NEFBWA has decided to hold a peaceful rally on Saturday, the 23rd July, 2011 starting from Gautam Buddha Statue, Noida Entry Gate. We shall give a memorandum to Chairman, GNIDA at Camp Office Sector 14-A demanding an immediate solution of the Noida Extension issue. The rally will terminate at Sector 18, Noida.

This is an opportunity available to us bring to the notice of the Authority our genuine grievances in the wake of the recent judgements of the Hon'ble Allahabad High Court on the issue of land acquisition in Noida Extension and to press for an early solution of the same. Therefore, all flat buyers are requested to please gather in full strength at Gautam Buddha Statue at 4:00 p.m. sharp on 23rd July, 2011.

    Dear Members,

    I am highly grateful to you for making the peace march such a grand success. I am especially thankful to the young generation for using technology such as facebook, SMS, emails etc. to the hilt to spread the message for participation in the rally. Although we took the decision to hold this rally on Friday, yet it was such a grand success on Saturday. I expect that this young segment of our flat-buyers will remain active in the same way in future as well.

    2. As you must have noticed now the problem is not limited to Noida Extension alone. The agitation of farmers has already spread to Noida and the way things are moving it is likely to engulf the whole of the District Gautambudh Nagar. We are getting feelers from the flat-buyers of these areas that they also wish to join NEFBWA to put up a united front. These people are of the view that since NEFBWA has already taken the lead and it is a respected and well-organized Association doing an excellent job on the issue, they do not want to open another front. They have a point as number of fragmented associations will not be able to take up the cause as can be done by an organization with a strong base.

    3. It is also noticed that a host of other categories of people have also been hit very hard by the judgments on land acquisition issue in Noida Extension. These affected people are builders, brokers, civil contractors, other petty contractors, architects, bankers, suppliers of basic construction materials such as bricks, cement and steel, suppliers of other building materials and of course employees of these segments. It has been brought to our notice that these segments have made huge investments in the hope of getting opportunity to cater to the housing projects coming up in Noida and Noida Extension. If the projects here are shelved and the land restored back to farmers they will suffer such huge loss that they will virtually be on road. Therefore, people from these segments have also expressed the desire to get associated with NEFBWA.

    4. We have given this matter a serious thought. There should be no problem in associating flat-buyers from other sectors of Greater Noida, Noida and Yamuna Expressway. As regards the other segments as enumerated above, there is no denying the facts that they too have been hit very hard by the developments that have taken place recently. We, as flat buyers, are not in direct contact with these categories except the builders. At this forum and right now, we are not discussing who is right and who is wrong. It is a matter of fact that we have some issues pending to be settled with the builders. But at this point of time and I repeat the words at this point of time, the interests of the flat-buyers and the builders converge and do not diverge. If all affected parties take a joint stand, we shall definitely succeed in saving our projects and revive the hope of getting our homes at the committed location and price.

    5. Not only the above categories we also invite the progressive farmers to come and join us to support our demand for homes to us at the committed location and price. We have mentioned in unequivocal terms that injustice has been done to the farmers. We have all along been raising the voice that they should get enhanced compensation. We also support their demand that they should get jobs in government and also alternate plot in the ratio in which they are demanding. The only thing is that we are against dismantling the development works and making the land cultivable again.

    6. This is in our own interest that the movement initiated by the flat-buyers is joined and supported by all the above affected categories to bring home the point that the solution lies in looking forward and not backward. While we are ready to open the doors of membership to the above categories, we wish to make sure that the movement does not lose its basic character that it is a movement of the home-buyers to get home at the location and price at which it was committed to them.

    7. In view of the position explained in the preceding paragraphs, it has been decided that there will be two types of membership ( 1 ) Primary Members – who will be only those persons who have booked flat with any of the builders in Noida, Greater Noida or Yamuna Expressway and ( 2 ) Associate Members - who could be any person coming from the affected categories such as builders, brokers, civil contractors, other petty contractors, architects, bankers, suppliers of basic construction materials such as bricks, cement and steel, suppliers of other building materials, employees of these segments and any other person who has been adversely affected. We will soon initiate the process to effect appropriate changes in the bye-laws of the Association.



    8. By associating affected persons of all regions and categories, we will certainly widen our support base and shall be in a position to carry forward our movement and also present our case in a more effective manner. In view of this, I request all of you to kindly spread this message as widely as possible amongst your friends and associates who belong to the above categories and urge them to become members as early as possible.

