  • Realtors knock famers’ doors to salvage non-Shahberi projects


    With more and more villages moving court seeking quashing of land acquisition, the confederation of real estate developers’ association of India (CREDAI) has got down to saving their non-Shahberi projects in Noida Extension from hanging in the balance too. CREDAI vice-president (NCR) Anil Sharma said, “We’re approaching farmers and asking them to relent. We have also spoken to banks asking them not to stop lending in Noida Extension projects, which are not affected by any court order.” Sharma said that CREDAI would set up a legal cell, which apart from resolving the refund issue, would also conduct due diligence before participating in any land auction in future.



    CREDAI has hired a firm to look after the situation arising out of the recent court judgment and land transactions among farmers, Greater Noida Authority and builders in Noida Extension. It will look after all projects planned in Noida Extension.

    Asked whether homebuyers were being refused loans for non-Shahberi projects too, Supertech chairman RK Arora said banks were ready to disburse loans if the Greater Noida Authority could give them an assurance that the land acquisition was in order.

    He said builders had a meeting with leading home loan provider HDFC. “Banks have said no to fund projects in Shahberi. But there is no major problem of funding as for projects elsewhere in Noida Extension. They want transparency and clearance of land title,” he said.

    Builders have said the authority will give them title clearance letters and they will forward the same to banks for continued funding to all Noida Extension projects. We have approached all nationalised banks regarding this and their response is positive. Authority officials will also meet banks in this regard.

    Developers will focus on not allowing any unauthorised colonies in Noida Extension. They have approached the authority for action against land grabbers and stop sale and purchase of land through illegal means.
    “We are also approaching farmers. They are not against development. We all know land acquisition is key to development. Farmers have some issues with the authority. They want their abadi land wrongly acquired by the authority to be leased back to them. They want developed land plots from the authority as part of rehabilitation benefits," said Sharma.
    There are 2.5 lakh units planned in Noida Extension. CREDAI has decided to ask the government to ensure there are no Shahberi-like cases in future.

    कंफेडरेशन ऑफ रियल एस्टेट डेवलपर्स असोसिएशन ऑफ इंडिया ( क्रेडाई ) की पश्चिमी यूपी की शाखा की मीटिंग में फैसला लिया गया कि शाहबेरी गांव में जमीन अधिग्रहण रद्द होने से जिन निवेशकों के घरों की बुकिंग फंस गई है उन्हें सुप्रीम कोर्ट के आदेश के मुताबिक ब्याज सहित पैसा लौटा दिया जाएगा। असोसिएशन ने कहा है कि जमीन अधिग्रहण रद्द होने और रकम लौटाने से बिल्डर्स को 600 से 700 करोड़ रुपये का नुकसान होगा। इसके बारे में संगठन ग्रेटर नोएडा अथॉरिटी से बात करेगा।

    बिल्डर्स की मीटिंग में यह भी फैसला लिया गया कि जो प्रॉजेक्ट्स सुप्रीम कोर्ट के फैसले से प्रभावित नहीं हुए हैं और उसमें बुकिंग कराने वाले निवेशक दहशत के कारण अगर अपनी बुकिंग कैंसल कराना चाहते हैं, तो उन्हें पूरी रकम वापस नहीं होगी। क्रेडाई का कहना है कि ऐसे निवेशकों को कॉन्ट्रैक्ट के मुताबिक पेनाल्टी वसूलने के बाद रकम वापस की जाएगी।

    गौरतलब है कि सुप्रीम कोर्ट द्वारा राज्य सरकार को भूमि को उनके मूल मालिकों को लौटाने के आदेश से करीब 6,000 खरीददार प्रभावित होंगे।

