        The toll plaza on the Delhi-Gurgaon express way has been in the news recently for all the wrong reasons

        Haryana chief minister Bhupinder Singh Hooda today said the state government is in talks with the National Highway Authority of India (NHAI) and the Ministry of Road Transport to buy out Gurgaon Toll Plaza, which has been caught in a logjam because of dispute over toll charges.

        The toll plaza on the Delhi-Gurgaon express way has been in the news recently for all the wrong reasons.

        The Punjab and Haryana High Court made the Plaza toll-free on the Delhi-Gurgaon border for a period of two weeks after the cancessionare - Delhi Gurgaon Super Connectivity Limited (DGSCL) - failed to provide a proper plan to avoid congestion at the toll.

        Earlier, the NHAI had also sent a notice to terminate contract to DGSCL, an issue which was later resolved out of court.

        On the recent union Cabinet decision to defer a decision on minimum support price (MSP) for wheat, Hooda said that he has written to Union agriculture minister Sharad Pawar to hike MSP as fertilzer costs have gone up.

        Haryana is the second largest wheat producer in India.

        The Cabinet recently deferred a decision on minimum support prize for wheat for 2013-14 crop marketing season (April-March). Earlier, the Commission for Agriculture Costs and Prices (CACP) recommended to freeze MSP of wheat at 2012-2013 level of Rs 1,285 per quintal to curtail the rising subsidy.

        On the repeated labour problems in Gurgaon hurting investor sentiments, Hooda said there is no general issues with labour in Gurgaon, but only specific problems which are being dealt on a case-by-case basis.

            Vehicles with Congress flag get e-way free ride

            Thousands of vehicles ferrying Congress supporters to the party's rally at Delhi's Ramlila Maidan on Sunday were allowed free passage at the toll plaza of the Delhi-Gurgaon Expressway. Vehicles, including trucks and other commercial vans, which were used to ferry supporters from Gurgaon, Rewari, Mewat and other parts of Southern Haryana passed through the expressway.
            But, the toll operators did not stop any vehicle bearing flags and posters of the Congress party. The boom barriers at both the toll plazas (Delhi-border Sirhaul and Kherki Daula) were lifted for all rally-bound vehicles.

            The South Delhi Municipal Corporation, which levies entry tax on each commercial vehicle entering the national capital through expressway, also did not charge any tax from these vehicles.

            Officials of the toll operator firm, Delhi Gurgaon Super Connectivity Limited (DGSCL) that has already lost toll revenue to the tune of R10 crore following a ban on toll collection imposed by the high court in September, refused to comment on the matter.

            Sources in the DGSCL confirmed the loss of lakhs of rupees due to free passage given to rally-bound vehicles. The Gurgaon police, however, denied of any 'special' instructions being issued to the toll operator for allowing free passage to rally-bound vehicles.

            "We have no knowledge of rally-bound vehicles being allowed free-passage. There were no instructions to the toll authorities in this regard," ACP (Traffic) Ravinder Tomar said.

            Many Congress leaders said that vehicles which were part of their convoy enjoyed a toll-free ride on the expressway.

            A Haryana Congress leader and MLA Rao Dharampal said that he led a convoy of about 1000 vehicles carrying party supporters to the rally.

            "Our convoy did not face any problem at the toll plaza as the boom barriers were lifted without our people paying toll charges. We had supporters from neighbouring districts such as Mewat and Mahendergarh. How come they can charge toll from us? Haryana government is already planning to take over this toll plaza," the MLA said.

            Madan Lal Grover, member of Pardesh Congress Committee (PCC), who claimed to have led 325 vehicles to the rally, also said none of the vehicles in his convoy had to stop at the toll plaza.

            A toll collection staff said on the condition of anonymity that he had clear-cut instructions from senior officials to not to charge toll from the vehicles carrying Congress flags.

                  With the very connected congress leader Abhishek Manu Singhvi fighting for DGSCL, it is unlikely that Haryana Govt can get rid of Toll. This is given and unfortunately this bane to the Millennium city is going to stay now...

                  The Delhi-Gurgaon expressway operator on Wednesday told the Delhi High Court that it was willing to get out of the project provided it was cleared off all the liabilities.