    9. Last but not the least, we also need financial support from you to carry forward this movement. We have already opened our bank account, but the same has not yet become operational. It is expected that our bank account will become operational very soon. We shall inform you the account number once the same becomes operational. You can deposit your membership fee as also other optional contributions in that account.

    Subject : Request for solving the problems of the flat-buyers in the wake of the recent judgments of the Hon'ble Allahbad High Court and Hon'ble Supreme Court of India by addressing the genuine grievances of the farmers.

      Noida Extension Flat-Buyers Welfare Association (NEFBWA) is an association of persons who have booked flats with different builders in Noida Extension. The objective of forming this Association is to protect the interest of the flat-buyers who have booked flats in Noida Extension. As on date, the Association has 5000 registered members and the number is growing every minute.

      As you are aware, sir, following the judgments in Sahberi case, farmers from adjoining villages approached the Allahabad High Court through different writ petitions challenging the acquisition of their land.. Now, the judgment has been delivered in Patwari case as well and there also the Hon'ble Court has taken the same stand and quashed land acquisition. Following this judgment, farmers from a large number of villages in Noida Extension are also moving court seeking relief on the same grounds. As the land in other parts of Noida Extension was also acquired with the same procedure which was followed in Shahberi and Patwari villages i.e. by dispensing with the conditions stipulated in of Section 5 ( A ) coupled with the invoking of urgency clause under Section 17 (1) of the Land Acquisition Act 1894, it is feared that the Allahabad High Court may take the same grounds and quash the land acquisition in other parts of Noida Extension as well. This will destroy the entire Noida Extension and spread the seeds of destruction to other parts of Greater Noida and Noida.

      However, there is a very important observation in the judgment of the Hon'ble Allahabad High Court… "We are informed that notional possession of the land was taken on 01.12.2009. In all the writ petitions, a status quo order was passed. The builders, who have been allotted the plots out of the acquired land, have been impleaded as parties. They were served but have not participated in the proceedings. It is admitted that so far there has been no development on the land". These observations of the Hon'ble Court put the writ petitions now being filed in post-Shahberi/Patwari cases on altogether different footing. There was no litigation pending in the cases which are being filed now, there was no status quo order and finally there is huge amount of development work that has already taken place prior to the filing of these writ petitions.

      It is a matter of fact that Noida Extension is a very well planned city with excellent facilities such as wide roads, express-ways, parks, electrification and all other modern amenities. As such huge amount of development work has already been undertaken by the Authority at the cost of the flat-buyers and tax-payers. Dismantling the already completed works in order to make the land cultivable again will amount to loss of huge amount of public money besides creating acute housing shortage. It is a matter of fact that whenever urbanization grows the land which is acquired is agriculture land. This also cannot be denied that there is acute shortage of affordable dwelling units in the NCR. Noida Extension offers the end users of the middle income group with excellent opportunity to buy residential units. It is for this reason that within a year and half of its launch approximately 1,00,000 flats have been booked in Noida Extension.

      We have every sympathy with the farmers. We are also aware of the fact that injustice has been done to them. It is against the principles of natural justice to deny opportunity to any person to raise objections if his property is being acquired. Obviously, this is also against the written law of the country i.e. Land Acquisition Act of 1894. Therefore, the farmers have their own genuine grievances which must be addressed. It is also equally important that the progress of development works should go forward and not backward. There is huge increase in land prices in NCR in recent years because of growing urbanization. In view of this, it is not a viable proposition to use the land for agriculture especially when there is such acute shortage of affordable dwelling units.
      In all the cases which have been filed or are being filed now there is interest involved of the flat-buyers who have booked flats in these projects . These flat-buyers are all end users of the flats and they have taken the flats for their self-use. They are not investors or brokers. They have made arrangements for the payment of the flats by disposing off some of their existing properties, gold or other valuable possessions. They also availed loans from banks/finance institutions or their employer. A large number of these flat-buyers are middle class government employees. The Association has already filed impleadment applications in Allahbad High Court that these bonafide flat-buyers will suffer huge and irreparable losses on account of any hard decision in post-Shahbari cases. In view of this, the Association has urged the Hon'ble Court that we must be given an opportunity to be heard before a decision is taken.

