    For builders, the interest cost is almost double of this.

    Q: What option do you think is mot feasible and practical at this point in time given the state of affairs that the Greater Noida authority itself finds itself in and they are going to have trouble acquiring new tracks of land to give to the developers and that’s going to be a long process, isn’t it?
    A: What we have been told informally that the farmers are not really interested in taking back the land in as much as they want higher compensation. Because a lot is at stake for the authorities as well so they might go for a negotiated settlement with the farmers.

    Q: So will you then negotiate with the farmers yourself. Will the authority negotiate on your behalf and will you then workout a better compensation for the farmers?
    A: The charter of the two authorities Greater Noida and Noida bar the members from direct interface with the farmers, though we can have formal channels with the farmers. The actual formal interface would have to be between the authority and the farmers.

    Q: What is the legal opinion that you have got so far because you have got the Allahabad High Court order, you have got a Supreme Court order. What are lawyers telling you? What are experts telling you about where you stand currently?
    A: There is some element of surprise and in that third and fourth party interests have not been considered while giving this order. I am sure the honorable High Court has its reasons and we are yet to read the order but I don’t think the interest of the developers and the end customers have been adequately represented.

    Q: Would you approach both the Supreme Court as well as the Allahabad High Court?
    A: Yes.

    Q: What is at stake here because when Shaberi case happened the reports that we saw suggested that there were projects close to Rs 40000 crore that were stranded on account of this. Now this is another 608 hectares being done away with in that sense. What is the cost that we are talking about here?
    A: The numbers are little exaggerated. The total number of apartments which are likely to get affected in Noida Extension is between1 lakh to 1.5 lakh apartments. Typical apartment ticket size would be Rs 20 lakhs, so we are talking about Rs 20000-30000 crore in total and roughly half of that - orders are already been passed on.

    Q: After Shaberi happened, real estate developers came and said that we will either relocate customers or we will compensate them, refund their money with interest. Does that still stand? Because where do you relocate them is also a question, or even this has been done away with?
    A: I don’t think that’s looking feasible in the very short term.

    Q: Compensation or relocation?
    A: We had builders who had five projects in the area; one of them got affected as they could have shifted the allottees of the affected project in the other four. But if all five get affected where does he relocate them to. The other thing is the money that is collected from the customers and the whole business model depends on collecting money in advance from the customers and investing in the land and construction. That money has been invested; it’s not lying in the bank.

    Q: That’s very important because you can no longer assure buyers who had invested in these apartments of compensation or relocation?
    A: I am not saying that. I am saying that some kind of settlement would have to come with the authority. The solution to this problem now lies with the authority and the government. They would either have to give us alternate pieces of land or compensate us for the expenditure that we have done on behalf of the customers in constructing half of the buildings.

    Q: What are banks saying because you have got consumers who have taken EMIs, loans to actually pick up these flats, real estate developers themselves who have taken loans from banks? What are banks saying at this point of time. How worried are they?
    A: The banks are worried but also understand that construction had not progressed to a very advanced level in these projects. So the bank exposure is not to the extent that otherwise would have been in such projects.

    Q: So will there be a decision on moving both the High Court and the Supreme Court by tomorrow, in the next 24 hours?
    A: Yes.

    Q: Also the possibility of a negotiated settlement with the Greater Noida authority?
    A: Yes.

    Solution is only possible OUT OF COURT.. Once SC decesion comes it will become more complicated.. Because reaquisition in a new way will take more than 3 years.. Which authority and builders will not say publicly and everyone knows government works are very slow..

    Also another way to negotiate with farmers in proper way they should clean up all the things in Shahberi village and declare at agriculture and ask for return money and if someone do not return then put case in court and it is sure noone is going to buy that land..

    Probably this little destruction may break unity of farmers and they can come on platform of reasonably negotiations and try destruction in that way price in neighbour villages also fall down...

    Situations are not as easy as it said, BMW already have ruined their image a lot in front of Farmers and as elections of UP is near hence forgot that if Government / BMW / Authority will take any actual tough actions against farmer group. We can not hide facts, politics is playing big role in it and at this time no party will try to hurt farmers at all. BMW also want to win next year UP elections and if all UP farmers give vote against BMW then they will not get even 50 seats and BMW know it very very well. Again farmers are not in hurry to sell their land they know later or sooner they can sell it easily (or after government change, or good compensation provided....) , believe me farmers are really not in hurry at all , builders & buyers are in more hurry to solve this issue. What you think without the permission of BMW such huge groups of farmers can do lots of rally all around the NE , GN , Noida 2-3 times a day...

