पतवाड़ी के किसानों का लिखित समझौता
जागरण संवाददाता, ग्रेटर नोएडा किसानों के साथ समझौते की दिशा में ग्रेटर नोएडा प्राधिकरण को बृहस्पतिवार को बड़ी सफलता हासिल हुई। पतवाड़ी गांव के किसानों के साथ प्राधिकरण का समझौता हो गया। इससे बिल्डरों व निवेशकों को बहुत बड़ी राहत मिली है। समझौता भी किसानों के लिए फायदेमंद रहा। उन्हें अब 550 रुपये प्रति वर्गमीटर अतिरिक्त मुआवजा देने पर सहमति बन गई है। साथ ही आबादी व बैकलीज की शर्तो को हटा लिया गया है। हालांकि नोएडा के सेक्टर-62 में गुरुवार को देर रात तक अन्य मुद्दों पर प्राधिकरण व किसानों के बीच बातचीत जारी थी। इलाहाबाद हाईकोर्ट ने 19 जुलाई को पतवाड़ी गांव की 589 हेक्टयेर जमीन का अधिग्रहण रद कर दिया था। अधिग्रहण रद होने से सात बिल्डरों के प्रोजेक्ट प्रभावित हुई हुए थे। 26 हजार निवेशकों के फ्लैट का सपना भी टूट गया था। प्राधिकरण के ढाई हजार भूखंड़ों, चार सौ निर्मित मकानों व दो इंजीनियरिंग कॉलेज की योजना भी अधर में लटक गई थी। 26 जुलाई को हाईकोर्ट ने नोएडा एक्सटेंशन के अन्य गांवों की सुनवाई के दौरान प्राधिकरण, बिल्डर व किसानों को 12 अगस्त तक आपस में समझौते करने का सुझाव दिया था। हाईकोर्ट के सुझाव पर प्राधिकरण ने किसानों से समझौते के लिए वार्ता की पहल शुरू की। 27 जुलाई को प्राधिकरण के सीईओ रमा रमन ने सबसे पहले पतवाड़ी गांव के प्रधान को पत्र भेज कर वार्ता करने के लिए आमंत्रित किया। दूसरे दिन ग्राम प्रधान रेशपाल यादव ने प्राधिकरण कार्यालय पहुंच कर सीईओ से बातचीत कर उनका रुख जानने का प्रयास किया था। 30 जुलाई को सीईओ ने गांव पतवाड़ी जाकर किसानों से सामूहिक रूप में बात की। इस दौरान मुआवजा वृद्धि को छोड़कर किसानों के साथ अन्य मांगों पर प्राधिकरण ने सकारात्मक रुख दिखाया। मुआवजा बढ़ोतरी पर बातचीत करने के लिए किसानों को आपस में कमेटी गठित कर वार्ता का प्रस्ताव सीईओ दे आए थे। इसके बाद किसानों के साथ गुरुवार को नोएडा के सेक्टर-62 में बैठक बुलाई गई। इसमें प्राधिकरण के सीईओ रमा रमन, ग्रामीण अभियंत्रण मंत्री जयवीर ठाकुर, सांसद सुरेंद्र सिंह नागर व जिलाधिकारी के साथ किसानों की वार्ता शुरू हुई। आठ घंटे तक वार्ता चलने के बाद किसान समझौते के लिए तैयार हो गए। सूत्रों के अनुसार पतवाड़ी गांव के किसानों को मिले 850 रुपये प्रति वर्गमीटर के अलावा 550 रुपये प्रति वर्गमीटर और देने पर सहमति बन गई है। देर रात तक बैठक जारी थी। अभी इसकी अधिकारिक घोषणा नहीं की गई है। हालांकि गांव के कुछ किसानों ने वार्ता की पुष्टि की है। इससे पूर्व किसानों की आबादी को पूरी तरह से अधिग्रहण मुक्त रखा जाएगा। बैकलीज की शर्ते हटा ली जाएगी। पतवाड़ी गांव का समझौता होने पर प्राधिकरण को नोएडा एक्सटेंशन के अन्य गांवों में किसानों के साथ समझौता करने की राह आसान हो गई है। नोएडा एक्सटेंशन विवाद ने रोके खरीददार : नोएडा एक्सटेंशन विवाद ने समूचे ग्रेटर नोएडा एवं यमुना एक्सप्रेस वे प्राधिकरण क्षेत्र में संपत्तियों की खरीद-फरोख्त पर ब्रेक लगा दिया है। दोनों जगह ढूंढे से भी खरीददार नहीं मिल रहे हैं। कुछ समय पहले तक जो लोग शहर में अपना आशियाना बनाने के लिए आतुर थे, वे अब यहां संपत्ति खरीदने से हिचकिचा रहे हंै। पिछले बीस दिनों में भूखंड व मकानों की गिनी-चुनी रजिस्ट्री हुई हैं। सिर्फ गांवों में कृषि व आबादी भूमि की रजिस्ट्री हो रही है। इससे प्रदेश सरकार को राजस्व की भी हानि उठानी पड़ रही है

