पतवाड़ी के किसानों का लिखित समझौता
जागरण संवाददाता, ग्रेटर नोएडा किसानों के साथ समझौते की दिशा में ग्रेटर नोएडा प्राधिकरण को बृहस्पतिवार को बड़ी सफलता हासिल हुई। पतवाड़ी गांव के किसानों के साथ प्राधिकरण का समझौता हो गया। इससे बिल्डरों व निवेशकों को बहुत बड़ी राहत मिली है। समझौता भी किसानों के लिए फायदेमंद रहा। उन्हें अब 550 रुपये प्रति वर्गमीटर अतिरिक्त मुआवजा देने पर सहमति बन गई है। साथ ही आबादी व बैकलीज की शर्तो को हटा लिया गया है। हालांकि नोएडा के सेक्टर-62 में गुरुवार को देर रात तक अन्य मुद्दों पर प्राधिकरण व किसानों के बीच बातचीत जारी थी। इलाहाबाद हाईकोर्ट ने 19 जुलाई को पतवाड़ी गांव की 589 हेक्टयेर जमीन का अधिग्रहण रद कर दिया था। अधिग्रहण रद होने से सात बिल्डरों के प्रोजेक्ट प्रभावित हुई हुए थे। 26 हजार निवेशकों के फ्लैट का सपना भी टूट गया था। प्राधिकरण के ढाई हजार भूखंड़ों, चार सौ निर्मित मकानों व दो इंजीनियरिंग कॉलेज की योजना भी अधर में लटक गई थी। 26 जुलाई को हाईकोर्ट ने नोएडा एक्सटेंशन के अन्य गांवों की सुनवाई के दौरान प्राधिकरण, बिल्डर व किसानों को 12 अगस्त तक आपस में समझौते करने का सुझाव दिया था। हाईकोर्ट के सुझाव पर प्राधिकरण ने किसानों से समझौते के लिए वार्ता की पहल शुरू की। 27 जुलाई को प्राधिकरण के सीईओ रमा रमन ने सबसे पहले पतवाड़ी गांव के प्रधान को पत्र भेज कर वार्ता करने के लिए आमंत्रित किया। दूसरे दिन ग्राम प्रधान रेशपाल यादव ने प्राधिकरण कार्यालय पहुंच कर सीईओ से बातचीत कर उनका रुख जानने का प्रयास किया था। 30 जुलाई को सीईओ ने गांव पतवाड़ी जाकर किसानों से सामूहिक रूप में बात की। इस दौरान मुआवजा वृद्धि को छोड़कर किसानों के साथ अन्य मांगों पर प्राधिकरण ने सकारात्मक रुख दिखाया। मुआवजा बढ़ोतरी पर बातचीत करने के लिए किसानों को आपस में कमेटी गठित कर वार्ता का प्रस्ताव सीईओ दे आए थे। इसके बाद किसानों के साथ गुरुवार को नोएडा के सेक्टर-62 में बैठक बुलाई गई। इसमें प्राधिकरण के सीईओ रमा रमन, ग्रामीण अभियंत्रण मंत्री जयवीर ठाकुर, सांसद सुरेंद्र सिंह नागर व जिलाधिकारी के साथ किसानों की वार्ता शुरू हुई। आठ घंटे तक वार्ता चलने के बाद किसान समझौते के लिए तैयार हो गए। सूत्रों के अनुसार पतवाड़ी गांव के किसानों को मिले 850 रुपये प्रति वर्गमीटर के अलावा 550 रुपये प्रति वर्गमीटर और देने पर सहमति बन गई है। देर रात तक बैठक जारी थी। अभी इसकी अधिकारिक घोषणा नहीं की गई है। हालांकि गांव के कुछ किसानों ने वार्ता की पुष्टि की है। इससे पूर्व किसानों की आबादी को पूरी तरह से अधिग्रहण मुक्त रखा जाएगा। बैकलीज की शर्ते हटा ली जाएगी। पतवाड़ी गांव का समझौता होने पर प्राधिकरण को नोएडा एक्सटेंशन के अन्य गांवों में किसानों के साथ समझौता करने की राह आसान हो गई है। नोएडा एक्सटेंशन विवाद ने रोके खरीददार : नोएडा एक्सटेंशन विवाद ने समूचे ग्रेटर नोएडा एवं यमुना एक्सप्रेस वे प्राधिकरण क्षेत्र में संपत्तियों की खरीद-फरोख्त पर ब्रेक लगा दिया है। दोनों जगह ढूंढे से भी खरीददार नहीं मिल रहे हैं। कुछ समय पहले तक जो लोग शहर में अपना आशियाना बनाने के लिए आतुर थे, वे अब यहां संपत्ति खरीदने से हिचकिचा रहे हंै। पिछले बीस दिनों में भूखंड व मकानों की गिनी-चुनी रजिस्ट्री हुई हैं। सिर्फ गांवों में कृषि व आबादी भूमि की रजिस्ट्री हो रही है। इससे प्रदेश सरकार को राजस्व की भी हानि उठानी पड़ रही है

  • This has not been confirmed which bench will hear Y. Expressway cases.. old one OR new bench. If these cases are given to old bench than verdict for Noida/G.Noida will come late after hearing of all cases.

    If new bench is made for Y.Expressway villeges.. than we might get verdict for Noida/G.Noida by next week. BUT in any case…. This can be confirmed only in next week.