    I am not saying go against farmers.. Already BMW is giving approx. good compensation.. Just tell them we are ready to return yours land if you think so.. But, the farmers who want to give the land they can give according to new policy else if the want to farming they should contiune we are ready to declare that land for farming.. In that way she will become favourite of farmers and also farmers will also think of proper price as rightnow thay are claming improper price becuase of these developments.. Let see how many farmers are ready to settle.. Also tell them we have to return money now to investors so we are giving you 2 months time for returning money after that we will charge you penalty as we have to give it to buyers..


    Take sympathy of boths and play diplomatically..

    Let see what happens.. Without trying you can not expect anything..

  • Farmers of NE Set New Ridiculous Demands

    Villagers' list of new demands

    Compensation on par with rate at which land was allotted by Greater Noida Authority to builders. In Noida Extension area, land was allotted to builders at Rs 10,000-12,000 per sqm. Farmers say since the authority works on a no-profit, no-loss basis, it should not have problems giving this rate to farmers.

    For land acquired from farmers and on which the authority built public facilities such as roads, sewers, parks etc, it should give compensation at the prevalent market rate. Farmers say this is necessary to neutralise the loss from the illegal sale of 60 acres of community land (gram panchayat land) in Patwadi to builders.

    17.5 per cent of the total number of flats being built by builders should be reserved for farmers. If they are not allotted these flats, cash equivalent to the cost of these 17.5 per cent flats should be given to farmers.

    The Noida Authority has promised to give every farmer a plot in a developed sector six per cent the size of the land acquired from them. Farmers now want this figure raised to 10 per cent and stamp duty done away with.

    Farmers want the Noida Authority to return abadi (inhabited) land to them and restore their full ownership over such land, abolishing the authority's practice of leasing such land to farmers.

    30 per cent job quota in industries, IT and fashion institutions.
    Plus, 30 per cent quota in admissions in all primary and senior secondary education institutes apart from 30 per cent fees waiver on their children.

    पतवाड़ी गांव के किसानांे ने मंगलवार को अपनी मांगों का प्रस्ताव तैयार कर अथॉरिटी को सौंप दिया। किसानों ने 11 हजार रुपये प्रति वर्गमीटर की दर मुआवजा देने की मांग की है। साथ ही विकसित प्लॉट भी 6 पर्सेंट से बढ़ाकर 10 पर्सेंट देने को कहा है। किसानों ने आवासीय स्कीम की तरह इंडस्ट्री, आईटी और इंस्टिट्यूशनल के आवंटन में भी 25 पर्सेंट किसान कोटा आरक्षित करने की मांग की है।

    इलाहाबाद हाई कोर्ट ने ग्रेटर नोएडा अथॉरिटी को जमीन अधिग्रहण के मुद्दे पर किसानों से समझौते के लिए 12 अगस्त तक का वक्त दिया है। किसानांे से समझौते के लिए सीईओ रमा रमण समेत अथॉरिटी के अफसर पतवाड़ी गांव के किसानों के साथ पंचायत कर चुके हैंं। हालांकि इसका फायदा नहीं दिख रहा है। किसानों ने मंगलवार को प्रस्ताव तैयार कर अथॉरिटी को रजिस्ट्री कर दी है। किसान रणवीर सिंह का कहना है कि 7 अगस्त की महापंचायत में प्रस्ताव पारित करा 8 अगस्त को अथॉरिटी से इसकी रिसीविंग ली जाएगी ताकि अगर कोर्ट जाना पड़े तो किसान वहां अपना पक्ष रख सकें।

    प्रमुख मांगंे

    - लीज बैक समाप्त कर समस्त आबादियों को उसी स्थान पर छोड़ा जाए।

    - अथॉरिटी एरिया में स्थापित औद्योगिक इकाइयों में स्थानीय लोगों को योग्यतानुसार 30 प्रतिशत रोजगार दिया जाए।

    - शिक्षण संस्थानों में प्राथमिकता के आधार पर 30 प्रतिशत फीस में छूट और 30 प्रतिशत प्रवेश में आरक्षण दिया जा ए।