    दूसरी ओर ग्रेटर नोएडा के पतवाड़ी गांव की किसान सावित्री देवी के मामले में उत्तर प्रदेश सरकार व अन्य पक्षकारों को नोटिस सर्व करने का आदेश देते हुए कोर्ट ने सुनवाई 8 नवंबर तक स्थगित कर दी। कोर्ट ने कहा कि राज्य सरकार व अन्य पक्षकार नोटिस मिलने के बाद जवाब भी दाखिल करेंगे। इस मामले में किसान और ग्रेटर नोएडा अथारिटी दोनों सुप्रीम कोर्ट आ चुके हैं और कोर्ट दोनों ही मामलों में नोटिस जारी कर चुका है।

    This is really BAD that SC further delay it and give next date of hearing after a long time of 3 months.... Worst situation.... only sufferer will be Buyers not Builders Lobby... Very soon after paper approval Builders will ask for next installments (or will cancel booking).... looking the yesterday attitude of SC, it feels that Verdict of NE may take 4-6 months at least....

    It will be very tough for genuine buyers to give further installment before SC verdict due to bank non approval and big RISKS involved..... Builders will make merry as they will get new booking / further installment with minimum work to show in society, they have lots of excuses for slow/no work.

    The very first case (HC) related NE disclosed in april-11 till then many builders including mine stop/slow their work till oct-11(last HC decision) almost 6months.

    when i booked my flat builder started digging work with good no of labors and heavy construction material on site shows the seriousness but after April-11 same condition we can see today.......only GADDA.

    so no one going to start work its sure.

  • No... let me tell u what is coming in 2-4 months

    Master plan is cleared.... builder will ask next installment.....else face cancellation as per agreement... builder will not start work for next 4-5 months...because case is pending in SC...Bank will play smart and will not disburse loan to BUILDER/Buyers.. since case is pending in SC and no one would take risk.....builders again increase price by 400-600 till Diwali.... old buyer is stuck... either sucide or pay more

    del_sanju....agar sabhi aapki tareh soche to desh ki ye condition na hoti.

    builders only think how to make money.

    AB toh mai bhi trapped feel kar rha hu. I gav myself a deadline till july after buying in jan 2012. family pressure also increasing.

    Isse acha toh 25-30 lak me delhi me unauthorised calony me hi 2-3 bhk hi le leta.

  • I have paid booking amt to patel neotown in 2010,later they issued provision allotment letter but agreement still not signed,they say they will signe after NCRPB approval,
    can any body tell the intention of builder to charge extra money from such buyer or they may charge from every buyer whether agreement signed or not because case of such buyers who paid booking amount but agreement not signed i think very few

  • I have been following this forum from a long time and reading all the comments, concerns but one thing which still is not clear to me is that if someone has booked the flat in any project of NE which does not fall in the villages under dispute like Shahberi or Patwari eg. Haibatpur. So once NCRPB gives approval to MP-2021 then those projects/construction will still be effected by SC verdict or those builders outside the mentioned dispute villages or will be in a position to resume with their construction work or not.

    Seniors please reply and clarify my concern.

    I understand your concerns but want to let you know that this SLP (special leave petition) has been filed by builders only. If builders knew that SC can cancel the entire NE accusation. Do you really think lawyers representing builders cant catch dis? they must have thought something before filling this SLP. The SLP is all about compensation and not about accusation. The chances for this thing getting cancelled is bare minimum.

