पतवाड़ी के किसानों का लिखित समझौता
जागरण संवाददाता, ग्रेटर नोएडा किसानों के साथ समझौते की दिशा में ग्रेटर नोएडा प्राधिकरण को बृहस्पतिवार को बड़ी सफलता हासिल हुई। पतवाड़ी गांव के किसानों के साथ प्राधिकरण का समझौता हो गया। इससे बिल्डरों व निवेशकों को बहुत बड़ी राहत मिली है। समझौता भी किसानों के लिए फायदेमंद रहा। उन्हें अब 550 रुपये प्रति वर्गमीटर अतिरिक्त मुआवजा देने पर सहमति बन गई है। साथ ही आबादी व बैकलीज की शर्तो को हटा लिया गया है। हालांकि नोएडा के सेक्टर-62 में गुरुवार को देर रात तक अन्य मुद्दों पर प्राधिकरण व किसानों के बीच बातचीत जारी थी। इलाहाबाद हाईकोर्ट ने 19 जुलाई को पतवाड़ी गांव की 589 हेक्टयेर जमीन का अधिग्रहण रद कर दिया था। अधिग्रहण रद होने से सात बिल्डरों के प्रोजेक्ट प्रभावित हुई हुए थे। 26 हजार निवेशकों के फ्लैट का सपना भी टूट गया था। प्राधिकरण के ढाई हजार भूखंड़ों, चार सौ निर्मित मकानों व दो इंजीनियरिंग कॉलेज की योजना भी अधर में लटक गई थी। 26 जुलाई को हाईकोर्ट ने नोएडा एक्सटेंशन के अन्य गांवों की सुनवाई के दौरान प्राधिकरण, बिल्डर व किसानों को 12 अगस्त तक आपस में समझौते करने का सुझाव दिया था। हाईकोर्ट के सुझाव पर प्राधिकरण ने किसानों से समझौते के लिए वार्ता की पहल शुरू की। 27 जुलाई को प्राधिकरण के सीईओ रमा रमन ने सबसे पहले पतवाड़ी गांव के प्रधान को पत्र भेज कर वार्ता करने के लिए आमंत्रित किया। दूसरे दिन ग्राम प्रधान रेशपाल यादव ने प्राधिकरण कार्यालय पहुंच कर सीईओ से बातचीत कर उनका रुख जानने का प्रयास किया था। 30 जुलाई को सीईओ ने गांव पतवाड़ी जाकर किसानों से सामूहिक रूप में बात की। इस दौरान मुआवजा वृद्धि को छोड़कर किसानों के साथ अन्य मांगों पर प्राधिकरण ने सकारात्मक रुख दिखाया। मुआवजा बढ़ोतरी पर बातचीत करने के लिए किसानों को आपस में कमेटी गठित कर वार्ता का प्रस्ताव सीईओ दे आए थे। इसके बाद किसानों के साथ गुरुवार को नोएडा के सेक्टर-62 में बैठक बुलाई गई। इसमें प्राधिकरण के सीईओ रमा रमन, ग्रामीण अभियंत्रण मंत्री जयवीर ठाकुर, सांसद सुरेंद्र सिंह नागर व जिलाधिकारी के साथ किसानों की वार्ता शुरू हुई। आठ घंटे तक वार्ता चलने के बाद किसान समझौते के लिए तैयार हो गए। सूत्रों के अनुसार पतवाड़ी गांव के किसानों को मिले 850 रुपये प्रति वर्गमीटर के अलावा 550 रुपये प्रति वर्गमीटर और देने पर सहमति बन गई है। देर रात तक बैठक जारी थी। अभी इसकी अधिकारिक घोषणा नहीं की गई है। हालांकि गांव के कुछ किसानों ने वार्ता की पुष्टि की है। इससे पूर्व किसानों की आबादी को पूरी तरह से अधिग्रहण मुक्त रखा जाएगा। बैकलीज की शर्ते हटा ली जाएगी। पतवाड़ी गांव का समझौता होने पर प्राधिकरण को नोएडा एक्सटेंशन के अन्य गांवों में किसानों के साथ समझौता करने की राह आसान हो गई है। नोएडा एक्सटेंशन विवाद ने रोके खरीददार : नोएडा एक्सटेंशन विवाद ने समूचे ग्रेटर नोएडा एवं यमुना एक्सप्रेस वे प्राधिकरण क्षेत्र में संपत्तियों की खरीद-फरोख्त पर ब्रेक लगा दिया है। दोनों जगह ढूंढे से भी खरीददार नहीं मिल रहे हैं। कुछ समय पहले तक जो लोग शहर में अपना आशियाना बनाने के लिए आतुर थे, वे अब यहां संपत्ति खरीदने से हिचकिचा रहे हंै। पिछले बीस दिनों में भूखंड व मकानों की गिनी-चुनी रजिस्ट्री हुई हैं। सिर्फ गांवों में कृषि व आबादी भूमि की रजिस्ट्री हो रही है। इससे प्रदेश सरकार को राजस्व की भी हानि उठानी पड़ रही है

    I'd like to request with NEFOMA team, pls raise FAR concern with authority regarding those construction has been started earlier(or completed structure up to some extend). Because architect have already design the structure layout considering with planned map and incorporate all facility like Lift. If no. of floor increased then no. of family increased and waiting time of lift increased and also effect the structure load and bearing capacity. I think this is very important issue should be highlight with mass movement if required.

    You have a very valid point. The load bearing capacity of a building/tower will definitely be adversely affected, if additional floors are added to a structure whose foundation has already been laid.

