पतवाड़ी के किसानों का लिखित समझौता
जागरण संवाददाता, ग्रेटर नोएडा किसानों के साथ समझौते की दिशा में ग्रेटर नोएडा प्राधिकरण को बृहस्पतिवार को बड़ी सफलता हासिल हुई। पतवाड़ी गांव के किसानों के साथ प्राधिकरण का समझौता हो गया। इससे बिल्डरों व निवेशकों को बहुत बड़ी राहत मिली है। समझौता भी किसानों के लिए फायदेमंद रहा। उन्हें अब 550 रुपये प्रति वर्गमीटर अतिरिक्त मुआवजा देने पर सहमति बन गई है। साथ ही आबादी व बैकलीज की शर्तो को हटा लिया गया है। हालांकि नोएडा के सेक्टर-62 में गुरुवार को देर रात तक अन्य मुद्दों पर प्राधिकरण व किसानों के बीच बातचीत जारी थी। इलाहाबाद हाईकोर्ट ने 19 जुलाई को पतवाड़ी गांव की 589 हेक्टयेर जमीन का अधिग्रहण रद कर दिया था। अधिग्रहण रद होने से सात बिल्डरों के प्रोजेक्ट प्रभावित हुई हुए थे। 26 हजार निवेशकों के फ्लैट का सपना भी टूट गया था। प्राधिकरण के ढाई हजार भूखंड़ों, चार सौ निर्मित मकानों व दो इंजीनियरिंग कॉलेज की योजना भी अधर में लटक गई थी। 26 जुलाई को हाईकोर्ट ने नोएडा एक्सटेंशन के अन्य गांवों की सुनवाई के दौरान प्राधिकरण, बिल्डर व किसानों को 12 अगस्त तक आपस में समझौते करने का सुझाव दिया था। हाईकोर्ट के सुझाव पर प्राधिकरण ने किसानों से समझौते के लिए वार्ता की पहल शुरू की। 27 जुलाई को प्राधिकरण के सीईओ रमा रमन ने सबसे पहले पतवाड़ी गांव के प्रधान को पत्र भेज कर वार्ता करने के लिए आमंत्रित किया। दूसरे दिन ग्राम प्रधान रेशपाल यादव ने प्राधिकरण कार्यालय पहुंच कर सीईओ से बातचीत कर उनका रुख जानने का प्रयास किया था। 30 जुलाई को सीईओ ने गांव पतवाड़ी जाकर किसानों से सामूहिक रूप में बात की। इस दौरान मुआवजा वृद्धि को छोड़कर किसानों के साथ अन्य मांगों पर प्राधिकरण ने सकारात्मक रुख दिखाया। मुआवजा बढ़ोतरी पर बातचीत करने के लिए किसानों को आपस में कमेटी गठित कर वार्ता का प्रस्ताव सीईओ दे आए थे। इसके बाद किसानों के साथ गुरुवार को नोएडा के सेक्टर-62 में बैठक बुलाई गई। इसमें प्राधिकरण के सीईओ रमा रमन, ग्रामीण अभियंत्रण मंत्री जयवीर ठाकुर, सांसद सुरेंद्र सिंह नागर व जिलाधिकारी के साथ किसानों की वार्ता शुरू हुई। आठ घंटे तक वार्ता चलने के बाद किसान समझौते के लिए तैयार हो गए। सूत्रों के अनुसार पतवाड़ी गांव के किसानों को मिले 850 रुपये प्रति वर्गमीटर के अलावा 550 रुपये प्रति वर्गमीटर और देने पर सहमति बन गई है। देर रात तक बैठक जारी थी। अभी इसकी अधिकारिक घोषणा नहीं की गई है। हालांकि गांव के कुछ किसानों ने वार्ता की पुष्टि की है। इससे पूर्व किसानों की आबादी को पूरी तरह से अधिग्रहण मुक्त रखा जाएगा। बैकलीज की शर्ते हटा ली जाएगी। पतवाड़ी गांव का समझौता होने पर प्राधिकरण को नोएडा एक्सटेंशन के अन्य गांवों में किसानों के साथ समझौता करने की राह आसान हो गई है। नोएडा एक्सटेंशन विवाद ने रोके खरीददार : नोएडा एक्सटेंशन विवाद ने समूचे ग्रेटर नोएडा एवं यमुना एक्सप्रेस वे प्राधिकरण क्षेत्र में संपत्तियों की खरीद-फरोख्त पर ब्रेक लगा दिया है। दोनों जगह ढूंढे से भी खरीददार नहीं मिल रहे हैं। कुछ समय पहले तक जो लोग शहर में अपना आशियाना बनाने के लिए आतुर थे, वे अब यहां संपत्ति खरीदने से हिचकिचा रहे हंै। पिछले बीस दिनों में भूखंड व मकानों की गिनी-चुनी रजिस्ट्री हुई हैं। सिर्फ गांवों में कृषि व आबादी भूमि की रजिस्ट्री हो रही है। इससे प्रदेश सरकार को राजस्व की भी हानि उठानी पड़ रही है

