पतवाड़ी के किसानों का लिखित समझौता
जागरण संवाददाता, ग्रेटर नोएडा किसानों के साथ समझौते की दिशा में ग्रेटर नोएडा प्राधिकरण को बृहस्पतिवार को बड़ी सफलता हासिल हुई। पतवाड़ी गांव के किसानों के साथ प्राधिकरण का समझौता हो गया। इससे बिल्डरों व निवेशकों को बहुत बड़ी राहत मिली है। समझौता भी किसानों के लिए फायदेमंद रहा। उन्हें अब 550 रुपये प्रति वर्गमीटर अतिरिक्त मुआवजा देने पर सहमति बन गई है। साथ ही आबादी व बैकलीज की शर्तो को हटा लिया गया है। हालांकि नोएडा के सेक्टर-62 में गुरुवार को देर रात तक अन्य मुद्दों पर प्राधिकरण व किसानों के बीच बातचीत जारी थी। इलाहाबाद हाईकोर्ट ने 19 जुलाई को पतवाड़ी गांव की 589 हेक्टयेर जमीन का अधिग्रहण रद कर दिया था। अधिग्रहण रद होने से सात बिल्डरों के प्रोजेक्ट प्रभावित हुई हुए थे। 26 हजार निवेशकों के फ्लैट का सपना भी टूट गया था। प्राधिकरण के ढाई हजार भूखंड़ों, चार सौ निर्मित मकानों व दो इंजीनियरिंग कॉलेज की योजना भी अधर में लटक गई थी। 26 जुलाई को हाईकोर्ट ने नोएडा एक्सटेंशन के अन्य गांवों की सुनवाई के दौरान प्राधिकरण, बिल्डर व किसानों को 12 अगस्त तक आपस में समझौते करने का सुझाव दिया था। हाईकोर्ट के सुझाव पर प्राधिकरण ने किसानों से समझौते के लिए वार्ता की पहल शुरू की। 27 जुलाई को प्राधिकरण के सीईओ रमा रमन ने सबसे पहले पतवाड़ी गांव के प्रधान को पत्र भेज कर वार्ता करने के लिए आमंत्रित किया। दूसरे दिन ग्राम प्रधान रेशपाल यादव ने प्राधिकरण कार्यालय पहुंच कर सीईओ से बातचीत कर उनका रुख जानने का प्रयास किया था। 30 जुलाई को सीईओ ने गांव पतवाड़ी जाकर किसानों से सामूहिक रूप में बात की। इस दौरान मुआवजा वृद्धि को छोड़कर किसानों के साथ अन्य मांगों पर प्राधिकरण ने सकारात्मक रुख दिखाया। मुआवजा बढ़ोतरी पर बातचीत करने के लिए किसानों को आपस में कमेटी गठित कर वार्ता का प्रस्ताव सीईओ दे आए थे। इसके बाद किसानों के साथ गुरुवार को नोएडा के सेक्टर-62 में बैठक बुलाई गई। इसमें प्राधिकरण के सीईओ रमा रमन, ग्रामीण अभियंत्रण मंत्री जयवीर ठाकुर, सांसद सुरेंद्र सिंह नागर व जिलाधिकारी के साथ किसानों की वार्ता शुरू हुई। आठ घंटे तक वार्ता चलने के बाद किसान समझौते के लिए तैयार हो गए। सूत्रों के अनुसार पतवाड़ी गांव के किसानों को मिले 850 रुपये प्रति वर्गमीटर के अलावा 550 रुपये प्रति वर्गमीटर और देने पर सहमति बन गई है। देर रात तक बैठक जारी थी। अभी इसकी अधिकारिक घोषणा नहीं की गई है। हालांकि गांव के कुछ किसानों ने वार्ता की पुष्टि की है। इससे पूर्व किसानों की आबादी को पूरी तरह से अधिग्रहण मुक्त रखा जाएगा। बैकलीज की शर्ते हटा ली जाएगी। पतवाड़ी गांव का समझौता होने पर प्राधिकरण को नोएडा एक्सटेंशन के अन्य गांवों में किसानों के साथ समझौता करने की राह आसान हो गई है। नोएडा एक्सटेंशन विवाद ने रोके खरीददार : नोएडा एक्सटेंशन विवाद ने समूचे ग्रेटर नोएडा एवं यमुना एक्सप्रेस वे प्राधिकरण क्षेत्र में संपत्तियों की खरीद-फरोख्त पर ब्रेक लगा दिया है। दोनों जगह ढूंढे से भी खरीददार नहीं मिल रहे हैं। कुछ समय पहले तक जो लोग शहर में अपना आशियाना बनाने के लिए आतुर थे, वे अब यहां संपत्ति खरीदने से हिचकिचा रहे हंै। पिछले बीस दिनों में भूखंड व मकानों की गिनी-चुनी रजिस्ट्री हुई हैं। सिर्फ गांवों में कृषि व आबादी भूमि की रजिस्ट्री हो रही है। इससे प्रदेश सरकार को राजस्व की भी हानि उठानी पड़ रही है

    It will not be applicable in West greater noida land acquistn.
    The farmers are becoming fool by doing all the agitation. My POV is that farmers are not going to get extra compensation as sugested by Allahabad high court. Farmers will get only compensation offered previously by GNA.