  • किसानों को मनाने में जुटे बिल्डर


    ग्रेटर नोएडा : अपनी साख बचाने के लिए बिल्डरों ने अब गांव में जाकर किसानों को मनाना शुरू कर दिया है। प्राधिकरण अधिकारी भी अपने स्तर से किसानों के साथ सहमति बनाने की कोशिश कर रहे हैं। अधिकारियों ने शुक्रवार को प्राधिकरण में किसानों के साथ बैठक की, वहीं बिल्डरों ने गांवों में जाकर किसान पंचायत लगाई। बिल्डरों ने पतवाड़ी गांव में प्रभावित किसानों के साथ अलग-अलग वार्ता की। हालांकि किसान अभी मुंह खोलने को तैयार नहीं है। उनका सिर्फ इतना कहना है कि जो भी निर्णय होगा, वह गांवों की सामूहिक पंचायत में होगा।

    नोएडा एक्सटेंशन में साबेरी, हैबतपुर, इटेड़ा, पतवाड़ी, रोजा याकूबपुर, छोटी मिलक, बिसरख व ऐमनाबाद आदि गांवों की भूमि है। साबेरी में सुप्रीम कोर्ट किसानों को जमीन वापस करने का आदेश दे चुका है। कोर्ट के इस निर्णय से अन्य गांवों के किसानों ने भी न्यायालय का रास्ता पकड़ लिया है। इससे प्राधिकरण व बिल्डरों की बैचेनी बढ़ गई है। साबेरी गांव के फैसले से सिर्फ सात बिल्डर प्रभावित हुए थे, अन्य गांवों में भी कोर्ट ने अधिग्रहण पर रोक लगा दी तो नोएडा एक्सटेंशन के सभी परियोजनाओं पर बुरा असर पड़ सकता है। प्राधिकरण व बिल्डर दोनों ही किसानों को मनाने में जुट गए हैं। बृहस्पतिवार को प्राधिकरण ने हैबतपुर व इटेड़ा गांव के किसानों के साथ बैठक कर सहमति बनाई थी। शुक्रवार को भी किसानों के साथ समझौता करने का प्रयास किया गया। बिल्डरों के प्रतिनिधियों ने पतवाड़ी गांव में पंचायत कर किसानों को भरोसा दिलाया कि उनकी मांगों को पूरा कराने के लिए वे भी प्राधिकरण से वार्ता करेंगे। किसान क्षेत्र के विकास में अपना योगदान दे, इससे सभी को लाभ मिलेगा। किसानों ने बिल्डरों के प्रतिनिधियों को अपनी मांगों से अवगत कराया। बताया जाता है कि किसान समझौते के मूड में हैं, लेकिन इससे पहले वे अपनी आबादी निस्तारण व मुआवजा वृद्धि की मांग को पूरा करना चाहते हैं। बिल्डरों की मुहिम कितना रंग लाएगी, यह किसानों के निर्णय पर निर्भर है। पतवाड़ी गांव के मान सिंह ने बताया कि बिना पंचायत के कोई निर्णय नहीं लिया जाएगा। जो भी फैसला होगा, वह किसान हित में होगा।

    ग्रेटर नोएडा : बादलपुर गांव के किसानों ने समस्या समाधान न होने पर न्यायालय में याचिका दायर करने की चेतावनी दी है। किसानों का आरोप है कि छह प्रतिशत भूखंड आवंटन में किसानों के साथ धोखा हुआ है। प्राधिकरण ने समझौते के समय अच्छी लोकेशन पर भूखंड देने का वादा किया था। अब खराब लोकेशन पर भूखंड दिए गए हैं। इससे किसानों में रोष है। किसान अपनी जमीन वापस लेने के लिए हाईकोर्ट का दरवाजा खटखटाएंगे।

  • Bisrakh holds key to Noida Extn fate


    The quashing of the “forced acquisition” of 156 hectares of land in Shahberi village has jeopardised 6,500 houses being built by key real estate players. Now, hundreds of farmers in the neighbouring village of Bisrakh, where more than a dozen builders have planned or launched
    their projects, have moved court, seeking quashing of land acquisition.
    Bisrakh has caused worries to the builders and the Greater Noida Authority as about 50,000 houses are planned in the village. In 2008, the Greater Noida Authority had acquired 608 hectares of land in Bisrakh.