    I visited NE yesterday. It was crowded like hell and all major builder offices were full of investors. I know we can not take anything for granted but we can at least be hopeful!

    NEFOMA working on the following points without disturbing buyers, because Buyers already in lot of problem. It’s a responsibility of the association to resolve his (Buyers) issue. When very much necessary than only called to buyers because time is very precious and buyers call must be result orientated.
    ---------------------------------------...------------------------------------

    1. The land which is acquired by government (GNA) allotted to builder for construction Housing Project.

    2. The position of Land is not remaining for Agriculture as lot of construction work/ Development already done by builder and Authority.

    3. Crores of rupee already invested in this area, which is also belong to citizen of India, if acquisition going to be cancelled, it’s total lose of Government as well for Farmers also.

    4. As the lakh’s of buyers already booked there flat in this area and invested a huge amount and paying EMI (interest only) to the Banks.

    5. At the same time Banks are approving the Housing loan in this area (Noida Extension) on these projects and before actual land row started banks disburse part payment to the builders, from that day buyers are paying only Interest on it and principal amount is still outstanding within the bank. If matter not going resolved lot of people become unstable or may be at this position where no place has remain. As the money is lying with builder and builders getting interest on buyer’s amount and buyers is paying interest on it, What a JOKE!

    6. As the lakh’s of buyers already booked there flat with different builders, builders harassing the buyers with demanding more money and threatening to cancelled the flat booking,

    7. Where lot of buyers given 10% of booking amount as per builder demanded and received the same by the builder for booking, asking more money in different way (i.e. As the builder ask 10% of BSP – Basic Sale Price (Total flat Area in square feet x Rate Per Square Feet called BSP), now they adding some more things like PLC, FMC etc. and showing shortfall of 10% booking amount.

    8. Please note that some of the builder received token amount for booking (Less than 10% of the BSP) to make his booking and meet the competition among the builder at that time, they also cancelling the booking showing short fall of 10% (Our question with builder. If there is a certain criteria to make a booking than why the respected builder received short / less amount for booking? If you (Builder) received short / less or any amount in the name of booking you must consider the same and not cancel any booking.

    9. We also considering, not asking or demanding any amount by the builders till project / area get approved by the banks / Greater Noida Authority or Supreme Court.

    10. Now we also want make an attention towards the BANK’s. Banks issue Housing Loan on disputed land and enjoying the interest from Innocent Buyers. If Land was disputed than why the banks approved the loans on disputed land to Flat buyers. As banks charge a processing fee to verify the thing (i.e. whether the Project is applicable for loan or the buyers have a capacity of re-payment etc). Bank have total discrimination of approving the HOUSING LOAN not the buyers, he (Buyers) only can apply the Loan and wait for approval, if not approved he can’t do anything, but once it’s get approved, than total responsibility of the bank not he buyer but after approving the loan he stop the disbursement due to the disputed area.

    11. What they (Banks) check? As Banks are charging fee for that. Why the only buyer face the heat of irresponsibility of the bank as they have no fault because Bank have total discrimination of approving the HOUSING LOAN not the buyers. We would like to say, Banks should consider and stop EMI up to matter get resolved and wave off interest for a such disputed period as done by authority (Called ZERO period) because we middle class people getting salary to manage our family requirement like Rent, Children fees, Food to family, daily expenses as you also aware with today’s cost of surviving/ living, due to the above circumstances we are lot in mental harassment and touchier.

    I also think the same way....SC matter is not for complete NE only for few selected pockets are under scanner of SC

  • i have budget of 50 lakhs or so....i was waiting for noida extn matter to be over so i have more option..but now i think i forget about noida extension

    I looking at noida expressway, greater noida and raj nagar extn

    as if i wait for another year for this area to be clear...then by that time these buiders will launch at 3500 psf.....and noida will be 5000 psf...raj anagr will be 4000 psf

    I will choose within the coming month in other areas and forget about this area
    pata nahin kab clear hoga..kab banega and when people can start living

    bye bye noida extension...sorry but i have limited budget and want a house