  • Indeed. It is a gud news but I am still scared to express my joy. The farmers have really made wise decision. They also know that this is the limit of hike in compensation. Authority will never pay more than that as it is practically not possible for them given the debt they are currently in.

    So for a wise person, there was no benefit to continue protesting and be uncertain about what they will get or not. They can not sell the land directly to builder and there was no other way that they could get more money. They were also not certain what they will do if the court directs them to get the land and return the money.

    Further, they also know that they can torture authority to certain extent only and if they cross the limit, they will cause the authority to committ sucide(return land and all projects scrapped) and land owners will have to undergo punishment(no development, no more money, etc.)

    Now, villagers of patwari will desperately seek that all projects of NE go ahead and area is developed fast as Mr. Rishipal yadav , Headman of Patwari said, "We have got money and now we want development work to resume"

    Bhai, 8% developed land bhi to milni hain and if area sees development and Pradhan sahab holds the plot for next 3-4 years, Pradhan sahab can himself become a builder(He will be getting a plot measuring more than 20 thousand square meters) or can sell the plot in crores.

    We all know Its all about MONEY and Farmers understood Its no more agriculture Land for them. Better to take compensation with no more further politics.

    If NA/GNA will decide to give higher compensation for rest all areas then whole Drama will solve in one short.

    Aug 17 2011 is like judgment day and what would be the next situation for Noida / Greater Noida. It will be getting clear.

    Authority/BMW already made lot of profits even we can not calculate about that so even if in case Court will give the judegement in the favor of Farmers. BMW will sort it by hook or crook. :bab (45):

    I am happy to see that builders are putting in money and thus increasing their stake - this makes this more credible - however still the oversupply situation and lease hold issue remains as it was which does not help changing my stance on Noida xxxx .

    I am still bearish from the investment point of view in Noida xxx - for enduser - if you work in that region - find a decent builder who has shown active interest and stick with them - those who are cash rich may look at finding some ready to move stuff.

    Overall agree. But here are my two cents:

    --> Any ready to move in House will cost you more then 40 lakhs, for a decent 2 BHK. While the cost of the same was around 20lakh for the NE region. Thats why many of us bought the house there. Else, who would not love to buy a kothi in Defense colony.

    --> As far as NE as a region to live is concerned, any region becomes livable once people start living over there. Density is not that a big problem. Ask a person living in Chandni Chowk. he wont give up that area to come in a posh colony of Noida or for that matter, for any other region.:bab (22):

  • This is definately a good news for people who have booked in NE. But i still think that this issue is far from over and will take more time to get resolved.
    Also it may take months for banks to start the process to funding projects.

    Yeah..really for them...angoor khattey haen.
    Coz things are going to be fine one day. Goverment cant loose its money which is in tune of over 100000 crore that is has spend on the development of the sectors. They will sort it out one way or other, although it might take some time. And eventually the money the authority is gonna spend, they will pass it to builders who will charge the money, as they are saying, from the new buyers.And thus rate for that region will increase.
    So overall scnerio looks good. Its just that becoz of all this political drama, the project might get delayed

    LUCKNOW: When farmers are coming forward to reclaim their land acquired for long but not used by the Uttar Pradesh government, the latter has amended the law to stop farmers from doing so.