                  But the National Highway Authority of India (NHAI) rejected the proposal, saying “it was nothing new and the operator had to comply with all the obligations”.

                  The NHAI had last year slapped a contract termination notice on the operator for violating terms of agreement.

                  “It is a gross misinterpretation of facts to say that the toll plaza is running at a loss when it is profitable... attempts are being made to push us out just when profits have started coming in after we invested so much on the project,” senior lawyer Abhishek Manu Singhvi, counsel for concessionaire Delhi-Gurgaon Super Connectivity Ltd (DGSCL), told justice Manmohan Singh.

                  The operator denied NHAI’s allegation that it had “siphoned off” R676 crore meant for the toll plaza towards other projects.

                  The court had on March 22 stayed a fresh show-cause notice issued by the NHAI to the operator on March 8 for its alleged failure to upgrade facilities and renovate the road that connects the national capital with the millennium city.

                  The court, which is hearing a petition filed by DGSCL against the first termination notice on February 18, 2012, said operation of the fresh notice was stayed till the court took a final stand on the earlier notice.The fresh notice came five months after both sides said they had settled the differences between them and had signed a memorandum of understanding.

                  The financiers of the project, Infrastructure Development Finance Company Ltd, had also signed the MoU.The NHAI board had also proposed that the number of trips for frequent commuters should be brought down to 40 a month against the existing 60 trips.

                    GURGAON: The Delhi-Gurgaon expressway is the only expressway in the country against which the National Highways Authority of India (NHAI) has received complaint over misappropriation of funds in the past three years.
                    The NHAI has twice issued termination or show cause notice to the private concessionaire, Delhi-Gurgaon Super Connectivity Ltd (DGSCL), in the past 14 months. A show cause notice for termination was issued by the NHAI to the private concessionaire on March 8, 2013, for failure to execute the measures and meet the targets as specified in the memorandum of understanding signed on September 18, 2012.

                    In reply to a question asked in parliament recently, the road transport and highway ministry stated that it has received no such reports in case of public-funded projects. The ministry, however, stated that it has received complaint against the DGSCL under the build-operate-transfer (BOT) toll projects.

                    The ministry was asked whether the government had received any complaints regarding misappropriation of funds at different toll plazas during the past three years and the current year, and details of the steps taken against the guilty toll plaza.

                    NHAI first issued termination notice on February 18, 2012 to the DGSCL for executing a loan agreement with Infrastructure Development Finance Company (IDFC) on September 9, 2010, without the knowledge and prior consent of the highways authority. IDFC signed a loan agreement after completion of the project (commercial operation started in January 2008) without the knowledge and consent of the NHAI for refinancing the project for a debt of Rs 1600 crore.

                    The highways authority issued a termination notice but the same was not given effect to as per interim order of the Delhi high court. Later, an MoU having the the terms of settlement was signed on September 18, 2012 between NHAI, IDFC and concessionaire in the high court.

                    The NHAI board later in a meeting on January 30, 2013, accepted to acquire 74% equity shares in the DGSCL by IDFC either directly or through its associates or affiliates as per concession agreement. However, IDFC has informed that they could not acquire the shares due to non-cooperation by the concessionaire. The private concessionaire failed to execute the measures or meet the targets specified in the MoU. Accordingly, a show cause notice for termination has been issued to the concessionaire on March 8, 2013, by the NHAI. The concessionaire has filed a petition in the Delhi high court against the show cause notice issued by the NHAI. The matter is sub-judice at present.

                    Replying to a question whether the government reviews the functioning of toll plazas on different national highways and expressways in the country, the ministry stated that functioning of the toll plazas is reviewed by the officials of the government and NHAI at different levels. Necessary corrective action as per the provisions in the contract agreement is being taken. Some of them are displaying proper fee display boards, excess/ less collection, depositing weekly remittance, maintaining server data, maintenance of proper records, facilitation of road users, staff welfare by the employer, review of complaints received at toll plazas. The government is implementing electronic toll collection system using Radio Frequency Identification (RFID) technology to improve the functioning of toll plazas on the national highways across the country.
