Even the farmers who have got back their land due to HC and HC verdict know that they can not do any farming on construction land. The top soil must have been sold off by the builders long back. So, according to latest media reports farmers are ready to negotiate with Greater Noida Authority and all they seek is a better compensation.

Do you think this issue will be resolved soon , let's say in a month or 2 ?

  • Be practical it is not easy to fulfill farmers demands by Govt/Authority within the limits of policies. Only builders can negociate if Govt will allow them to do so, which will be the last option for the Govt and for builders too.

  • well some builders were already talking about giving more compensation to the farmers on tv show. will they shift the cost to buyers? we have to see that.it was all about compensation.farmers were pissed off when other neighbouring villagers got high compensation.

  • Developmental work in Patwari suffers setback

There is need for the court to address the fears of the buyers as well." Another buyer Pratibha says, "It is not every day that we can buy a house and if the entire Noida Extension area gets denotified , where will we go. Now, we have no choice but to wait to find out what's in store for us?"Also , the Patwari order has further complicated matters since developers went ahead with major construction work, considering that over 90 percent farmers in Patwari had already claimed compensation . Major housing projects like Supertech's Eco village I, Amrapali's La Residentia , Ultra Homes, Arden's Arihant and several more are already underway. Structures of almost five to six floors are ready. The Authority too has already spent Rs. 200 crore on development work in Patwari alone.

Major chunks of development projects like the 130-metre wide Noida-Greater Noida link road, a 60-metre wide link road between Greater Noida and Ghaziabad, the proposed Metro line from Sector 72 in Noida to the Bodaki railway Station, a wide network of sewer lines and several arterial roads fall in the affected area. Besides, the seven developers, land has been allotted for institutional use to two IT companies and two colleges and a hHospital."The order has actually slammed brakes on the development of Greater Noida. The Authority, the developers and buyers have all invested huge amounts of money in the area and all of it is turning out to be a criminal waste of resources," said CEO of GNIDA Rama Raman.

  • Noida Extn flat buyers move Allahabad HC

The Noida Extension Flat Buyers Welfare Association has filed a petition in Allahabad High Court seeking to implead them as a party in the petitions challenging land acquisition in Gautam Bhudh Nagar.

People who purchased flats in Noida extension have formed an association and approached the High Court to take into account their interests as well. The petitioner association has appealed to the High Court to ensure that the interests of the investors who have invested their hard earned money in the real estate projects should not suffer.

Allahabad High Court Thursday after hearing the plea of the Flat Buyers Association adjourned the petitions filed by farmers of Haibatpur, Bisrakh jalapur, Roza Yakubpur village, challenging the acquisition of land in Noida extension.

In a related matter the division bench comprising Justices Amitava Lala and Ashok Kumar Srivastava directed to prepare a list of pending challenges mentioning the date of notification, and date of acquisition of all the related matters.

Allahabad High Court has listed the case of land acquisition of Dadri district’s Ghodi Bachedi village on July 26 alongwith other petitions challenging land acquisition in the area. Petitioners - the farmers of Ghodi Bhacheri village from Dadri had approached the court challenging land acquisition by government by relying on urgency clause to do industrial development, but no such development ever took place, claimed the petitioners.

Petitioner stated that land was acquired from them for industrial development so that villages can get employment. However, even though the land was acquired in the year 2005-06 for industrial development, no development took place so far.

  • Great initiative. After all there are more flat buyers in Noida Extension, Greater Noida or Noida than farmers in these areas. The need is to come together on a common platform. Only then will even courts / politicians heed the interests of the middle class.

  • Wait for a Political Solution before UP Elections.

In another post I had discussed the genesis of this problem.

Now lets look at it from a political perspective and try to find a solution. Political perspective, cause this is a problem created by the Politicians and they are only ones who can solve it. Without a political solution, there will case upon cases one after another in the courts and nobody will gain anything for the next decade or so.

And before I begin let us be clear on one thing; life/death/well-being/development of citizens (or groups of citizens) become relevant or irrelevant to politicians depending on their assessment of its impact on their political future.

If you have been following GN & NE for few years now, you would know that this region was in big news in the second half of 2008, just before 2009 General Elections. About 5 people had died and about 100 politicians courted arrest. For the last 3 years no one talked about it, no one discussed it, there was barely any news coverage given to this region until recently; when Rahul Gandhi saw a political opportunity, with an eye on 2012 UP Assembly elections.

As soon as UP elections are over NE/GN/YEA will be forgotten once again. This issue might come up once again in 2013 just before the 2014 General Elections, if no permanent solution is provided by BMW before the UP elections; which is highly unlikely as I am sure that BMW wants to win again.

BMW's political inaction, so far, could be due to two reasons. My first guess is that she is waiting for this issue to reach its peak at which time she will come up with a solution which will have the maximum possible impact on the 2012 elections and ensure her another victory. And the second more scarier guess is that, in her own assessment, BMW does not think that NE/GN/YEA will affect her political future. I say this because, lets be practical, UP is India's largest state made up of 70 districts and Gautam Buddh Nagar, where NE/GN/YEA are situated, happens to be just one of these 70. Even if BMW looses heavily in GB Nagar, she can make up for it in other districts. However, given the media attention NE has been receiving in the recent past, she can not make the mistake of assuming that the impact of her Actions or Inactions will be limited to just one district.

So far, Congress, which is at the forefront of the agitation, seems to be fighting for the cause of a few thousand landowners in the District, purely for their votes. They are simply not concerned with the long term welfare of these people; had they been concerned about their cause they wouldn't have left it on the back-burner for 3 years. And most importantly similar issues are being raised by Landowners in Congress ruled states as well, is the Congress Party fighting for their cause??? Take a wild guess, you will have your answer.