    The move also clashes with the provisions in the new land acquisition law proposed by the Central government. The Uttar Pradesh government on Thursday got the Uttar Pradesh Urban Planning and Development Amendment Bill 2011 approved by the state assembly amid uproar and then adjoined the assembly sine die. After the amendment, now people will not be able to stake claim to get back their land once acquired by the government, even if it is not used for more than five years after acquisition.

    Earlier, the law gave right to the people to get compensation and reclaim their land if it was not used by the government within five years. Now, the amendment empowers government to keep the unused land as long as it wants. Significantly, on Thursday, farmers of Nithari, Chaura Sadarpur and Morna in Gautambudh Nagar filed a petition in the Allahabad High Court to get back their land which was acquired in 1976 by the UP government. Farmers said that around 1500 bigha of land was acquired by the district development authority for urbanization but it has not been put to use till date.

    The High Court has admitted the petition and fixed August 17 for hearing the case. Further, on Monday last, the Allahabad High Court had stayed acquisition of 317 hectare of land by UP government in three villages of Bulandshahr. The state government had acquired the land in Junaidnagar, Budhnagar and Saraiya for industrial development in 1998-99 using urgency clause of the Land Acquisition Act 1894 . However, the land has not been used till date.

    The villagers now want their land back or adequate compensation as per the latest land rates. The High Court after hearing the petition of villagers, stayed the land acquisition and gave a month time to government to resolve the issue by negotiating with villagers. Significantly, the amendment which denies right to reclaim was passed on the last day of the monsoon session of the state assembly. It was adjourned sine die following uproar by the Opposition. Later, opposition parties termed the amendment as anti farmer. Leaders of SP, BJP, Congress and RLD have also accused the BSP government of showing utter disregard to parliamentary procedure by getting the amendment passed in the state assembly without any debate.

    The amendment done by the Uttar Pradesh government also clashes with the new land acquisition and rehabilitation law proposed by the Congress led UPA government at the centre. The proposed law gives right to reclaim acquired land if not used for five years. Uttar Pradesh government officers, while justifying the move, said that the amendment is applicable only for acquisitions done by urban development authorities.

    It does not include acquisition done under the Land Acquisition Act 1894 for industrial or any other public purpose, they added. Further, they said that acquisition will be done as per new land acquisition and rehabilitation policy of the state government, which has provisions for adequate compensation and rehabilitation, hence there will be no public resentment.

    GREATER NOIDA: The Greater Noida authority raced against time to hand out higher compensation cheques to more than half of Patwari villagers before the Allahabad high court's deadline for reaching an out-of-court settlement with the farmers ended on Thursday night.

    However, the residents of this Noida Extension village, even those who had accepted the cheques, were refusing to withdraw their petitions in court.

    Last month, the court had acted on a single petition to reverse the land acquisition in the entire village. Other petitions by Patwari villagers are still pending. By doling out higher compensation to re-acquire the Patwari land, the authority hopes to set the tone for winning over the other 10 villages in the area.

    But Patwari villagers seem to have other plans. Although more than 700 farmers had taken their cheques, their lawyer claimed they were yet willing to withdraw their petitions. "Why should the farmers withdraw their petitions?" asked Parmendra Bhati, the advocate for many Patwari farmers. "In fact, we are filing another 18 petitions on behalf of Patwari villagers in court on Friday."

    The farmers claim that they cannot be forced to withdraw their petitions. "We will meet the authority in court on August 17 and let the court decide," said a farmer.

    Said village head Reshpal Yadav, "I have not yet withdrawn my plea. We will see about it as GNIDA is not keeping its word as per the agreement."

    Meanwhile, about 500 farmers of Patwari who have refused to collect their compensation cheques said the authority had repeatedly called them to come and collect the compensation cheques giving them time up to midnight of Thursday to sign and settle. "We are not willing to compromise and will wait for the HC's decision on August 17," said Kallu Singh Yadav, a farmer from this group.

