This can be something in which authority exploit farmers.
I assume farmers would have consumed all or most of the money by this time and they would not be in a position to return the money.

GREATER NOIDA: The happiness of villagers who have already claimed compensation for their land from the Greater Noida Industrial Development Authority seems to be short lived.

Coming down hard on the Sahberi villagers, whose land acquisition has been quashed by the Supreme Court, the Authority has issued a public notice asking them to return the compensation amount within the next 15 days in return for the 156 hectares land.

The Authority will then begin the process of returning land to villagers.Around 15 per cent the villagers in Sahberi have claimed compensation after their land was acquired by the Authority.

While the apex court order has directed the Authority to return the land in cultivable condition, it has caused a major hassle for the Authority as half the land acquired for construction of houses has been used or, in some cases, set aside for creation of public facilities such as roads, parks and drainage system.

With the court asking the Authority to return the land to farmers as it was, the Master Plan for the integrated development of Noida Extension will now go awry. Authority sources said structures like roads and drains would have to be bulldozed.

With more villages moving court, officials fear that planning and execution of development in Greater Noida will be disturbed beyond repair. Since the Greater Noida authority was formed in 1991, all land has been acquired using the urgency clause, something held illegal by the courts.

"The land use of the land in question was changed after some consideration, but now we will have to return the complete area to its actual owners. Now, for instance, on two acres out of the total six acres of a plot a concrete road has been made. We cannot tell the farmer that we will give back only four acres to him now. The two acres on which a part of the road exists is also his and he has a right to dig it up and grow crops," he added.

The Authority has already constructed arterial roads and begun the process of laying power, sewer networks in the area. With neighbouring villages also moving court now, a major threat looms over a proposed 130m-wide Noida-Greater Noida Link Road that will go up to Jewar. A part of the Greater Noida Metro line is also proposed to run along this route and a 100m-wide commercial belt was also being planned on one side of this road.

  • GNA CEO has already made statement in this regard that those farmers who are not able to pay the amount will be provided sufficient time to pay the compensation amount or they will have option of getting the due amount adjusted in the new compensation amount when authority acquires Shahberi land again.

    This is contradictory in that case. If GNA CEO has said that they will provide sufficient time to pay back the amount than why GNA came up with this notice of 15 days. Purpose : may be threat to other farmers so that they can go for out of court settlement.

    And in case GNA goes to acquire the land again than priority can be given to those builders whose land was denotified and in that case the investors can get their flat back.

    There are many if's and But's :D . Hope everything goes right and

  • I have no idea why 15 days notice was issued to farmers to return the compensation money when they are ready to give sufficient time to farmers who do not have money or even ready to adjust the amount in next acquisition process. One reason could be that they first issued the notice but later realised that this will have no impact because farmers will once again approach court for less time period given to them to return the compensation amount or It could be a threatening tactics for those who will oppose the yet again acquisition process.

    Regarding chances of priority being given to builders who were allotted the land earlier, yes builders could be given priority but I dont think buyers who booked flat in affected project would take that chance. First of all, project will be delayed considerably and it is also not certain if builders will be given priority or not. This time authority is going to hear objectiions raised by farmers so obviously it will take lot of time.

    नोएडा एक्सटेंशन के साबेरी मामले में सुप्रीम कोर्ट के आदेश को लेकर ग्रेटर नोएडा प्राधिकरण ने कार्रवाई शुरू कर दी है। सुप्रीम कोर्ट के आदेश की प्रति बुधवार को प्राधिकरण को मिली। आदेश का अध्ययन करने के बाद प्राधिकरण ने किसानों को जमीन वापस लौटने के लिए टीम गठित कर दी है। बिल्डरों को पैसा वापस करने के लिए बृहस्पतिवार से पत्र भेजा जाएगा।
    मालूम हो कि छह जुलाई को सुप्रीम कोर्ट ने साबेरी गांव में 156.75 हेक्टेयर जमीन का अधिग्रहण रद्द कर दिया था। सुप्रीम कोर्ट के आदेश की प्रति मिलने के बाद बुधवार प्राधिकरण के मुख्य कार्यपालक अधिकारी (सीईओ) रमा रमन ने अधिकारियों के साथ बैठक कर कोर्ट के आदेश का अनुपालन करने का निर्देश दिया। सीईओ रमा रमन ने बताया कि राजस्व रिकार्ड में जमीन किसानों के नाम दर्ज करने के लिए जिलाधिकारी को पत्र भेज दिया गया है। राजस्व रिकार्ड से प्राधिकरण का नाम काटकर किसानों का दर्ज कर लिया जाएगा। लैंड विभाग के अधिकारी, तहसीलदार, अमीन व लेखपाल बुधवार से राजस्व रिकार्ड में किसानों को नाम खंगालने लगे हैं। राजस्व रिकार्ड में किसानों का नाम दर्ज करने के बाद प्राधिकरण व राजस्व विभाग के अधिकारी गांवों में जाकर किसानों की जमीन का सीमांकन करेंगे। मौके पर जमीन की पैमाइश कर चिन्हित करेंगे कि कौन सी जमीन व कितनी जमीन किस किसान के नाम है। जमीन चिन्हित करने के बाद किसानों को मौके पर कब्जा दिया जाएगा। सीईओ ने बताया कि साबेरी में करीब साढ़े तीन सौ किसानों की जमीन का अधिग्रहण किया गया था। इसमें से 131 किसानों ने साढ़े 17 करोड़ रुपये का मुआवजा उठा लिया था। जिन किसानों ने मुआवजा उठा लिया है, उनसे पैसा वापस लेने के लिए एडीएम भूमि अध्याप्ति को पत्र भेजा रहा है। एडीएम किसानों को वापस पैसा करने के लिए नोटिस जारी करेंगे। मुआवजा की रकम जमा करने के बाद प्राधिकरण 131 किसानों के नाम जमीन दर्ज करेगा। हालांकि सीईओ का कहना है कि अगर किसानों ने मुआवजा की रकम खर्च कर ली है तो उनके साथ उदारता बरती जाएगी। रकम जमा करने के लिए समय दिया जाएगा।

    बिल्डरों को भी भेजा गया पत्र
    सुप्रीम कोर्ट का आदेश मिलने के बाद प्राधिकरण ने साबेरी गांव में बिल्डरों को जमीन पर से कब्जा हटाने के लिए पत्र भेजा है। बिल्डरों से अपना पैसा लेने के लिए कहा गया है। सीईओ ने बताया कि पैसे के लिए आवेदन करने के बाद बिल्डरों को रकम वापस कर दी जाएगी। साथ ही बिल्डरों से कहा गया कि वे निवेशकों का पैसा ब्याज के साथ वापस कर दें।

  • When even Banks are not able to recover loans from the farmers then how can GNA recover the money.

    Court has only instructed GNA to return land. Recovering money is GNAs headache. GNA has only to follow the law of the land as banks do. They cannot make their own rules.

    If farmers refuse then they will have to fight a legal battle in courts which all know is a lengthy process.
