Unjustifed Clauses by Supertech in NE (GNW)

    Supertech is giving allotment letter with escalation clause which means buyer will have to pay the increased amount in construction cost from date of booking till the time of possession. They have kept the 50% cost of flat as construction cost and as per the escalation clause, Buyer will have to pay for the increase in the cost of construction material from the date of booking till the time of possesion. So if construction cost is increased by 20% till the time of possesion, Buyer will have to pay 20% of construction cost extra at the time of possesion. When we booked the flat they never told there will be extra charges, Its no where written in their application form for escalation charges.

    At the time of booking there was no mention of any additional cost but in agreement they are putting such clauses. Secondly I booked a flat of 795 sqft now they have increased Super area to 890 sqft and there is only change of Balcony of 5 sqft in old and new layout. Now they are asking for additional amount for increased super area at the time of possession.

    Please help what I can do in this case.

    Supertech like other builders is having a 1-sided BBA. But yeh to hadd hi ho gayi.

    Challenge them in consumer forum, if you are fine with taking the legal path.

      There are hundred of other buyers also who have been cheated by Supertech. At the time of booking their channel partner/Sales Executive don't tell that there will be hidden charges and take booking by 10% amount. After 2-4 months of booking they issue allotment letter with all 1 sided clauses, where these unjustified clause are mentioned. When Buyer shows his/her dis-agreement on unjustified clauses then Supertech people gives threatening that if you don't agree with term & conditions mentioned in allotment agreement, you will have to cancel the booking. As the result of cancellation of booking 15% of total cost of flat would be deducted which means buyer will lose all this booking amount.

        Why the hell people buy in SuperTech.

        Not even a single visit to their past projects and no feedback from their past customers. Seriously, I do not blame SuperTech, people made sure they get cheated, why cry now.

            That's true FieldWorker Bhai, people don't use their mind and then cry in the last, I don't find even a single person in the entire forum who does Supertech in any way.

              Buyer bhi kya kare bhaiya.... everyday 3C, ATS, Purvanchal is not launching projects......

              Wholesale mein flats to amrapali, supertech, jaypee, sikka, jaise 3rd class builders hi bhechte hain....

                There are unprecedented number of flats being built in Noida Extn itself, there is no such crisis in NExtn. Above that many buyers just are not interested in NExtn due to SC cases.

                  And that's why ATS, Purvanchal, 3C don't have even a single project in Noida Extension, GN is the safe bat then extension and you can find all good builders with decent rates plus RTM.