    Farmer leader Manveer Bhati said, “In May, 21 farmers moved court. They sought quashing of 30 hectares of land. They have obtained a stay order. Early this month, 110 farmers had moved court, seeking the acquisition of 40 hectares of land. The petition will be heard on July 21. Even on Friday, 250 farmers left for Allahabad to file petitions in the high court.”

    The court is hearing the petitions separately. The petitioners say the land in these cases was acquired using the urgency clause of the Land Acquisition Act — something held illegal by the court and used as a ground to quash the land acquisition in Shahberi.

    The petitions also say the land use was changed to suit private builders. Unlike Shahberi, where 85% farmers had not accepted compensation, half of the 500 affected families had accepted compensation in Bisrakh.
    But they are ready to pay it back for their land. They say they were forced to accept compensation. The outcome of these cases will decide the fate of Noida Extension, where 2,000 acres of land has been acquired from farmers and allotted to builders for the construction of luxury houses.

    ग्रेटर नोएडा। भूमि अधिग्रहण के खिलाफ अब किसान जाग उठे हैं और प्राधिकरण के विरोध में न्यायालय की शरण में जा रहे हैं। न्यायालय ने अब चिपियाना बुजुर्ग गांव के तीन किसानों को राहत देते हुए जमीन पर यथा स्थिति रखने का आदेश दिया है। यह आदेश चार जुलाई को कोर्ट ने दिया है।
    पीड़ित किसानों के अधिवक्ता ओमवीर बैसोया ने बताया कि प्राधिकरण द्वारा चिपियाना बुजुर्ग गांव की अर्जेसी लगाते हुए धारा-४ का प्रकाशन कर दिया गया और किसानों को लगा कि अब प्राधिकरण उन्हें सुन नहीं रहा है। जिसके चलते किसान हाईकोर्ट की शरण में चले गए। अधिवक्ता ने बताया कि कोर्ट ने चिपियाना बुजुर्ग के किसान तेजवीर, स्वतंत्र सिंह और गजेंद्र सिंह को राहत देते हुए आदेश दिया है कि उनकी जमीन पर कोई भी प्राधिकरण अग्रिम आदेश तक कब्जा नहीं ले सकेगा। इसके अलावा उक्त जमीन पर यथा स्थिति का आदेश दे दिया गया है।

As far as i know abt the gaur project..land was acquired in 2002 by GNA (vill - Haibatpur, As confirmed by Gaur & GNA,), also kindly read the allabhad HC verdict, same has been mentioned cleary and handed over to Gaur in 2009. Land was acquired under Sec 6 not in Sec 17 ..it was clearly written in buyer's agreement. Nobody knows wht will happen in future but as of today Gaur is safe one. So please go in depth, everyone knowshalf knowledge very dangerous.

    Below is verbatim transcript of interview of Pankaj Bajaj, President of CREDAI NCR with CNBC-TV18’s Shereen Bhan on 20.07.2011.

    Q: Real estate developers are in a state of shock at this point in time but you have now decided to take legal recourse and the options for approaching both the Supreme Court and the Allahabad High Court?
    A: Legal recourse is one of recourses that we have. We are exploring every possibility to resolve the whole situation is right now.

    Q: What could be the other options?
    A: We could talk with the authorities for a settlement; we could seek some compensation from them. We could get them to allot alternate pieces of land. We could also get the authority to come to a negotiated settlement with the farmers.

    Q: Is the authority willing to even talk to you at this point in time?
    A: Of course! We are in constant touch with the authority and they realise that just like our buyers are in a soup, so are we as buyers, we are the authorities buyers and hence, we are in a soup too.

    Q: What option do you think is mot feasible and practical at this point in time given the state of affairs that the Greater Noida authority itself finds itself in and they are going to have trouble acquiring new tracks of land to give to the developers and that’s going to be a long process, isn’t it?
    A: What we have been told informally that the farmers are not really interested in taking back the land in as much as they want higher compensation. Because a lot is at stake for the authorities as well so they might go for a negotiated settlement with the farmers.