    Exactly this is what i meant. Earlier we had hopes of a judgment by this week. But now we have to wait atleast till next week.

    Even after HC judgement, this case can go to SC. Seems ki bahut time lagega to resolve fully. Though not invested in NE, GN or YE, i hope it gets resolved asap - a win-win for both parties.

  • Hope god and bench of judges help to fulfill dreams of thousands of end users who have wished their own house in NCR… my lots of friend had invested over there…. And I know how they were curious in discussing flat layout with wife and their family member… even they had started planning different house hold item as per layout of their booked flat…

    Hope this judgment will not do injustice to any one….either farmers or flat buyers…Farmer should get compensation as per patwari and buyers get their dream home.

  • Courts dont' seem to be interested in understanding the problem of common man and its just getting lingered on one pretext or the other...
    Now i am having intution that this will not get resolved n coming six months....
    Can senior members please advice what to do ... if we wait indefinitely then other areas are getting out of approach...time when i booked in NE
    sector7xx and eway were around 2800...now they have crossed 3500..
    after another six months they will cross 4K .....

    I am sailing in the same boat. No option but W & W (wait and watch)
    and after this I started believing more strongly Anna and its JLB. Had it been there, we would not have been suffering and losing .

    HC can not suffer Lakhs of Middle Class Buyers.... it will take some time but finally some agreement will be done and good news will come for NE Buyers.... Wait & Watch will be good policy as at OLD NE booked rates it's not possible to purchase any new flat in NCR at this time....

  • Agreed that there is no other option rather than wait and watch but question is till when....if it takes too much time and result is negative then what ...??? its not like that we couldn't afford the flat in 7xxor e-way .. reason we booked in NE was that for the same price we were getting much bigger space... now if after long time results come -ive then it will be really really frustrating .. when we will see that our peers who had booked in eway or 7xx are actually nearing the posession and we are back to square one......and more over rather then having some symapthy
    with sufferrers evry party tries to get there share of leverage out of the situation like the eway and 7xx builldsers hiked prices previously by adding punchline "Clear Land and Clear title without any litigations".....

    But on the other hand, the day when NE issue get solved and land becomes clear then NE will get one of the BEST return in whole NCR..... then NE will increase double fast then other near by NCR areas..... Let me know if land is 100% clear then why people will not prefer to buy in NE rather then Noida 7x in 4000+ PSF Rate.... After problem solved NE will become most appreciable perperty area in Whole NCR.

    Its mix of residential as well as commercial. Its par with Noida.
    I pray to god to resolve the issue in favour of flat buyers. Its most probably will sorted out around December (finally). Construction will start in same speed as before.
    If the Judges use even small common sense / practical knowledge the decision will not be one sided. Court will ask:
    :give more compensation
    : leave some farmers land or compensate there land else where
    : Fair land price will be last price recorded on sale in concern village in land registry department before acqisition of the area. Court may say give 2 time or so.. for that recorded rate. Land rate appreciated because of development in NE.
    : Court may scrap some land acqisition where land still lying unattended by authority except infrastucture (already done or proposed) development like Road, sewage, school, hospital etc.

    Just refer Swami Narayan Temple case in Delhi in Yamuna River, where Supreme court said although it is illegal but it is not in the interest of public to demolish it. There are various other case also on similar line.

    Sorry to interrupt you...you used one word "court will ask", dear friend there is another court in India that is SC...if HC verdict comes, some of the farmers influenced by politicians (if it is negative/not convincing verdict for them) will surely approach SC...then how long it will take....regarding BMW buyers are not her voters bank (most of us are from outside UP).....

    I am also optimistic like you...but reality is something different.....let us wait for the unending dirty political drama.....

    Again you said "Construction will start in same speed as before" kindly clarify : from where these builders bring such a massive number of workers most of them left forever.....most difficult task is accumulating manpower, it will take time.....

    No court or politicians or builders or we (buyers) never consider about them (workers)...how they are living (without work for last some months....?).......?reality is something different

    BUT WE ARE OPTIMISTIC there will be some light at the end of the tunnel

    There was a message earlier that court hearing is finished but decision is reserved. What does it mean? Is decision already taken by HC Bench and kept to be disclosed later or decision will be taken later.
    To me following is most probable outcome:
    1) Farmers get more compensation
    2) Builders to make more flats in the same area
    3) Existing buyers do not have to pay more but new buyers to shell out more.

    If decision goes in favor of farmers and land is returned to farmers then it will be Catch 22. Land will be returned to farmers only when they have given the money back to authority (which I doubt). Builders will be after authority to get their money back (White + Non white).. Flat buyers will run around to court to get their money back. I think farmers cannot sell their land without permission from authority and authority will ensure a difficult life for farmers if it is on losing ground...

    BTW, just curious to know as how many seats can a political party lose in GNoida region due to NE?

  • It will be a mix of both of these options:
    1) Farmers get more compensation
    2) Builders to make more flats in the same area

    For areas where construction has not yet started, land will be given back. God knows what will happen to buyers of these locations. Builders will either offer their money back with/without interest (loss for buyers as they wont be able to book another flat at previous cost) or offer buyers flats in other projects - whatever non preferred flats left.

    Correct that BMW govt will ensure that farmers are not able to sell the land again.

    For areas where construction has been considerable, will take advantage of FAR increase & increase the no. of flats.

    Even if this verdict comes out, farmers (fanned by political parties) who do not get their land back, will move to SC.

    Result: Middle class buyers remain targets as usual.