        The facts which must be considered at this stage are that huge amount of development has already taken place in the area, there is acute shortage of affordable dwelling units in NCR, Noida Extension is a well-planned and well-developed modern township, about 1 lakh flat buyers have already invested in Noida Extension, hundred of crores of rupees have been paid as stamp duty for execution of the lease deed, construction work has already started in most of the projects and in some projects the building has come upto 8th floor, displacement of about 1 lakh flat-buyers will further add to the already acute housing shortage in NCR. And last but not the least, there are genuine grievances of the farmers which if had addressed timely, this situation would not have come.

        While you deserve the credit for designing such a well-planned futuristic city, you are also to be blamed for not properly addressing the genuine grievances of the farmers who were the real owners of the land on which development works have taken place.

        In view of the position explained in the above paragraphs, we earnestly request you to kindly intervene in the matter without delay and address the genuine grievances of the farmers. It is impossible to restore the already developed land with so much of construction already having taken place back to cultivable stage. Besides, dismantling the development work will amount to loss of huge amount of money of the flat-buyers and hamper the progress of development work in the area.

        It is hoped that the farmers also understand this point. It is gathered from the mood of the agitating farmers that their demand is primarily for enhanced compensation. If the Authority takes initiative, it should not be very difficult to reach a settlement with the farmers because they are fighting for a just cause and injustice has been done to them.
        We, the bonafide flat-buyers, have come to you with the expectation that you will understand our plight and accept the mistakes committed in the past and also settle this matter with the farmers without any further delay before any more adverse decisions are pronounced by the Hon'ble Allahbad High Court.

    The developments of today in Hon'ble Allahbad High in the matters of land acquisition are given in the succeeding paragraphs.

    The Counsel of NEFBWA Shri S.D. Singh brought to the notice of the Hon'ble Court the interests involved of the flat-buyers and the hardships that they will suffer in the event of the decision going Sahberi and Patwari way. Our Counsel informed the Hon'ble Court that the flat-buyers booked the flats after exercising due diligence as is expected of an educated person. There was a proper allotment letter issued by the GNIDA in favour of the builder, the lease deed had been executed in favour of the builder, proper stamp duty had been paid, earnest money had been paid to the Authority as per the terms and conditions of allotment, the physical possession of the land had been given by the Authority to the builder, the drawings had been approved, all other approvals including approval from the Airport Authority of India and environment department were in place.
    And above all the construction work was progressing without any hindrance. In these circumstances, it was submitted before the Hon'ble Court that we, the flat-buyers, are a necessary party and we may kindly be heard before a decision is delivered. After hearing our views, it is a matter of great relief that the Hon'ble court asked the concerned parties to reach a settlement before 12.08.2011. The Hon'ble Court also referred the matter to a larger Bench and fixed 17.08.2011 as the next date of hearing. We are grateful to the Hon'ble Court for this gesture.

    We are grateful to our esteemed members for their unflinching support and trust. It is because of the cooperation of our members that we have been able to bring to the notice of the Hon'ble Court the fact that large number of bonafide flat-buyers will suffer unbearable hardships if any more decisions are taken without giving them a hearing. On the same issue, judgments had already been delivered by the Hon'ble Allahbad High Court and Supreme Court and therefore it was feared that all land acquisitions done by following the same procedure would also be quashed in the same manner. However, we brought to the notice of the Hon'ble Court at the right time the interests involved of the flat-buyers and it is for this reason that the Hon'ble Court extended its indulgence and issued directions to the parties particularly GNIDA/State Government/Farmers to make sincere efforts for a solution.

    Finally, we assure our farmer brothers that we are with them. We have all along been mentioning that injustice has been done to the farmers. They must get what is due to them. We are also contemplating that we should get in touch with the farmers directly and make them aware of our hardships. Our office bearers and our Counsel are still in Allahbad.     A study of the judgment indicates that the Hon’ble Court is seized of the problems being faced by the genuine flat-buyers. Besides, this is also in the knowledge of the Hon’ble Court that the litigations being filed now are an afterthought and not genuine as is evident from the observations of the Hon’ble Court given below:-

Therefore, in addition to consideration of the cause, the Court has additional duty to find out who is genuine and who is unscrupulous litigants, trying to take advantage of the situation”.


