I am in process to buy a flat in resale, but Builder has not yet started transfers.

So if I pay full amount then also there would be no transfer to my name till builder starts transfers from there end.

Seller is in need of urgent cash as he is not able to pay current demand from the builder.

My dealer is suggesting, to pay 30% of sale deed as advance which is equals to the demand raised by builder so that seller can pay the same to builder; after resisting dealer is saying that i can give chequ favouring builder itself so that with sale agreement this cheque statement can also be shown as proof, and another clause he is suggesting to alter in agreement is 'if seller backs out to transfer unit in future then he would be liable to pay 3 times of agreement amount instead of 2 times'.

Please suggest guys, should I go ahead with the deal, or do i need to take any extra steps or should I back out? Its very urgent, replys would be much appreciated.