    The authority snatched the land from farmers and given it to builders after changing the land use ... According to the law it is illegal and thus the whole acquisition should be nullified .. This is what the law says as interpreted by the lawyers.

    Builders have a different version that they have bought it from the authority ..

    Tell me something if I snatch a car from someone then sell it to someone who inturn sells its pieces to different guys will all of them be not convicted for the criminal conspiracy of stealing and using stolen property.

    Likewise it is a criminal conspiracy by the authority, the builders, the buyers and all in between to unlawfully snatch piece of property and then try to use it.

  • Welcome to India! it applies to all land acquisitions in India. Be it UP or Haryana..land will come from farmers only and you will always find some problem with whole process. You making noise because it came to public view. Every Govt to Businessmen transactions are loaded with some deviation from process.

    Don't worry about NE...I don't think you have invested so don't worry about it. This will be sorted with more money from authority to farmers.

    you are mistaken my friend about haryana - in haryana the govt is mere facilitator it does not snatches land from farmers using the urgency clause and later gives it to private builders for different purpose for which the rules are much tougher.

    in haryana all the land which are bought from farmer by private townships are fully paid to the farmer govt has very little role to play other than the development of infra.

    So update yourself and once again its a criminal case in gr noida west or noida ext and supreme court will deal with that accordingly.

    As of today every sq ft of gr noida west is unsafe for buyers

  • My two cents in this matter

    1. Even if Greater Noida West is 1% less safe than other area, then end user should not opt for this. There are other options also. Even if other options are far/less space in same price or some other problems then also it is better because for end user safety of fund is most important. Even banks are still taking undertaking from buyers that in any mishapp they have to pay emis irrespective of whether they get home or not. Builders have also added in their BBAs that any over compensation will be beared by buyers only. So buyers are bound from all sides. A home buyer( whether first time or seasoned buyer can never be smarter than builders or banks).
    2. Neither banks are taking any such undertaking in any other area nor builders are having such clauses in other areas. So It means there is still some percentage of risk so end users should restrict themselves. Kisi aur area mein thodi takleef bhi ho to takleef jhelni chahiye, kyonki takleef apne ghar mein toh jheloge. Investors can very well go with Noida Extension because agar 5-10 flats mein se 1-2 barbaad bhi ho gaye toh baki se loss poora ho jayega.
    3. Most Important : If I buy anything anywhere in the world, then I am owner & I have full rights to do whatever I wish with my buy, like I can gift, rent, sell, destroy or anything. But when You buy in NE you dont have the right to resell. Yeh kaun si gundagardi hei, please koi toh samjha do mere ko.

    If anybody is hurt, please pardon me, I am not very learned person for NE matters.

    Disclaimer: I am not invested in Noida Extension. Visited the area only twice before the land aquisition problem. At that time I rejected the area because Land was purchased on hire purchase by the builders & I did not have faith in any builder that after completing the project they will complete their installments. I am an End User & happy now a days & getting my posession in next 15 days. I dont have to do anything with above fight going on.

    I agree with you on points 1 and 2, if you think the legal mess is potentially disastrous to your financial well being and expected returns are not worth the risk, then staying away from NExtn is the right decision.

    However, I disagree with your point 3, you are not the owner of the flat until registry is done. The same will be case in NExtn. You can not take moral high-ground in case of transfers. Transfers are a way to bypass the law itself by taking the difference in black and avoiding registry amount.

    How come a place where nobody is living has ...wide roads (130 m, 60 m), service roads (24 m), intersector roads (60m), underground sewage, beautiful roundabouts, green belts, parks, street lights and now a Mall.
    Above that the area is only three years old in total, with no work for more than an year.


    What about people who think, facilities come after more than a decade of people living at the place :Cry::Cry::Cry:, there is no respect for conventional wisdom.

    You mean to say that all over India law is broken when some resell is happenning before registry & only NE is legal in this way. I am surprised to know. It is not necessary to take extra profit in black only. I have seen cases when people are buying in resell in pure white money through bank loan. I dont see anything illegal in this....

    I never wrote, NExtn is some alternate correct way, you missed it completely. Well I am not a lawyer, but have always seen the difference demanded and given in black only, therefore that's my perception regarding transfers.

    Nice to see ur couter point. Appreciate that u have something to spend ur valuable time on this forum.

    -Acquisition of Land: Read land acusition Act made by Angrej. No where it prohibited to Gov not to acquire the land. Gov has full right to do so.

    - Changing land use: Where it is stated Government cant change the land use. Show me the act.

    - Compensation to land owners: Where it is stated that Gov has to pay xxx Rs amount as compensation. It is all upto Gov.


    Dont blame Government. Blame the Laws.
    If laws is wrong u cant blame others.

    Here in India we people use to say "every thing will be done as per laws:D" Hahahaha

    But i always say Nehru n Ambedkar made the laws so it was not laws for every indian but it was for Nehru n ambedkar family.

    Why rest of Indian suffer because of these stupid genious.