    It is a matter of fact that the Hon’ble Court is now fully aware of the grievances of the flat-buyers as also of the other parties such as builders and bankers. It is for this reason that the Hon’ble Court has directed the concerned parties such as State Government/GNIDA and the farmers to reach a compromise by 12th August 2011. The Hon’ble Court has also referred the matter to be placed before the larger Bench on 17th August 2011 which again is indicative of the fact that the Hon’ble Court is concerned about the interests of the larger segments of the society.
    Some of our friends suggested that we should hold a peace march either on Saturday or Sunday. In view of the time-bound directions of the Hon’ble Court to the concerned parties, any uncalled-for and extraordinary pro-activity at this stage will not serve any purpose. Rather the same may in fact have a negative impact. We are hopeful that there will be some positive settlement before 12th August 2011 and therefore we should wait for the same.


    IMPORTANT: Meanwhile, we must gear ourselves up with all requisite information so that we are in a position to put our stand strongly before the Hon’ble Court on 17th August, 2011 in the event of failure of settlement. Besides our viewpoint, we are also required to place before the Hon’ble Court a verified list of the registered members of NEFBWA. It is, therefore, requested that you may please send through e-mail, by post/courier or personally scanned/photo-copy of any document as proof of your having booked a flat in Noida Extension with any of the builders. This document could be copy of acknowledgement of application submitted to builder, allotment letter, payment receipt or any other document with your signature thereon to prove conclusively that you have booked the flat. Please note that the officer-bearer of NEFBWA will have to give an affidavit in court to the effect that the list includes only genuine flat-buyers. We shall be obliged if this document is sent at the earliest to enable us to take further action at the earliest.

    Its fight for all, We will protest and will decide our future course of actions in the same meeting. As you know we are a big community but as we don’t have any back support. But now NEOMA is getting dynamic people to make it more strong.

    Please understand NEOMA is formed when there was no such issues, Our Purpose is not just land issue, Out objective is long term. WE formed NEOMA to fight for any such issues in near future. But right now we have land issue that is on top priority for all buyers.

  • Noida Extension: Builders pose as buyers to bypass refund


    First, their dream of becoming house owners was demolished after the Supreme Court and Allahabad High Court issued directives scrapping land acquisition in Greater Noida. Then, hopes of a full refund offered them some consolation. Now, a group that claims to speak up for them, but is actually the voice of builders, has put more than one lakh home buyers on shaky ground again.

    The newly formed Noida Extension Flat Buyers' Welfare Association (NEFBWA) appears to have unilaterally surmised that the majority of the buyers want houses in alternative areas and not a refund.

    This has left the purchasers, largely comprising members of the middle class who had sunk their entire savings into the projects, nonplussed.
    After the SC order in the Shahberi case, the buyers of flats in other villages of Greater Noida heaved a sigh of relief. They thought they, too, would get their money back because the legal status of land acquisition was the same in those areas as well.

    But the association's latest stand has emboldened the builders and property dealers not covered by the Shahberi verdict. The result is that they have started setting their own terms and conditions for returning the money invested by buyers.

    One utterly perplexed buyer says, "Many builders with projects outside Shahberi have set their own rules. They say 10 per cent of the total cost of the flat will be deducted from the refund amount. So, if I have paid Rs 3 lakh and the cost of the flat is Rs 32 lakh, I will end up paying the builder ` 20,000 to settle accounts, instead of the other way round."

    "When we requested NEFBWA to take up the issue, they asked us to talk to the builders directly. This association is a front for builders," he adds.
    Even Gopal Singh, a lawyer for the farmers, sympathises with such purchasers. "It is quite apparent that some people are doing netagiri to promote the interest of builders", Singh feels.

    But NEFBWA general secretary G.L. Sagar, a Central government employee, claims that all the members in the group are genuine buyers and that they enjoy widespread support. However, in the same breath he admits that only 6 per cent of the total number of buyers are members of the association. " We have 6000 listed members in the association. We will plead our case effectively," Sagar claims.

    Association president R.P. Tyagi in an email sent to the members of the association, said: "A host of other categories of people have been hit hard by the (court) judgment on land acquisition. They include builders, brokers, contractors etc."

    Although it is his subsequent statement that exposes his soft spot for the builders: "If the projects are shelved, they will suffer losses that can drive them to bankruptcy. Therefore, they have expressed their desire to get associated with the NEFBWA."

    Parminder Bhati, a lawyer pleading the case of farmers of Bisrakh and Patwari villages, explains the rationale behind the formation of the NEFBWA.

    "A few wealthy investors booked several flats to sell them later at appreciated rates. They formed this association. Since the HC is least interested in hearing the case of builders, they have been trying to pursue a case through the NEFBWA."