  • This is what I know, (sources not fully reliable, request reliable sources) for Group Housing projects
    FAR of Ghaziabad is 3.75. All new development in Indirapuram is on this FAR, total chaos in making. RNE is saved by the Hindon Air Base restrictions.
    FAR of CR is 4.0. Builder bribed GDA official to it or may be some builders in CR is facing issues for constructing more than FAR 3.75 of Ghaziabad.

    However, regarding congestion, more pertinent issue is total ground coverage. In Ghaziabad it is 30% and GNoida it is 35%. But in Ghaziabad building bye laws are a joke. That’s why CR Paramount suddenly have a tower in the central green and CR Supertech’s residents can shake hand from balcony with their neighbors in opposite tower. In GNoida, building bye lays are followed to certain extent.

    In NExtn, many builders will change layout to cater changing market dynamics. The price has increased to Rs 3000 psft, but buying power of the majority of the buyer remained between Rs. 25-30 Lakh, logical way out is more flats of smaller sizes.

    Importantly, additional FAR can be purchased by the builder, but the ground coverage remains same. Current buyers, if suddenly new towers comes in green area, the builder can be challenged though RTI in GNA on ground coverage rules.

    As you are aware that G.Noida Master Plan is approved by NCR planning Board which was mandatory to start construction as instructed by Allahabad HC. NEFOMA sent a letter to builders for confirmation on below points –

    1. When construction activities will be started in your project “Current Project Name /Sector in Noida Extension”. Please provide approx date ?


    ...
    2. Is there any change in layout of your project. What amendment has been done in layout due to additional FAR. Please provide copy of new layout ?

    3. Is there any new tower being added in new layout (If any). How much flats will be added ?

    4. Any change is super built up area of flats and open/green area ?

    What is impact of new price list on old buyers ?


    How many flat you have canceled in your projects ?

    Developers asked to start work on units ‘immediately’

    GREATER NOIDA: The Greater Noida Industrial Development Authority (GNIDA) has decided to not lose any more time and ordered developers to resume construction work in Noida Extension immediately. This direction comes as all pre-conditions to resume construction work in the area have been finally met.

    In a meeting on Monday with 25 major developers, Greater Noida Authority CEO Rama Raman directed them to resume all stalled construction work with "immediate effect." Raman also asked them to start paying their due instalments for the period between October 21, 2011 and August 2012 so that the Authority can resume halted development work.

    The developers owe the Authority a total of about Rs 20,000 crore as instalment for the land allotted to them in Noida Extension almost three years ago. However, as per the initial agreement, the entire amount is to be paid to the Authority in instalments spread over eight years.

    GNIDA has already collected nearly Rs 300 crore from the developers. However, following the Allahabad high court order on October 21, 2011, directing developers and GNIDA to stop work in Noida Extension, most developers stopped paying the due instalments. Developers owe the Authority around Rs 1,000 crore for the period between October 21, 2011 and now.

    However, the Authority has not given any deadline to the developers to pay up and has also assured them that no interest will be charged from them on the due instalments. This respite of the 'zero period' will also be applicable to buyers regarding their instalments due to the developers.

    In a meeting with homebuyers in the evening, Raman assured them that developers will not hike the rates for existing investors. The Authority has also decided to call a meeting with leading banks to assure them of the marketability of Noida Extension projects.

    Builders were asked not to charge interest from buyers for the period work on the sites was stopped.
    The Greater Noida Authority has allowed builders to start work on their sites in the Noida Extension area. In a meeting held with the builders on Monday, the Authority permitted them to commence construction in wake of the recent approval of its Master Plan 2021 by the National Capital Region Planning Board (NCRPB).

    Declaring the nearly ten months' time, during which work on the sites was stopped, as 'zero period', the Authority, however, waived off the interest levied on installments of allotments to the builders during this period.

    The Authority also asked the builders to not charge interest from their buyers during this period.

    "We have asked them clearly not to burden buyers in any manner as they have already suffered a lot during the last one year. Many buyers have actually spent a lot by paying EMIs (equated monthly installments) as well as paying house rent. They have been hit hardest during this crisis," as senior Greater Noida official who attended the meeting said.

    "We have told them clearly that if we receive any complaint from the buyers against them, we would have to act against them. No financial burden should be passed on to the existing buyers in any case," the official added.

    The builders, meanwhile, announced that they have received permission to start construction and would recommence work soon.

    Mohit Arora, managing director, Supertech, said, "The Authority had permitted us to start work just after the approval was granted. We are all prepared to start work anytime soon. The Authority had also waived off our interest during the zero period."

    As the news of builders starting their work spread, farmers expressed anguish. They plan to move the Supreme Court (SC) soon against the NCRPB's approval.

    "It is a game plan in which the innocent buyers are the only victims. Whichever builder starts work first, would attract more buyers. Irregularities are running into thousands of crores," said Parminder Bhati, a lawyer and resident of Bisrakh, in Noida Extension.


    "The people should understand that several litigations are already pending before the apex court. The Supreme Court decides cases on constitutional basis. It has already cancelled acquisitions of Shaberi and Makoda villages and villages in question now have the same illegality in common," Bhati added.

    "In all likelihood, the SC would quash the acquisitions of these villages too," Bhati further added. The farmers claimed that the Authority has acted even against the High Court's (HC) order which had asked it to get the Master Plan approved before any construction begins. "The authority should have obtained the court's permission before allowing builders to start work," said Tejram Yadav, a lawyer and Haibatpur inhabitant.

    One year before.. some condition.. cases were pending in HC... buyers were not aware...and putting money... Now only difference is buyers are now aware of case.. but still putting money.. I visited NE many times and have strong feelings that SUCH HUGE HUGE development (builder/authority) can not be cancelled by SC.. guys 130sqm road /NE flyover, connecting road.. all were made via land acquisation.... so authority can not destroy road etc.