All these politicians have so far ignored a huge political opportunity in the region, the investors/buyers (read Vote Bank). In NE alone more than 2.5 lakh houses were under construction, if any political party decides to represent the cause of these 2.5 families (ok only 1 lakh have invested so far, but rest assured that given the scarcity of residential property it won't be long before the balance also gets picked up) and ensures that justice is done to them, they can rest assured that majority of the 5 lakh voters in NE will vote for them. If you club GN & YEA as well, you are looking at a landslide victory.

However, the problem is that majority of this potential Vote Bank does not live in GB Nagar, as such will not vote in the next elections. Had these investors/buyers been registered voters of GB Nagar, the situation would have been quite different. In fact it wouldn't be wrong to assume that situation could have been exactly opposite, where the demands of these landowners would have been ignored for the benefit of million plus middle class voters.

In any case, it is in the interest of all political parties to offer a mutually beneficial solution which addresses the concerns of all concerned, the Landowners, the Buyers/Investors, the Builders and also something for the Landless Labourers who lost the only source of their livelihood.

The best solution and the only solution I can think of and the only plausible solution at this time is that UP/Central Govt pay some additional compensation to these Greedy Landowners and also allot them some land in a developed sector. Committing to an annuity based compensation would not be possible because of administrative reasons and moreover who will pay for this??. Simultaneous Govt should also set up a scheme for the rehabilitation of the Labourers, as they are the ones who have gained nothing from the entire deal but lost everything.

If such a package is offered to the erstwhile landowners all problems will be solved and everyone will live happily ever after. Cause the Landowners are only interested in more money and their greed is the only thing that has created this problem. If you think that the Landowners will pay back the compensation and mow down all the construction that has happened so far and start cultivating this land once again; forget it. Most of them have already made drastic life style changes and have spent the money. They can not pay back the compensation given to them even if they sell off everything. They are also not interested in agriculture anymore, as has already been reported in some news reports, all they want is more money, period.

Tax Payers of India have so far been paying for the subsidies given to these Landowners, let this be another one such subsidy borne by the Tax Payers. At least it will bring peace and much needed development in the region, which will benefit not just the current stake-holders but everyone.

The Central Govt also needs to bring new legislation to control and regulate the manner and the purposes for which Agricultural Land can be acquired. You can not carry on using something that was created more than 120 years ago. Just to give you a better picture, when the current Land Acquisition Act was framed, my great grand parents were studying in school. Is anyone still using anything which is that old?? Then why should we continue using a Law which is that old. This obviously is a long term solution which might take couple of years but in the immediate short term Govt needs to stuff more money in the throats of these greedy landowners and bring this dispute to a permanent solution.

  • Issue is very serious and it has made complicated by politics.Actually loss has happend to all the three parties.1.Builder,2buyer,3.Farmer.Who is in most comfortable position UP Govt babus and minister who has earned by lips n bounds.End user is the weakest Goat. Now I will put you all parties view.
    1. Builder: Although they had paid huge black money to UP Govt but can't get back because all that money is not on paper.First time in the history of NCR builder has learnt lesson that only by paying bribe to Govt. body thaey won't be sucsessful always and farmers are also having Power.

2.Buyer: Buyer is weakest Goat.Jisko sab ne pakaya aur khaya he lost evrey thingi.e, money, house, bank loan and kaa sapna..Sarkaar ne kisko loota Middle class buyer ko/Builder ne kisko loota middle class buyer ko..Paisa kahan gaya...Ministers ke Foreign account me...Buyer even dn't have time to fight court case...90 % of them are naukri-pesha..Kya kar payenge ...do-char pet peeche khaane waale hain can't continue long battle.

3.Farmer: They are the victims and no doubt about it.Agar aapki property koi raato-raat cheen le to aapko kaisa lagega. They got oppurtunity to get revenge. But the effect of revenge is not where it should be.Effect has got tranferred to end user..Baabu khus/Mantri khush/UP Govt chup/Builder kaa paisa Govt kha gayee/

The ironey of the situation is BMW's behaviour. She is quite and knows if 2012 lost thn 2017 kat kaa paisa hai BSP ke pass..What is their for her to loose..She has sucked blood of common man and no court of law can punish her..because case is against aquisition where GNIA is involded..
Doston jahan tak ho sakega being end user hum ladenge....aur agar hamaari kismat me hoga to wo bhi milega...
Lekin jara socho kab tak hammari mehnat ki kamai yuhin Builder/bank/authority/Govt itni aasaani se khaate rahenge....
Let us fight But don't blame farmers because they had been victimised and now they got chance to take revenge...and they will DACNCE on CHANCE...

All the buyers must be united and become a strong force.

Some known face like Anna or Ramdev or someone like that can be persuaded for the cause to have more publicity and visibility ... or just say marketing.

Dushman ka dushman doost hota hain

Use online media to create a positive image of the affected buyers .... now all the buyers are portrayed as cunning investors and as if these blood sucking investors are sucking POOR farmers maa...... need to turn the table ... need to create an image of poor 50+ Mussadilal is loosing his life in front of a SUV riding farmer.

  • Thanks for sharing your views friends. It seems the solution has to be innovative for a compromise to be reached.

I admire the cool and dispassionate way in which you discuss political motives king. But, there is one point on which i disagree with you. Yes, UP elections are definitely making things play out as they are right now. But, general elections will not revolve around UP land acquisition in my view , because in the center the incumbent is the Congress. So, Congress will be on the defensive during that period. This issue of land acquisition will be sucked dry by UP elections itself IMO.

That's correct. It is highly unlikely that BMW will let Congress run away with their agenda.
