    Today's SC decision has put a stop on all NE Speculations. The matter is finished. All the investors money is sunk!

    The Noida Extension is finally finished!

    Don't take this decision relevant to only Shahberi context! It will be applied to all land, taken in similar fashion, as soon as the hearings for all lands come across.

    SC has shown no mercy to middle class buyers - not considered them as the party too!


    SC upholds Allahabad HC order, asks govt to return land to Greater Noida farmers


    NEW DELHI: The Supreme Court on Wednesday upheld the Allahabad high court order quashing the acquisition of land in Greater Noida as well as transfer of the land to 7 builders.

    The SC also imposed a cost of Rs 10 lakh on the Greater Noida Industrial Authority (GNIDA) for nexus with the builders and directed it to hand over the land to the villagers and farmers.

    "GNIDA allotted the land to builders in complete violation for which the land was acquired," a bench comprising justices G S Singhvi and A K Ganguly said.

    The bench said even before the government approved the use of land from industrial to residential purposes, the authority allotted the land to some builders.

    The SC said that Greater Noida Authority was in collusion with builders to acquire the land first for public purpose and then in brazen violation of law transfer it to builders.

    The court said it will give detailed reasoning for arriving at this judgement later.

    The court passed its order on a petition filed by GNIDA and real estate developers and builders, including Supertech and Amrapali, challenging the high court order which had quashed the notifications for land acquisition in Greater Noida adjoining the national capital.

    please do not spread rumors and create panic. As of now the order is only for one village. whether other farmers also go to court will depend on whether the farmers benefit from today's order.

      You yourself answered the question: "whether other farmers also go to court will depend on whether the farmers benefit from today's order"!

      Farmers are certainly big beneficiary in this case - and already whole NOIDA EXTN. is in litigation.

      First Blow: Check with the banks if they are going to finance any NE Project now!

          नई दिल्ली: सुप्रीम कोर्ट ने नोएडा एक्सटेंशन जमीन अधिग्रहण रद्द कर दिया है, लेकिन सवाल ये उठता है कि आखिर यह पूरा मामला क्या है.नोएडा एक्सटेंशन चक, शाहबेरी, बिसरख, पटवारी, खेरी भनोता, रोजा जलालपुर यानी 6 गांवों को मिलाकर बना है. यह इलाका ग्रेटर नोएडा का हिस्सा है, लेकिन बिल्डरों ने इसे नोएडा एक्सटेंशन का नाम दे दिया.
          इसी नोएडा एक्सटेंशन में बिल्डर कम बजट में छोटे फ्लैट्स का निर्माण कर रहे थे. यहां 15 से 25 लाख में 2-3 कमरे के फ्लैट बुक किए जा रहे थे जबकि 35 से 45 लाख में विला भी बुक किए जा रहे थे, लेकिन अदालत के फैसले के बाद घर के सपने पर पानी फिर सकता है.
          नोएडा एक्सटेंशन में 78 फीसदी हिस्सा तो गैर-विवादित है, लेकिन 22 फीसदी जमीन विवादों में फंस गई है.
          चक और शाहबेरी गांव की 156.93 हेक्टेयर जमीन विवादित है, जिसकी वजह से करीब आठ हजार लोगों के घर के को ग्रहण लग गया है और 6 बिल्डरों के प्रोजेक्ट पर भी ग्रहण लग गया है.
          आम्रपाली के स्मार्ट सिटी प्रोजेक्ट का करीब 22 फीसदी हिस्सा विवादित है. इसमें करीब ढाई हजार फ्लैट बनने थे.
          विवादित जमीन के कुछ हिस्से पर सुपरटेक बिल्डर का इको विलेज-2 प्रोजेक्ट भी आ रहा है.
          962 फ्लैट वाले रुद्र हाइट्स का पूरा प्रोजेक्ट, 1500 फ्लैट वाले गुलशन होम्स का पूरा प्रोजेक्ट, 2000 फ्लैट और 300 विला वाले पंचशील का पूरा प्रोजेक्ट, महागुन के माईवुड्स प्रोजेक्ट का 25 फीसदी हिस्सा विवादित है.
          कुछ बिल्डरों ने लोगों को दूसरे प्रोजेक्ट में फ्लैट देने का वादा किया है, लेकिन गृह प्रवेश से पहले अपशकुन तो हो ही चुका है.

              The situation is not good at all .

              Let's hope that SC comes up with some guidelines ( which they enforce ) for the sake of 1000's of end users/investors who r stuck up in the mess .

                Guys only 22 % land is under dispute....78 % is enough to develop this area.
                farmers who has accepted the compensation can not file any case in supreme court.I do not think there will be further much damage to farmers.

                  Manoj, I also hopes so.
                  So far, the lands of main Noida, only where the farmers have taken compensation + the plots in lieu of the land, and have already sold off those plots, can be considered safe!

                    safe 78% me kitne projects aate hai..aur 22% disputed land me kitne projects aate hai...ab clear picture samne aayegi..