    Q: So will you then negotiate with the farmers yourself. Will the authority negotiate on your behalf and will you then workout a better compensation for the farmers?
    A: The charter of the two authorities Greater Noida and Noida bar the members from direct interface with the farmers, though we can have formal channels with the farmers. The actual formal interface would have to be between the authority and the farmers.

    Q: What is the legal opinion that you have got so far because you have got the Allahabad High Court order, you have got a Supreme Court order. What are lawyers telling you? What are experts telling you about where you stand currently?
    A: There is some element of surprise and in that third and fourth party interests have not been considered while giving this order. I am sure the honorable High Court has its reasons and we are yet to read the order but I don’t think the interest of the developers and the end customers have been adequately represented.

    Q: Would you approach both the Supreme Court as well as the Allahabad High Court?
    A: Yes.

    Q: What is at stake here because when Shaberi case happened the reports that we saw suggested that there were projects close to Rs 40000 crore that were stranded on account of this. Now this is another 608 hectares being done away with in that sense. What is the cost that we are talking about here?
    A: The numbers are little exaggerated. The total number of apartments which are likely to get affected in Noida Extension is between1 lakh to 1.5 lakh apartments. Typical apartment ticket size would be Rs 20 lakhs, so we are talking about Rs 20000-30000 crore in total and roughly half of that - orders are already been passed on.

    Q: After Shaberi happened, real estate developers came and said that we will either relocate customers or we will compensate them, refund their money with interest. Does that still stand? Because where do you relocate them is also a question, or even this has been done away with?
    A: I don’t think that’s looking feasible in the very short term.

    Q: Compensation or relocation?
    A: We had builders who had five projects in the area; one of them got affected as they could have shifted the allottees of the affected project in the other four. But if all five get affected where does he relocate them to. The other thing is the money that is collected from the customers and the whole business model depends on collecting money in advance from the customers and investing in the land and construction. That money has been invested; it’s not lying in the bank.

    Q: That’s very important because you can no longer assure buyers who had invested in these apartments of compensation or relocation?
    A: I am not saying that. I am saying that some kind of settlement would have to come with the authority. The solution to this problem now lies with the authority and the government. They would either have to give us alternate pieces of land or compensate us for the expenditure that we have done on behalf of the customers in constructing half of the buildings.

    Q: What are banks saying because you have got consumers who have taken EMIs, loans to actually pick up these flats, real estate developers themselves who have taken loans from banks? What are banks saying at this point of time. How worried are they?
    A: The banks are worried but also understand that construction had not progressed to a very advanced level in these projects. So the bank exposure is not to the extent that otherwise would have been in such projects.

    Q: So will there be a decision on moving both the High Court and the Supreme Court by tomorrow, in the next 24 hours?
    A: Yes.

    Q: Also the possibility of a negotiated settlement with the Greater Noida authority?
    A: Yes.

Except now, they can order to builders to refund with interest in direct form or else through GNA. Which is technically a long task. Solution of this problem could be only OUT OF COURT settlement. Builders and GNA rightnow trying to take advantage of innocent buyers by putting guns on their shoulders. Best Go to villages and contact some farmer leaders, Builders, GNA.. Arrange a meeting next SAT or SUN. Also inform farmer leaders that they should come with their DEMANDS. Meeting is more from buyers side but, we are also inviting Builders and GNOIDA Authority. Also Invite all Media person. Discuss issue OPENLY about their Demands. Once SC order is out nothing can be done because it will not be easy to deal with GNA and Builders. Also six months delay project will cost all of us 1 lakhs rupee extra as 20 lakhs rupee loan on an average: 1 year interest is around 2 lakhs. Look on economics. DO NOT POLITICISIZE THE ISSUE ELSE IT WILL GO AGAINST US!! DEMAND FOR FLAT AND ACTION AGAINST CULPRIT BUILDERS AND GNA. Tell to channels directly we are not investors we are buyers.
