    File FIR. This is straight case of cheating.. Collect all ads, receipts, documents, emails.

    Have faith.. DD Township did the same thing and projected refund with 9% interest and sold entire license lock stock barrel to BPTP by kite flying through FDI. Now facing charges of cheating and fraud. Family member(s) of promoter in Tihar.

  • All the member have started getting money back in their account. That too this is happening surprisingly. We have not submitted any cancellation requests.
    This is a very big mistake which Spire has done. They shouldn't have transferred money like this. That too no communication from their side like letters or emails.

    Actually, they must have consulted their legal department and did this in hurry. But they don't know that there are better advocates in market and this will be their biggest mistake. The main reason is that License is still present in the JV company name and land papers etc. Hence, they cannot cancel the units like this.

    Straight away file a case with EOW as a group of minimum 20 buyers.

    Please read the recent judgement rejecting bail plea of DD township being tried for Cheating and mass fraud.. In brief, DD Township invited applications for plots in 2008 without license and signed agreements with FDI and sold stuff in 2010 when license was obtained. FDI transfers rights to BPTP subsequently. DD/BPTP agree to pay buyers with 9%.. Rest follow details of the case in attached HC Judgement Rejecting Bail of Mr Sanjay Gambhir, Director DD. Now in Tihar for a long time.

    Multiple FIRs will be required to be filed if you thing it is worth fighting for your own money..

    Whatever the limitation of the builder may be, he cannot force a 3rd party liability on buyers who have bought in good faith.

    Notably, the Case against DD township in HC of Delhi is fought by a Public prosecutor and not by a team of paid high flying lawyers.. Have guts to call a spade and spade and spare some time in filling complaints collectively with EOW and FIR in local police stations.

    Dear All,

    The investors of Spire Central project in sector 106 have been made to suffer badly by the promoters. The company after holding the investor's monies for more than 2 years, unilaterally cancelled the project and has refunded the money of the investors back into their accounts. This was done without any formal communication to the investors about the project license being cancelled or any explanation or reason for it. Phone calls to the company office just say that the license is cancelled since there is some case going on some of their other land in amritsar.. even this is a new communication since till a month back they were saying approvals have not been received on the plan..

    today those investors are all stranded and left with no where to go with the rate having increased more than almost 200% ...and the plight of those who bought it in resale is even worse since the company has only refunded the amount which was paid to them and not the premium which these investors paid to the sellers in resale..that premium amount as of date stands lost with normal buyers stranded with loans and leveraged assets...

    i appeal to all forum members to help the investors of spire central get justice by restraining from investing in their other projects and guiding us with whatever information and support we can get on next steps to get justice...

    i wud also request the moderators to make this a sticky thread so that we can gather as much public support in our fight for justice...

    if we allow builders to get away like this, none of us can be sure of our monies as to when a builder decides to cancel the project and refund the money...resale of projects will become very risky if a precedent like this gets set and the builder gets away scot free...
