफ्तार किया जाता है और महिलाओं के साथ रेप होता है। कोर्ट ने यूपी सरकार पर यह भी आरोप लगाया कि किसानों के खिलाफ सरकार खतरनाक अभियान चला रही है, जिसका विरोध करने पर उन्हें लाठियां मिलती हैं। कोर्ट ने कहा कि सरकार किसानों की आने वाली पांच पुश्तों की रोजी रोटी छीनने का काम कर रही है।

    बुधवार को फिर इस मामले में सुनवाई होगी।