    After the August 6 pact between Patwari villagers and the authority, around 1400 farmers from Patwari were entitled to the hiked compensation. "The higher compensation has brought an additional burden of Rs 295 crore on the authority," said a senior Greater Noida Authority official. The authority is hopeful of getting individual agreements from a majority of the farmers which they would submit in court.

    Meanwhile till Thursday, having chased a target of handing out almost 1,000 cheques to farmers of Patwari village, the authority is now gearing up to compile the data of all farmers who have accepted their hiked compensation, for presenting it to the HC on August 17, the next date of hearing.

    Farmers of about a dozen other villages have moved court, seeking quashing of land acquisition. The court will hear all related matters on August 17 and decide on the fate of 70,000 houses booked in Haibatpur, Bisrakh, Itedha, Ghanghola, Devla and Roza-Yakoobpur. Around 2.25 lakh houses have been planned. If the Patwari pact holds, it will save 20,000 under-construction dwelling units in the Noida Extension-Greater Noida area which falls in 589 hectares of Patwari village land.

    ग्रेटर नोएडा प्राधिकरण पतवाड़ी गांव के किसानों के साथ समझौता करने में कामयाब हो गया, लेकिन निवेशक व बिल्डरों को अभी राहत नहीं मिली है। किसानों से लेकर प्राधिकरण तक सभी की निगाहे 17 अगस्त को हाईकोर्ट में होने वाली अहम सुनवाई पर है। इस दिन करीब एक दर्जन गांवों की याचिकाएं उच्च न्यायालय के सामने होंगी। निवेशकों व बिल्डरों में इस बात को लेकर बैचेनी है कि समझौते के बाद कोर्ट का क्या रुख होगा। इसका अन्य गांवों के किसानों के साथ प्राधिकरण का समझौता नहीं हो पाना है।
    हाईकोर्ट में बुधवार को पतवाड़ी के अलावा बिसरख, रोजा याकूबपुर, हैबतपुर, इटेड़ा, ऐमनाबाद, खैरपुर गुर्जर, सैनी, देवला, जुनपत, घोड़ी बछेड़ा आदि गांवों के किसानों की याचिकाओं पर सुनवाई होनी है। साबेरी व पतवाड़ी की तरह इन गांवों में भी इमरजेंसी क्लाज लगाकर जमीन अधिग्रहीत की गई थी। करीब तीन दर्जन बिल्डरों को इन गांवों में ग्रुप हाउसिंग योजना के लिए भूखंड आवंटित किए गए हैं जिन पर करीब एक लाख फ्लैट बनने हैं। निवेशक आशु शर्मा व रंजीत मिश्रा का कहना है कि नोएडा एक्सटेंशन का अस्तित्व अब कोर्ट के फैसले पर निर्भर है। कोर्ट ने इन गांवों में भी अधिग्रहण रद कर दिया तो सभी बिल्डरों की परियोजनाएं प्रभावित हो जाएंगी। जिन परियोजनाओं में उन्होंने फ्लैट बुक करा रखे हैं, वे अभी प्रभावित नहीं है। बुधवार की सुनवाई में उनका भविष्य तय होगा। किसान भी सुनवाई पर टकटकी लगाए बैठे हैं। बिसरख गांव के किसान राजपाल भाटी का कहना है कि प्राधिकरण के साथ वार्ता अब 17 अगस्त की सुनवाई के बाद ही होगी। पतवाड़ी के समझौते के बाद प्राधिकरण अधिकारियों के चेहरे से चिंता की लकीरें कुछ कम जरूर हुई हैं, लेकिन ये पूरी तरह हटी नहीं है। अधिकारी इस बात से आशंकित हैं कि कोर्ट अन्य गांवों में साबेरी व पतवाड़ी जैसा आदेश जारी न कर दे। वहीं प्राधिकरण के अधिकारी सुनवाई से पहले इस बारे में कुछ भी बोलने को तैयार नहीं हैं।
